Amends the Common Interest Community Association Act. Provides that the operation of a licensed day care home, as defined in the Child Care Act of 1969, in a residential dwelling, is incidental to the primary residential use of the dwelling and constitutes a valid residential use for the purpose of any community instrument. Provides that a community instrument may not impose restrictions on a residential dwelling licensed as a day care home unless the restrictions are no more restrictive than those imposed by the Child Care Act of 1969 or rules adopted by the Department of Children and Family Services. Provides that a community instrument may not prohibit the use of a residential dwelling as a day care home unless prohibiting the use is necessary to preserve the health, safety, and welfare of the other residents in the community. Provides that the burden of proof is on the party seeking to enforce a community instrument to demonstrate, on a case-by-case basis, that the restrictions are necessary to preserve the health, safety, and welfare of the residents of the community. Provides that a condominium, timeshare, or cooperative is exempt from the provision.
Amends the Tax Increment Allocation Redevelopment Act in the Illinois Municipal Code. Provides that the joint review board shall appoint one of its members to preside over certain public hearings.
Creates the Illinois Economic Development Corporation Act. Creates the Illinois Economic Development Corporation. Creates the board of directors of the Corporation and sets forth the membership of the board. Provides that the board shall develop and implement economic programs to provide business support and expertise and financial assistance to companies that are investing and creating jobs in Illinois and to support new business start-ups and business expansion and growth in Illinois. Sets forth the powers of the board. Creates the Illinois Small Business Development Center within the corporation to provide business counseling and educational programs developed at the local, regional, and State level to support Illinois small business creation and growth. Provides that the Center shall provide assistance, in the form of training, counseling, and information resources, to startup businesses and job-creator firms regarding the startup process. Provides that the board shall submit annual reports to the members of the General Assembly.
Creates the Medicaid Budget and Impact Note Act. Requires every bill that amends the Illinois Public Aid Code, affects eligibility for or enrollment in Medicaid, or has a financial impact on the operation of the Department of Healthcare and Family Services to have prepared for it, prior to second reading in each chamber, a brief explanatory statement or note that includes a reliable estimate of the expected impact of the bill on the annual budget of the Department of Healthcare and Family Services and the State of Illinois, as well as the projected costs and benefits associated with the implementation of each provision in the bill. Authorizes any member of the General Assembly to request one of these notes. Requires the Director of Healthcare and Family Services, or his or her designee, to respond to requests for notes.
Amends the Illinois Income Tax Act. In a Section concerning estimated taxes, provides that, if a taxpayer is entitled to a refund after the payment of the fourth installment, then he or she may apply the amount of the refund to the first installment due in the next taxable year.
Amends the Pharmacy Practice Act. Makes a technical change in the Section concerning Social Security Numbers.
Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Amends the definition of "employee" to exclude persons whose employment does not benefit the public. Also includes technical changes. Effective immediately.
Amends the Sex Offender Community Notification Law. Provides that the Department of State Police shall provide on its Sex Offender Information web page a form that allows a person who seeks access to sex offender information to be notified by e-mail of when a sex offender changes residence, employment, or school attendance to a location within a particular zip code or within a specified distance from an address. Provides that the Department of State Police shall provide such information by e-mail notification to a person who completes the form.
Amends the Illinois Income Tax Act. Provides for a credit for taxpayers who, during the taxable year, install, on a building or property that is owned by the taxpayer and that is located in the State, a geothermal energy device and sets the amount of the credit at the lesser of (i) $5,000 or (ii) 50% of the actual cost of the acquisition and installation of the device. Provides that the credit may not be carried forward or back and may not reduce the taxpayer's liability to less than zero. Effective immediately.
