Amends the Downstate Police and Downstate Firefighter Articles of the Illinois Pension Code. Authorizes the corporate authorities of a participating municipality to elect, by a duly authorized resolution or ordinance, to calculate actuarial liabilities using a 30-year rolling amortization period.
Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that the purchase or use of a waste oil furnace or a waste oil boiler is exempt from taxation under the Acts. Effective immediately.
Amends the Alternative Health Care Delivery Act. Sets forth a definition for "postsurgical recovery care center model". Provides that a postsurgical recovery care center model may provide sleep laboratory or similar sleep studies in accordance with applicable State and federal laws and regulations. Requires the Department of Public Health to enforce by rule certain provisions concerning patient care with respect to each postsurgical recovery care center model. Sets forth policies and procedures concerning patient care, including the administration, storage, and monitoring of non-emergent blood transfusions given in a postsurgical recovery care center model.
Amends the Counties Code. Provides that a county may not limit the height of a renewable energy system that is used exclusively by an end user other than using the setback of 1.1 times the height of the system from the end user's property line. Further provides that permits for the erection, maintenance, repair, alteration, remodeling, or extension of buildings or structures used or to be used for the harvest of renewable energy by an end user shall be free. Provides that a county may not impose regulations on structures or devices, eliminate uses, buildings, or structures, or require permits with respect to structures or devices used for any renewable energy system that is used exclusively by an end user. Effective immediately.
Amends the Nursing Home Care Act. Provides that the Department of Public Health shall enter into an interagency agreement with the Office of the State Fire Marshal under which the latter shall conduct all surveys, evaluations, or inspections of nursing homes with respect to facility standards regulating protection of residents from fire hazard.
Amends the Sanitary Food Preparation Act to repeal a provision prohibiting restaurants from listing a particular food product for sale on menus when the product is not actually sold to consumers. Provides instead that it shall be an unlawful practice for any person or business to misrepresent on any menu or other posted information, including advertisements, the identity of any food or food products to any of the patrons or customers of eating establishments. Exempts retail food or grocery stores that do not provide facilities for on-the-premises consumption of food or food products. Sets forth determinative factors whereby the identity of a food or food products shall be deemed misrepresented. Provides that a local health department that publishes occurrences of violations of law, regulation, or ordinance shall also publish occurrences of violations of the provision concerning menu misrepresentation.
Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that, by January 1, 2014, the Department shall (instead of may) adopt rules to authorize the electronic filing of any return or document required to be filed under any Act administered by the Department.
