Rep. Rita Mayfield

Amends the Illinois Finance Authority Act. Provides that the Illinois Finance Authority and the State Fire Marshal may (rather than shall) jointly administer a fire truck revolving loan program and an ambulance revolving loan program. Provides that the Authority may use loans and guarantees authorized by the fire truck revolving loan program, the fire station revolving loan program, and the ambulance revolving loan program to maximize the number of participants in those programs and to maximize the efficient use of taxpayer appropriated funds. Provides that the Authority may determine the financial structure of loans or guarantees authorized by those programs. Provides that the Authority and the State Fire Marshall may access the funds associated with those programs and may charge and collect fees in connection with those programs. Effective immediately.

Amends the Illinois Municipal Code. In provisions concerning the annexation of contiguous territory, requires a 60% vote (now, a majority) of the owners of record of land in the territory to be annexed and 60% (now, a majority) of the electors, if any, residing in the territory to petition the circuit court for annexation. Requires that at least 60% (now, a majority) of the electors residing in the unincorporated territory cast ballots in favor of annexation for the territory to become a part of the annexing municipality. Sets forth public hearing and notice requirements for the annexation of contiguous territory with no electors. Effective immediately.

Amends the School Code. Requires each school board to establish an alternative basic education track focused in mathematics and reading for students performing one grade level or more below their current grade level according to current learning standards and the school district. Requires the State Board of Education to adopt standards for the alternative basic education track. Effective immediately.

Amends the Great Lakes Naval Base Jurisdiction Act. Provides that the City of North Chicago is prohibited from discriminating in the provision of law enforcement services against the children of personnel serving in the United States Navy, or any other children, attending any public school located on lands within the United States Naval Training Base at Great Lakes. Authorizes the City of North Chicago to exercise its police powers and to provide law enforcement services to public schools located on lands within the United States Naval Training Base at Great Lakes. Effective immediately.

Amends the Unified Code of Corrections. Provides that before the release of a committed person from an institution or facility of the Department of Corrections, the person shall receive a mental health evaluation. Provides that if the evaluation determines that the committed person is severely or profoundly mentally retarded and not functional, the committed person shall be referred to the Department of Human Services and only released directly into the Department's care or to a family member or other person who can provide care.

Amends the School Code. Requires a school district's school lunch program to include flavored milk as an option for students. Effective immediately.

Amends the School Code. Provides that mandate waivers may not be requested from laws and rules pertaining to physical education. Effective immediately.

Amends the Juvenile Court Act of 1987 relating to abused, neglected, and dependent minors who have been removed from the parent's custody. Provides that the Department of Children and Family Services shall conduct a study every 4 months for the first year that the child has not been reunited with his or her family. Provides that the Department of Children and Family Services shall document in detail why the parent and child have not been reunited and what specific steps are being taken to reunite the family. Provides that the court may appoint an independent third party to review the service plan as to whether the goal has been achieved, including a determination that all necessary steps have been taken to reunite the child with his or her family and that the return of the child home cannot be achieved under the plan. Provides that the appointment may include, but is not limited to, court appointed special advocates.

Amends the Illinois Vehicle Code. Provides for the issuance of Prince Hall Freemasonry license plates. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and renewal. Provides that $15 of the additional fee for original issuance and $2 of the additional fee for renewal shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the additional fee for original issuance and $23 of the additional fee for renewal shall be deposited into the Master Mason Fund.

Amends the Illinois Oil and Gas Act. Provides that the Director of Natural Resources shall adopt rules that require, prior to such hydraulic fracturing, the owner or operator to perform a suitable mechanical integrity test of the casing or of the casing-tubing annulus or other mechanical integrity test methods using procedures that are established by administrative rule. Provides that each owner or operator that begins extracting natural gas from shale shall report to the Department specified information within 30 days after the completion of all stages of the hydraulic fracturing stimulation. Requires that the owner or operator shall post the chemical disclosure information on certain specified websites. Provides that the owner or operator shall provide information to the Director as to the amounts, handling, and, if necessary, disposal at an identified appropriate disposal facility, or reuse of the well stimulation fluid load recovered during flow back, swabbing, or recovery from production facility vessels. Provides that the storage of the well stimulation fluid load shall be protective of an underground source of drinking water by the use of either tanks or lined pits. Provides that nothing in the provision shall be construed to require or allow disclosure of trade secrets or commercial information that is exempt from inspection or copying when provided to the Department together with a claim made pursuant to the Freedom of Information Act that such information is proprietary, privileged, or confidential and that disclosure may cause competitive harm to the person or business. Provides that the provision only applies to the extraction of natural gas from shale.
