STATE AGENCIES-NURSE OVERTIME

Amends the Department of Children and Family Services Powers Law of the Civil Administrative Code of Illinois, the Mental Health and Developmental Disabilities Administrative Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the Department of Veterans Affairs Act, the Illinois Public Aid Code, and the Unified Code of Corrections. Provides that no nurse who is paid an hourly wage and who has direct responsibility to oversee or carry out nursing care or related duties may be required to work mandated overtime except in the case of an unforeseen emergent circumstance when such overtime is required only as a last resort, and limits the time of such overtime. Provides that when a nurse is mandated to work up to 12 consecutive hours, the nurse must be allowed at least 8 consecutive hours of off-duty time. Prohibits retaliation because a nurse refuses to work mandated overtime as prohibited under these provisions. Authorizes the filing of complaints alleging violations of these provisions. Effective immediately.

ENTERPRISE ZONE-EXTEND 20 YRS

Amends the Illinois Enterprise Zone Act. Provides that an Enterprise Zone shall be extended for an additional 20 years upon application by the corporate authorities of the county or municipality that designated the Enterprise Zone. Amends the Retailers' Occupation Tax Act. Provides that exemptions granted under the Act for tangible personal property used or consumed in an Enterprise Zone may be in effect for not more than the term of the enterprise zone. Amends the Public Utilities Act and the Retailers' Occupation Tax Act to make conforming changes in provisions concerning tax exemptions for businesses located in Enterprise Zones. Effective immediately.

DCE0-ETHANOL ENCOURAGEMENT

Amends the Illinois Renewable Fuels Development Program Act. Sets out legislative findings regarding certain types of ethanol blended fuel. Provides that the Department of Commerce and Economic Opportunity may provide information to gas stations in the State encouraging the stations to offer E15 as an option for customers. Provides that the Department may provide information to gas stations on any financial assistance that may be available to subsidize the cost of providing E15 blended fuel to consumers.

INC TX-ANGEL INVESTMENT CREDIT

Amends the Illinois Income Tax Act. Raises the limit on angel investment tax credits from $10 million to $20 million in total income tax credits per year. Raises the limit on an applicant's eligible investment from $2 million to $4 million. Effective immediately.

PEN CD-LEAVES-LABOR ORGS

Amends the Illinois Pension Code. Amends various Articles of the Code to provide that participants under those Articles are only entitled to creditable service for periods of service with a labor organization if the employee and employer contributions for the service are received by the Fund before the effective date of the amendatory Act. Amends the IMRF Article of the Illinois Pension Code to provide that the Illinois Municipal League and the Will County Governmental League are participating instrumentalities only with respect to service on or before the effective date of the amendatory Act. Effective immediately.

DCFS-CUSTODY-VISITATION-FELON

Amends the Unified Code of Corrections and the Illinois Marriage and Dissolution of Marriage Act. Provides that whenever the Department of Corrections is to release any inmate who has been convicted of a felony, earlier than it otherwise would because of a grant of good conduct credit, the Department shall give written notice of the impending release not less than 120 days prior to the date of the release to the victim of the offense for which the inmate was convicted and the victim's family members. Provides that a court may not award either sole custody or joint custody to a parent who has been convicted of a felony unless certain criteria are first met, including that (i) a psychological examination of the parent has been conducted by a qualified individual, and that individual is of the opinion that the parent is a fit person to raise and care for the child and (ii) the child or the child's legal guardian has consented to an award of custody to the parent. Provides that a court may not award unsupervised visitation to a parent who has been convicted of a felony unless similar criteria are first met. Provides for immediate suspension of a parent's unsupervised visitation if the child alleges that he or she has been a victim of abuse or sexual molestation perpetrated by a person in the home where the unsupervised visitation has taken place.

USE/OCC TAX-HAY STORAGE

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Beginning on July 1, 2012, exempts from the taxes imposed by these Acts (i) baling twine and baling wire and (ii) plastic bags, plastic sleeves, and plastic sheeting used to store or cover hay or silage, but only if it is certified by the purchaser that items (i) and (ii) will be used primarily for production agriculture or State or federal agricultural programs. Exempts those purchases from the sunset provisions of the Acts. Effective immediately.

INC TX-HIRE ILLINOIS CREDIT

Amends the Illinois Income Tax Act. Creates the Hire Illinois Tax Credit. Provides that a business is eligible for a $1,500 tax credit for each recent graduate of an Illinois college or university it hires within a taxable year. Provides that the Department of Commerce and Economic Opportunity shall limit the monetary amount of these tax credits to $15,000,000. Provides for procedures for a business to apply for a certificate of eligibility for the credit and for procedures to apply for a tax credit certificate. Provides that a business shall submit a copy of the tax credit certificate to the Department of Revenue with its return. Grants the Department of Commerce and Economic Opportunity powers necessary or convenient to administer the tax credit. Applies only to taxable years 2011 and 2012. Effective immediately.

URGES-NO TANF WORK WAIVER

Urges the Governor and the Secretary of the Department of Human Services to not seek a waiver from the U.S. Department of Health and Human Services of federal work requirements under the Temporary Assistance for Needy Families program.

DHS-TANF-WAIVER RESTRICTION

Amends the Administration Article of the Illinois Public Aid Code. In regard to work participation requirements under the Temporary Assistance for Needy Families (TANF) program, prohibits the Department of Human Services from submitting to the Secretary of the U.S. Department of Health and Human Services a TANF demonstration project waiver proposal in order to (i) forgo compliance with federal mandates concerning work activities for TANF recipients and (ii) develop an experimental, pilot, or demonstration project to meet the work goals of the TANF program. Effective immediately.
