DRUG POSSESSION-TREATMENT

Amends the Alcoholism and Other Drug Abuse and Dependency Act, the Cannabis Control Act, the Illinois Controlled Substances Act, the Methamphetamine Control and Community Protection Act, and the Unified Code of Corrections. Provides that an individual convicted of an offense involving the illegal possession of cannabis, a controlled, look-a-like, or counterfeit substance, or methamphetamine and sentenced on or after the effective date of the amendatory Act shall be sentenced to probation instead of imprisonment. Provides that the court shall order the individual to receive treatment under the supervision of a program designated by the Department of Human Services for the duration of the individual's probation. Provides that an individual convicted of such an offense and sentenced to a term of imprisonment before the effective date of the amendatory Act may petition the court to have his or her sentence vacated and to be sentenced to probation and treatment and provides for evaluation of the petition.

PAWNBROKER-REQUIRE FINGERPRINT

Amends the Pawnbroker Regulation Act. Provides that a pawnbroker must, at the time of making a loan or purchase, require the signature and right thumbprint of the person pledging or pawning any goods on all pawn tickets, bills of sale, or ledger cards retained by the licensee. Provides that if the person is unable to write, then the person shall sign by mark. Provides that if the person signs by mark, then the pawnbroker shall record on a separate signature card information that shall enable the pawnbroker to identify the person in case of the loss of the ticket. Provides that if the person does not have a right thumb, then a clear fingerprint shall be obtained using any other existing finger. Effective January 1, 2011.

Amends the Deposit of State Moneys Act. Authorizes investment in repurchase agreements of government securities having the meaning set out in the Government Securities Act of 1986,"as now or hereafter amended or succeeded". Effective immediately.

Amends the Department of Economic Opportunity Law of the Civil Administrative Code of Illinois. Creates a loan program for ex-offenders to plan and start their own businesses. Defines terms and sets requirements for loans. Amends the State Finance Act to create the Ex-Offender Fund. Effective January 1, 2010.

PB HLTH-SEXUALLY TRANS DISEASE

Amends the Illinois Sexually Transmissible Disease Control Act. Adds definitions for "health care professional" and "expedited partner therapy". Provides that the Department of Public Health shall provide information and technical assistance as appropriate to health care professionals who provide expedited partner therapy services for persons with sexually transmissible diseases. Provides that a health care professional who makes a clinical diagnosis of chlamydia or gonorrhea may prescribe, dispense, furnish, or otherwise provide prescription antibiotic drugs to the infected person's sexual partner or partners without physical examination of the partner or partners, if in the judgment of the health care professional, the partner is unlikely or unable to present for comprehensive health care. Provides that the health care professional shall provide counseling for the patient and written materials to be given by the patient to the partner or partners. Provides that a health care professional providing expedited partner therapy in good faith without fee or compensation and providing counseling and written materials shall not be subject to civil or professional liability, except for willful and wanton misconduct. Makes other changes.

VEH CD-TINTED WINDOW INSTALL

Amends the Illinois Vehicle Code. Provides that a person may not install or repair any sign, poster, window application, reflective material, nonreflective material, or tinted film upon the front windshield, sidewings or side windows immediately adjacent to each side of the driver. Provides that a first violation is a petty offense with a fine between $50 and $500, and a second or subsequent offense is a Class C misdemeanor with a fine between $100 and $500. Provides that an installer may install window treatment for a person who is legally permitted, due to medical reasons, to drive with window treatment that would otherwise be illegal and provides that the installer must obtain and store a copy of a doctor's certificate or letter from the person with medical condition in the installer's permanent records. Provides that the Secretary of State shall provide a notice of the requirements of a provision prohibiting driving a motor vehicle with any sign, poster, window application, reflective material, nonreflective material, or tinted film upon the front windshield, sidewings or side windows immediately adjacent to each side of the driver, unless an exception applies, to a new resident applying for vehicle registration.
