CREDIT AGREEMENTS ACT-TECH

Amends the Credit Agreements Act. Provides that specified provisions shall not constitute a defense to a claim that arises out of bad faith conduct intended to unjustly benefit a creditor or a third party. Provides that the mere failure by a creditor to enter into a credit agreement with or to provide a written commitment to a debtor, without more, shall not constitute bad faith under specified provisions. Provides for the legislative intent of the General Assembly and that certain provisions apply to pending actions as well as actions commenced on or after the effective date of the amendatory Act. Effective immediately.

SCH CD-HALF-DAY KINDERGARTEN

Amends the School Code. Provides that the board of directors of a school district must establish a kindergarten in connection with the public school in the district and maintain it as long as the annual average daily attendance therein is not less than 15 (previously, upon petition of at least 50 parents or guardians of children that meet specified criteria, the board of directors shall, if funds are available, establish a kindergarten in connection with the public school designated in the petition and maintain it as long as the annual average daily attendance therein is not less than 15). Provides that the board must (rather than may) establish a kindergarten with half-day attendance or with full-day attendance. Provides that provisions related to compulsory attendance apply to children between 5 and 17 years of age (rather than between 7 and 17 years of age). Effective August 1, 2010.

CRIM CD-PATERNITY FRAUD

Amends the Criminal Code of 1961. Creates the offense of paternity fraud. Provides that a person commits the offense by knowingly alleging that a person is the biological father of a child when that person knows that the allegation is false and may result in the person alleged to be the biological father of the child being erroneously adjudicated as the father of the child. Provides that the penalty is a Class A misdemeanor.

HUMN RTS-PRIOR CONVICTIONS

Amends the Illinois Human Rights Act. Provides that it is the policy of this State to prevent discrimination based on prior criminal conviction in employment. Establishes that it is a civil rights violation for an employer, employment agency, or labor organization to inquire into or to use the fact of a prior criminal conviction, or an arrest or criminal history record information (rather than an arrest or criminal history record information) as a basis to refuse to hire, to segregate, or to act with respect to recruitment, hiring, promotion, renewal of employment, selection for training or apprenticeship, discharge, discipline, tenure or terms, privileges or conditions of employment, unless otherwise required by federal or State law.

CHILD SUPPORT-FORGIVE INTEREST

Amends the Illinois Public Aid Code, the Illinois Marriage and Dissolution of Marriage Act, the Non-Support Punishment Act, and the Illinois Parentage Act of 1984. Provides that a court may grant a motion to forgive interest on past due child support if: the obligor demonstrates that during the time that the past due child support was accumulating, the obligor was unable to pay child support; the obligor agrees to make future support payments on time provided that if the obligor fails to make future support payments on time, the court may reinstate the interest charge; or the obligor makes a lump sum payment.

PARENTAGE ACT-PATERNITY FRAUD

Amends the Illinois Parentage Act of 1984. Requires the court to vacate a child support order entered under the Act if the court finds, by clear and convincing evidence, that the moving party is not the biological father of the child who is the subject of the support order and that the obligee maliciously misrepresented the paternity of the child to the obligor. Requires the obligor to file the motion to vacate the support order within 2 years after the discovery of evidence that he is not the biological father of the child. Permits the obligor to bring an action against the obligee or the true biological father of the child to obtain restitution for child support previously paid pursuant to the order, if the court vacates the support order. Provides that any judgment obtained in an action for restitution may not be enforced against the mother until after the child for whom the vacated support order was entered is 18 years old or is otherwise emancipated. Provides that any wage deduction or garnishment action taken to enforce a judgment for restitution against the true biological father shall stand behind any withholding order entered against the true biological father for the support of the child for whom the vacated support order had been entered. Provides that if the support order is vacated, the court shall also vacate the judgment or adjudication of paternity under which the support order was entered.
