Amends the Criminal Code of 1961. Eliminates the provision that a prosecution of a spouse of a victim for any violation by the victim's spouse for criminal sexual assault, aggravated criminal sexual assault, criminal sexual abuse, or aggravated criminal sexual abuse is barred unless the victim reported the offense to a law enforcement agency or the State's Attorney's office within 30 days after the offense was committed, except when the court finds good cause for the delay.
Amends the Code of Criminal Procedure of 1963. Provides that an investigative entity must turn over to the prosecutor all information, whether incriminating or exculpatory, gathered in an investigation. Adds provisions for a petition for a new trial based on an independent claim of actual innocence based on newly discovered evidence. Adds provisions for the actual innocence hearing. Requires that the defendant establish his or her innocence by clear and convincing evidence before the court may order a new trial.
Amends the Code of Criminal Procedure of 1963. Provides that in any case involving an offense in which the prosecution attempts to introduce evidence of incriminating statements made by the accused to an informant, the prosecution must timely disclose certain information during discovery. Provides that the prosecution must show by clear and convincing evidence that the informant's testimony is reliable before the court allows the testimony at trial. Provides that the provisions do not apply to statements that are lawfully recorded. Applies to all actions initiated on or after the effective date of the amendatory Act.
Amends the Illinois Income Tax Act. Provides that, for taxable years ending on or after December 31, 2003, each taxpayer is entitled to an income tax credit in the amount of $1,000 per taxable year if, at any time during the taxable year, the taxpayer's spouse served on active duty in the Illinois National Guard or a reserve component of the armed forces of the United States. Allows the credit to be carried forward for 10 years and exempts the credit from the sunset provisions of the Act. Effective immediately.
Amends the Criminal Code of 1961. Provides that when force or threat of force is an element of the offense, consent is a defense to any of the offenses of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse only if the victim of the offense was 17 years of age or older at the time of the commission of the offense.
Amends the School Code. Makes a technical change in a provision concerning promoting students to the next higher grade level.
Amends the Illinois Governmental Ethics Act. Makes technical changes in a Section concerning the short title.
Amends the Illinois Income Tax Act. Provides that, for taxable years ending on or after December 31, 2003, each taxpayer is entitled to an income tax credit in the amount of $1,000 per taxable year if the taxpayer is a member of the Illinois National Guard or of a reserve component of the armed forces of the United States and served for at least 60 continuous days of active military service during the taxable year pursuant to orders of either the Governor or the President of the United States. Allows the credit to be carried forward for 10 years and exempts the credit from the sunset provisions of the Act. Effective immediately.
Amends the Illinois Public Aid Code. Authorizes the Department of Public Aid's Child and Spouse Support Unit to request and receive from Internet service providers, pursuant to an administrative subpoena, location information concerning individuals in connection with enforcing a child support obligation. Effective immediately.
