Amends the Illinois Vehicle Code. Changes the definition of an all-terrain vehicle to any motorized off-highway device designed to travel primarily off-highway, 50 inches or less in width, having a manufacturer's dry weight of 1,500 pounds or less (rather than 900 pounds or less), traveling on 3 or more non-highway tires (rather than low-pressure tires), designed with a seat or saddle for operator use, and handlebars or steering wheel for steering control, except equipment such as lawnmowers. Defines "recreational off-road vehicle" as any motorized off-highway device designed to travel primarily off-highway, 60 inches or less in width, having a manufacturer's dry weight of 1,500 pounds or less, traveling on 4 or more non-highway tires, designed with a non-straddle seat and a steering wheel for steering control, except equipment such as lawnmowers. Provides that all provisions of the Illinois Vehicle Code that apply to an all-terrain vehicle shall apply the same to a recreational off-highway vehicle. Effective immediately.

Creates the Green Energy Business Act. Authorizes the Department of Commerce and Economic Opportunity to receive and approve the applications of qualified businesses seeking designation as Green Energy Businesses. Amends the Illinois Income Tax Act, the Retailers' Occupation Tax Act, and the Public Utilities Act to provide that Green Energy Businesses are eligible for certain credits and exemptions under those Acts. Effective immediately.
Amends the Illinois State Collection Act of 1986. Provides that, in the case of any liability referred to a collection agency, any fee charged to the State by the collection agency is considered an additional liability owed to the State. Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Illinois Income Tax Act to authorize the Department of Revenue to adopt rules and regulations for payments by credit card. Amends the Illinois Income Tax Act. Provides that certain lottery and gambling winnings are allocable to the State. Makes other changes. Amends the Retailers' Occupation Tax Act. Makes changes concerning actions by the Department to recover unpaid taxes, penalties, and interest. Amends the Illinois Vehicle Code. Authorizes the Secretary of State to disclose or otherwise make available to the Department of Revenue social security numbers for use by the Department in the administration of any tax administered by the Department of Revenue or in the collection of any tax or debt that the Department of Revenue is authorized or required by law to collect. Effective immediately.
Amends the Rivers, Lakes, and Streams Act. Provides that the Vermilion River, from its confluence with the Illinois River upstream to the bridge at 18th Street in LaSalle County, is declared a navigable stream, shall be deemed and held a public right-of-way, and shall remain free, open, and unobstructed, and all laws prohibiting the obstruction of navigable streams shall be deemed applicable to the Vermilion River between the points identified.
Amends the Employee Leasing Company Act. Provides that any registration issued under the Act may be revoked or an application for registration may be denied if the Director of Insurance finds that the lessor, applicant, chief executive officer, partner, sole proprietor, or executive director (instead of lessor or applicant) meets certain conditions.
Amends the Public Utilities Act. Makes a technical change in the short title Section.
Amends the State Prompt Payment Act. Removes a provision that requires vendors to initiate a written request for the payment of an interest penalty that is at least $5 but less than $50. Removes a provision that authorizes the Department of Central Management Services and the State Comptroller to adopt rules establishing when interest penalties of less than $5 may be claimed and paid. Effective July 1, 2009.
Amends the Illinois Finance Authority Act. Increases the general bonding authority by $4,000,000,000. Effective immediately.
Amends the Charitable Trust Act. Sets forth a definition of "Medical Sharing Trust". Provides that an organization complying with the provisions concerning a Medical Sharing Trust is not subject to the provisions of the Illinois Insurance Code, except that a Medical Sharing Trust offering any services other than a Medical Sharing Trust that are regulated under any provision of the Illinois Insurance Code shall be required to comply with the Illinois Insurance Code with respect to the provision of those services. Sets forth registration requirements for a Medical Sharing Trust. Provides that a Medical Sharing Trust may facilitate payments between participants who have present medical needs and participants with the ability to pay for the benefits of those participants in need. Sets forth requirements concerning the operation of a Medical Sharing Trust.
Amends the Illinois Insurance Code. In the provisions regarding recoupments, removes the requirement that a remittance advice be provided to a health care provider. Provides that except in cases of fraud, all claims paid by an insurer or other specified organization shall be considered final unless adjustments are made pursuant to the Act. Provides that if an insurer or other specified organization determines that it has made an overpayment to a provider, the insurer must give the provider a written statement specifying the basis for the claim of overpayment. Sets forth recoupment provisions for situations where (i) there is a contract between the provider and the insurer and (ii) there is no contract between the provider and the insurer. Provides that an insurer or other specified organization shall not seek recoupment for payment of a claim based on any claimed lack of medical necessity if the insurer has received the provider's treatment records. Provides that an insurer or other specified organization shall not offset payment for claims for services to a patient against claims for the provider's services to any other patient. Makes other changes.
