CONSUMER FRAUD-WIRELESS CHARGE

Amends the Consumer Fraud and Deceptive Business Practices Act. Requires wireless carriers to bill consumers only for authorized charges. Provides that, in the case of a complaint, there is a rebuttable presumption that an unauthorized charge for a product or service was not authorized by the consumer. Provides that a wireless carrier may establish that a consumer authorized a charge with a record of affirmative consumer authorization, a demonstrated pattern of knowledgeable past use, or other persuasive evidence of authorization. Provides that with respect to direct-dialed telecommunications services, evidence that a call was dialed is prima facie evidence of authorization. Provides that while a complaint is pending, the consumer shall not be required to pay the disputed charge or any associated late charges or penalties. Provides that the disputed charge may not be sent to collection. Provides that no adverse credit report may be based on non-payment of the disputed charge. Provides that if a wireless carrier receives a complaint that the consumer did not authorize the purchase of the product or service associated with a charge, the wireless company, not later than 30 days from the date on which the complaint is received, shall either verify and advise the consumer of the consumer's authorization of the disputed charge or undertake to credit the disputed charge and any associated late charges or penalties to the consumer's bill. Provides that nothing in the new provisions prevents a consumer from exercising his or her other rights. Provides that a violation is an unlawful practice within the meaning of the Act.

$DNR-OPEN SPACE LANDS GRANTS

Appropriates $10,000,000 to the Department of Natural Resources to make grants under the Open Space Lands Acquisition and Development Act.  Effective July 1, 2007.

MERCURY-AD PRDCTS-COSMETICS

Amends the Mercury-added Product Prohibition Act. Provides that no person shall distribute or sell any cosmetics, toiletries, or fragrances containing mercury. Provides that any person who knowingly sells or distributes mercury-containing cosmetics, toiletries, or fragrances in this State commits a petty offense and shall be fined up to $500. Provides that a manufacturer that distributes cosmetics, toiletries, or fragrances containing mercury to persons in this State must disclose the level of mercury in its cosmetics, toiletries, or fragrances. A manufacturer who fails to disclose the level of mercury in its cosmetics, toiletries, or fragrances commits a business offense and shall be fined $10,000. Effective January 1, 2009.

CHIP-ELGIBILITY-PLAN COVERAGE

Amends the Comprehensive Health Insurance Plan Act. Provides that coverage under the Plan shall automatically terminate as of the effective date of any medical assistance, except in cases where the effective date of the medical assistance is the date that the application for medical assistance was submitted to the Department of Human Services and that date is different than the date that the applicant is determined to be eligible for medical assistance. Provides that in that circumstance, coverage under the plan shall terminate on the date that the applicant was determined to be eligible for medical assistance. Effective immediately.

SCH CD-INTERNET SAFETY

Amends the School Code. In a Section concerning an Internet safety education curriculum, provides that beginning with the 2009-2010 school year, a school district must incorporate into the school curriculum a component on Internet safety to be taught at least once each school year to students in grade 3 or above. Requires the State Board of Education to develop a model curriculum for educating children regarding child online safety. Requires the State Board of Education to provide to each school district educational materials for parents regarding child online safety.
