MEDICAID-APN-PSYCHIATRIC SRVCS

Amends the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to reimburse advanced practice nurses for psychiatric services they provide, as authorized by Illinois law, to Medicaid recipients. Effective immediately.

SCH CD-TAX FOR UTILITY EXPENSE

Amends the School Code. Allows the school board of any district (other than the Chicago school district) to cause a proposition to levy an annual tax for gas and electric utility expenses to be submitted to the voters of the district at a regular scheduled election. Provides that if a majority of the votes cast on the question is in favor thereof, then the school board may levy the tax annually thereafter. Provides that any funds received from the imposition of the tax must be deposited into the utility fund of the school district. Provides that any surplus moneys in the utility fund may be rolled over to cover expenses for the following fiscal year. Provides that an extension made for gas and electric utility expense purposes is excluded from the definition of "aggregate extension" under the Property Tax Extension Limitation Law of the Property Tax Code.

MEDICAID-FAMILY MEMBR CAREGIVR

Amends the Illinois Public Aid Code. Provides that the Department of Human Services, in consultation with the Department of Healthcare and Family Services, shall develop an initiative within the Home Services Program under which legally responsible adults may be reimbursed for providing care to eligible clients. Sets forth the components of the initiative. Provides that by November 1, 2008, the Department of Human Services and the Department of Healthcare and Family Services shall report their findings and recommendations to the General Assembly regarding proposed rule changes to the Illinois Administrative Code and amendatory changes to the State Medicaid Plan for the purpose of implementing the initiative. Provides that by January 1, 2009, the Department of Healthcare and Family Services shall seek federal approval to amend the State Medicaid Plan, and the Department of Human Services and the Department of Healthcare and Family Service shall submit proposed rule changes to the Joint Committee on Administrative Rules. Effective immediately.

INC TAX-CREDITS

Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.

SCH CD-CHARTER SCH LIMIT-CHI

Amends the Charter Schools Law of the School Code. Under specified circumstances, allows for a maximum of 5 additional charter schools exclusively for truants or dropouts in Chicago if the limit on the number of charter schools that may operate at any one time in the rest of the State has not been reached. Provides that if any of the additional charter schools are not used exclusively for truants or dropouts, then the State Board of Education shall withhold and the charter school shall forfeit all State funding designated for that school.

HABILITATIVE SERVICES

Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act to provide coverage for habilitative services, including, but not limited to occupational therapy, physical therapy, and speech therapy for children under the age of 19 with congenital or genetic defects existing at or from birth or with a defect acquired at a young age. Amends the State Mandates Act to require implementation without reimbursement.

MINE SUBSIDENCE-CLAIMS

Amends the Counties Code and the Illinois Insurance Code. Provides that when an insurer pays a claim to an insured for mine subsidence, the insurer must file notice of that claim with the recorder of the county where the insured's property is located. Provides that every recorder must accept notice of a payment of a claim for mine subsidence insurance and file this information in a way that allows it to be accessed in a title search of the property.

VEH CD-NEW DRIVER SIGN

Amends the Illinois Vehicle Code. Provides that a minor holding an instruction permit or a graduated driver's license must display on any vehicle he or she is driving a sign or signs, approved by the Secretary of State, indicating that the vehicle is being driven by a new driver. Provides that the Secretary of State shall adopt rules for implementing the new provisions. Provides that the rules shall address the issue of whether a fee shall be charged for obtaining the sign or signs and the amount of the fee, if any.
