COMP HEALTH INSURANCE-COVERAGE

COLLEGE ILLINOIS-BONUS MONEY

Amends the Illinois Prepaid Tuition Act. Subject to appropriation, provides that on July 1, 2008 or as soon thereafter as may be practical, the Illinois Student Assistance Commission shall deposit $200 into each individual participant account created in the Illinois Prepaid Tuition Trust Fund. Provides that if the amount appropriated is insufficient to deposit $200 into each individual participant account, then the total amount appropriated must be divided equally among all individual participant accounts. Effective July 1, 2008.

PROHIBIT INTERNET PRESCRIBING

Creates the Internet Prescribing Prohibition Act. Provides that licensed prescribers may not knowingly prescribe medications for a patient via the Internet, World Wide Web, telephone, facsimile, or any other electronic means unless (1) the patient has been physically examined by the prescriber or has been given a documented patient evaluation, including health history and a physical examination, to establish the diagnosis for which any legend drug is prescribed; (2) the prescriber and the patient have discussed treatment options and the risks and benefits of treatment; and (3) the prescriber has maintained the patient's medical records. Provides that these provisions shall not be construed to prohibit patient care in certain circumstances or to prevent the electronic distribution of a prescription to a pharmacy. Provides that a person convicted of violating these provisions is guilty of a business offense and shall be fined not less than $1,000 for the first violation and not less than $2,000 for a second or subsequent violation. Requires a person convicted of violating the Act to be reported to the Division of Professional Regulation of the Department of Financial and Professional Regulation for appropriate licensing board review. Amends the Medical Practice Act of 1987, the Podiatric Medical Practice Act of 1987, the Illinois Optometric Practice Act of 1987, the Illinois Dental Practice Act, the Physician Assistant Practice Act of 1987, and the Nursing and Advanced Practice Nursing Act to provide that violation of the Internet Prescribing Prohibition Act constitutes grounds for disciplinary action under those Acts.

CHIP-MASTECTOMY

Amends the Comprehensive Health Insurance Plan Act. Adds a provision requiring that the Plan provide coverage for mammograms and prosthetic devices or reconstructive surgery incident to a mastectomy, Pap tests, prostate-specific antigen tests, colorectal cancer examination and screening, and contraceptives as required under certain Sections of the Illinois Insurance Code. Provides that any expense or charge for routine physical examinations or tests related to certain covered benefits are not excluded from coverage under the Plan. Deletes a provision excluding any expense or charge for oral contraceptives used for birth control or any other temporary birth control measures from coverage under the Plan.

GREEN GOVERNMENT-GRANT

Creates the Illinois Energy Efficiency and Conservation Block Grant Act. Provides that the Green Governments Coordinating Council, in conjunction with the Office of Lieutenant Governor, shall be the State governmental body responsible for applying for and distributing any and all energy efficiency and conservation grant money pursuant to the federal Energy Independence and Security Act of 2007. Sets forth the duties of the Green Governments Coordinating Council with respect to those grant moneys. Effective immediately.

PROCUREMENT DISCLOSURES

Amends the Illinois Governmental Ethics Act. Requires that a special government agent file his or her statement of economic interests within 60 days after assuming responsibilities as a special government agent (now, within 30 days after making an ex parte communication). Amends the Illinois Procurement Code. Prohibits all State employees from obtaining State contracts (now, those earning more than 60% of the Governor's compensation). Requires that a waiver from the prohibition against obtaining State contracts must be filed within the earlier of 60 days after it is issued or when contract performance begins, and provides that the contract is voidable if the waiver is not filed within that period. Prohibits the State from entering into a contract with respect to the issuance of bonds or other securities with an entity that uses an independent consultant. Defines an independent consultant. Requires that a State contract with an entity subject to certain Municipal Securities Rulemaking Board requirements for reporting political contributions must include a certification of compliance during the contract with those requirements. Provides that violation makes the contract voidable by the State and bars the entity from State contracts with respect to issuance of bonds or other securities for 10 years. Permanently bars an entity found guilty of violating the rules’ prohibitions against obtaining or retaining securities business and making political contributions or payments. Effective immediately.

PEN CD-PERMITTED INVESTMENTS

Amends the Illinois Pension Code. In provisions concerning permitted investments for pension funds with net assets of $5,000,000 or more, (i) removes provisions requiring that securities are of a corporation created or existing under the laws of the United States or any state, district, or territory thereof and that the issuer of the stocks has been subject to the requirements of Section 12 of the federal Securities Exchange Act of 1934 and has been current with the filing requirements of specified Sections of that Act during the preceding 3 years and (ii) increases the maximum percentage of the market value of the pension fund's net present assets in certain investments from 35% to 50% if the fund utilizes an investment management consultant or an investment manager. Effective immediately.
