Amends the Criminal Code of 1961. Provides that the fee collected from an offender diverted to the State's Attorney's bad check diversion program may be used in the enforcement and prosecution of criminal laws.

Amends the Criminal Code of 1961. Provides that officers, agents, or employees of the federal government commissioned by federal statute to make arrests for violations of federal criminal laws shall be considered "peace officers" under the Code when the commission of any offense (rather than a felony) under Illinois law is directly observed by the person.
Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.
Authorizes the Department of Corrections to convey the described property to the Community Unit School District 303.
Amends the Fire Protection of Unprotected Area Act. Provides that it is the duty of the State Fire Marshal to make all reasonable efforts to ensure that all areas of the State are covered for fire protection and paying an adequate and reasonable fee for that protection. Effective immediately.
Amends the State Finance Act. Creates the Home Emergency Assistance Targeted Relief Fund as a special fund in the State treasury and provides that, from appropriations from the Fund, the Department of Healthcare and Family Services must use the moneys in the Fund for the purposes of energy assistance programs. Creates the Extra Fuel Tax Revenues Fund as a special fund in the State treasury. Requires the Treasurer, on the effective date of this amendatory Act, to transfer $50,000,000 from the General Revenue Fund to the Home Emergency Assistance Targeted Relief Fund. Provides that, beginning on the effective date of this amendatory Act, on the first day of each month, the Treasurer shall transfer the balance, if any, of the Extra Fuel Tax Revenues Fund to the General Revenue Fund until the cumulative amount transferred from the Extra Fuel Tax Revenues Fund to the General Revenue Fund reaches $50,000,000. Exempts the Home Emergency Assistance Targeted Relief Fund and the Extra Fuel Tax Revenues Fund from the administrative chargeback provisions of the Act. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. In each of those Acts, provides that if, at any time during fiscal year 2006, the total net revenue realized for fiscal year 2006 that was collected by the State on the sale or use of motor fuel in fiscal year 2006 is equal to or exceeds the total net revenue realized for fiscal year 2005 that was collected by the State on the sale or use of motor fuel, then each month through July 2006 the Department shall pay into the Extra Fuels Tax Revenues Fund 80% of the net revenue realized for the preceding month from the 6.25% rate on the selling price of motor fuel and gasohol that was sold during fiscal year 2006. Effective immediately.
Amends the Illinois Finance Authority Act. Expands the fire truck revolving loan program to include EMS service vehicles. Amends the State Finance Act to make conforming changes.
Amends the Toll Highway Act. Provides that the Illinois State Toll Highway Authority shall, upon the request of a vendor or vendors and the payment of an appropriate fee or fees, erect and maintain, near the appropriate sign notifying motorists of an upcoming toll highway intersection, a sign or signs indicating the presence near that intersection of a business or businesses providing services to travelers, such as lodging, food, or motor fuel. Provides that these signs and their placement shall conform with the Illinois Manual on Uniform Traffic Control Devices for Streets and Highways. Effective immediately.
Amends the Illinois Municipal Code. Provides that a fire department foreign fire insurance board shall have 7 trustees, including the fire chief and 6 members of the fire department (now, the Board is established by ordinances of the corporate authorities). Provides for an annual election of board officers. Provides that the annual municipal audit shall include funds appropriated to the board and shall determine whether the funds have been expended only by the board. Amends the Fire Protection District Act. Provides that in each fire protection district that has an organized fire department there shall be a foreign fire insurance board. Provides that the board shall have 7 trustees, including the fire chief and 6 members of the fire department. Provides that officers shall be elected annually. Authorizes the board to make rules. Provides that the treasurer must give a bond to the board. Provides that the board shall develop and maintain a list of items that are appropriate expenditures. Provides that the annual fire protection district audit shall include funds appropriated to the board and shall determine whether the funds have been expended only by the board. Makes other changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that the immunities granted for fire protection and rescue services apply to those responding under the terms of a mutual aid agreement.
