If and only if Senate Bill 243 of the 104th General Assembly, as amended by House Amendment No. 1, becomes law, then the Open Meetings Act is amended to allow a public body to hold closed meetings to consider self evaluation, practices and procedures, or professional ethics, when meeting with a representative of a statewide association (rather than a statewide or regional association) of which the public body is a member. Effective upon becoming law or on the date Senate Bill 243 of the 104th General Assembly takes effect, whichever is later.

Appropriates $300,000 from the General Revenue Fund to the Department of Public Health for grants to the Les Turner ALS Foundation for research on Amyotrophic Lateral Sclerosis (ALS) and for care of those persons affected by the disease. Effective July 1, 2026.

Creates the Algorithmic Pricing Transparency Act. Provides that any person or entity that sells or offers to sell goods or services through an online platform to consumers in this State shall provide a clear and conspicuous disclosure if the price displayed to a consumer is generated using surveillance pricing. Provides that a consumer may opt out of surveillance pricing and a covered entity shall provide the consumer with a non-personalized baseline price for the goods or services. Prohibits a covered entity from using specified personal information to generate algorithmic pricing. Provides that a violation of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. Effective one year after becoming law.

Appropriates $2,000,000 from the General Revenue Fund to the Chicago Metropolitan Agency for Planning for fulfilling its obligations under the Regional Planning Act and for enhancing capacity to support local planning and technical assistance for the counties and municipalities, including, but not limited to, ADA self-evaluation and transition plans, bicycle and pedestrian plans, Capital improvement plans, comprehensive and other strategic plans, corridor plans, grant readiness, plan implementation assistance, pavement management plans, transportation safety plans, and other assistance in response to local needs. Effective July 1, 2025.

Proposes to amend the Local Government Article of the Illinois Constitution. Provides that a municipality may become a home rule unit by the affirmative vote of at least two-thirds of the corporate authorities of the municipality (rather than by having a population of more than 25,000 or electing by referendum to become a home rule unit). Provides that a municipality that is a home rule unit may elect not to be a home rule unit by the affirmative vote of at least two-thirds of the corporate authorities of the municipality (rather than by a referendum). Provides that a municipality that is a home rule unit on January 1, 2027 shall remain a home rule unit until the municipality elects not to be a home rule unit. Effective upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.

Amends the Mine Subsidence Insurance Article of the Illinois Insurance Code. Makes changes to defined terms. Provides that the moneys in the Illinois Mine Subsidence Insurance Fund shall be derived primarily from premiums for mine subsidence insurance ceded by insurers to the Fund pursuant to the Article and from investment income. In establishing mine subsidence insurance premium rates, provides that the Fund shall give due consideration to factors reasonably considered by an insurer when setting premium rates. Changes terms related to the appointment of directors in provisions concerning management of the Fund and establishes 3-year staggered terms for the directors. Provides that all directors shall be independent and owe a duty of care and duty of loyalty to the Fund. In provisions concerning mine subsidence coverage, provides that the loss covered shall be the loss in excess of any applicable deductible or retention in the policy, subject to the limit of insurance for mine subsidence damage stated in the policy. For all policies issued or renewed on or after January 1, 2027, provides that there shall be no deductible or retention applicable to mine subsidence damage. For all policies issued or renewed on or after the effective date of the amendatory Act, provides that the maximum amount of reinsured loss per residence, per commercial building, and per living unit shall be the amounts established by the Fund and approved by the Director. Provides that the residential and living unit coverage provided under the Article may also cover specified costs of debris removal, moving and storage of contents, and repair or replacement of landscaping. Makes changes in provisions concerning division of the Fund; exemptions; rights of insurers to refuse to provide mine subsidence coverage; arbitration; reinsurance agreements; distribution of premiums; reporting requirements; right of recourse and setoffs; subrogation; and powers of the Director of Insurance.

Amends the Crematory Regulation Act. Authorizes the Comptroller to issue citations or fines, or both, to licensees. Requires a cemetery authority to implement (i) a standard operating procedure and provide a copy to all employees; and (ii) a medical waste management plan. Authorizes the Comptroller to impose a fine not to exceed $10,000 for each violation under the Act. Allows the Comptroller to refuse to issue a license or take disciplinary action if the applicant or licensee has failed to pay delinquent taxes or child support. Requires the Comptroller, upon revocation or suspension of a license, to notify the county coroner or medical examiner who is responsible for the area where the crematory is located to immediately make arrangements to take possession of bodies and cremated remains and arrange for final disposition of any decedents in the possession of the suspended licensee after consulting with the authorized agents for those bodies. Provides that if no authorized agent can be contacted, the county coroner or medical examiner shall take possession of bodies and cremated remains within 72 hours of notification from the Comptroller. Requires a crematory authority to perform a cremation no more than 60 days from the date the human remains have been delivered to it unless the crematory authority has received specific instructions to the contrary on its cremation authorization form. Requires the crematory authority to notify the Comptroller and the coroner or medical examiner in the county in which the death occurred as to why the cremation cannot be performed if it is not done within the 60-day period. Provides that pacemakers do not need to be removed in alkaline hydrolysis cremations. Requires that cremated remains must be stored in a place free from exposure to the elements and be responsibly maintained until disposal. Makes other changes. Amends the Cemetery Care Act. Provides that if a cemetery authority owning or operating a privately owned cemetery has accepted care funds and is considered abandoned or seeks dissolution, it allows, if no receiver is available, a circuit court to order a willing unit of local government to take over the cemetery. Makes other changes.

Amends the Secretary of State Act. Provides that the Secretary of State shall establish a program to be known as the Blue Envelope Program through which the Office of the Secretary of State shall design and make publicly available blue envelopes that may be used by individuals who have been diagnosed with autism spectrum disorder to hold documents required for the operation of a motor vehicle. Sets forth additional requirements. Provides that an individual diagnosed with autism spectrum disorder may voluntarily participate in the program. Provides that any information provided on the outside of the envelope shall be used solely to support safe and effective communication during interactions with first responders and law enforcement officers and shall not be entered into any federal, State, or local database. Provides that the Secretary of State may adopt rules to implement and administer the program.

Amends the Fire Protection District Act. Provides that a member of the board of trustees of a fire protection district having fewer than 4 full-time paid firemen may be compensated a sum not to exceed $1,500 (rather that $1,000) per annum. Provides that a member of the board of trustees of a fire protection district having more than 3 but fewer than 10 full-time paid firemen may be compensated a sum not to exceed $2,000 (rather that $1,500) per annum. Provides that a member of the board of trustees of a fire protection district having 10 or more full-time paid firemen may be compensated a sum not to exceed $2,500 (rather that $2,000) per annum.

Creates the Motor Vehicle Glass Repair Act. Provides that an insured under a property and casualty insurance policy shall not, either prior to or after a claimed or covered loss, assign, delegate or otherwise transfer, in whole or in part, to any other person the insured's: (1) duties under the policy; or (2) rights or benefits under the policy. Provides that any contract violating the delegation prohibition shall be void and unenforceable. Sets forth provisions concerning a motor vehicle glass shop's notice requirements to an insured; motor vehicle glass repair claims and practices; prohibited acts; and an insured's right to choose a motor vehicle glass repair shop. Establishes a presumption that a motor vehicle glass repair shop is acting knowingly in violation of provisions concerning prohibited acts if the motor vehicle glass repair shop engages in a regular and consistent pattern of the prohibited activity. Requires the Department of Insurance to adopt rules necessary to administer and implement the Act, including rules to enforce compliance with the Act.
