MEDICAID-BED RESERVES-PAYMNTS

Amends the Medical Assistance Article of the Illinois Public Aid Code. Deletes a provision requiring the Department of Healthcare and Family Services to cease payments for bed reserves for purposes of inpatient hospitalizations to intermediate care facilities for persons with development disabilities, except in the instance of residents who are under 21 years of age. Effective immediately.

DHFS-ICF/DD-BED RESERVE RATES

Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to adopt rules which establish a policy of bed reserve payments to Intermediate Care Facilities for the Developmentally Disabled (ICF/DDs) which addresses the needs of facility residents and their families. Requires the Department to set, by rule, certain bed reserve payment rates based on the length of time a resident of an ICF/DD is absent from the ICF/DD (i) for purposes of a physician-authorized in-patient admission to a hospital or (ii) for purposes of a home visit with a family member. Provides that no Department rule regarding bed reserve payments shall require an ICF/DD to have a specified percentage of total facility occupancy as a requirement for receiving bed reserve payments. Exempts State-operated facilities from the provisions of this amendatory Act. Effective immediately.

CHGO TEACHER PENSION FUNDING

Declares that it is the sense of the House that the Illinois General Assembly must make annual contributions to the Chicago Teachers' Pension Fund in an amount equal to 20-30% of the amount of the annual State contribution to the Teachers' Retirement System of Illinois.

MED PATIENT RIGHTS-ID BADGES

Amends the Medical Patient Rights Act to exempt facilities licensed or certified under the ID/DD Community Care Act or the Community-Integrated Living Arrangements Licensure and Certification Act from the provision concerning the wearing of identification badges.

MEDICAID-NEEDS ALLOWANCE

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides for a minimum monthly personal needs allowance, subject to appropriation, for persons who are inpatients in a facility licensed under the ID/DD Community Care Act and who are eligible for Medicaid. Provides that the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act, so that the person's total monthly personal needs allowance from both State and federal sources equals $50. Effective immediately.

CIV PRO-FORECLOSE-FRAUD-FELONY

Amends the Code of Civil Procedure. Provides that a person commits false representation concerning real estate title, a Class 4 felony, when he or she knowingly, as part of any transaction or legal proceeding under the Mortgage Foreclosure Article of the Code, claims an interest in real estate or executes, notarizes, or records a fraudulent real estate document. Provides that a person commits a pattern of making false representations concerning real estate title, a Class 3 felony, by committing false representation concerning title to real estate in 2 or more instances with a similar pattern or purpose which are not isolated incidents within the preceding 4 years and in which the aggregate loss or intended loss is more than $250. Provides that the Attorney General has a private right of action for civil penalties arising from such conduct. Provides that if a person does not correct the false representation within 20 days of a written request to do so, the owner or holder of the beneficial interest in real estate which is the subject of a false representation concerning real estate title may bring a civil action in the circuit court in the county in which the real estate is located to recover damages suffered by the owner or holder of the beneficial interest plus reasonable attorney's fees.
