NURS HM-DAMAGES & ATTY'S FEES

Amends the Nursing Home Care Act. Provides that a licensee shall pay the actual damages (instead of the actual damages and costs and attorney's fees) to a facility resident whose rights, as specified in certain provisions of the Act, are violated. Effective immediately.

IEMA: HOMELAND SECURITY

Amends the Illinois Emergency Management Agency Act. Provides that the Illinois Emergency Management Agency shall establish guidelines by rule for the expenditure of the funds in the Homeland Security Preparedness Fund with input provided by a statewide interagency organization and public safety multidisciplinary organizations established to advise the Director of the Illinois Emergency Management Agency regarding public safety preparedness. Provides that the Illinois Emergency Management Agency shall spend the moneys in the fund to enhance State and local homeland security preparedness, all risk disaster response readiness, and statewide public safety mutual aid. Amends the State Finance Act to create the Homeland Security Preparedness Fund. Amends the Illinois Vehicle Code. Provides that, beginning with the 2015 registration year, a $3 surcharge shall be collected in addition to other registration fees for motor vehicles of the first division, motorcycles, motor driven cycles, pedalcycles, and vehicles registered in the 8,000 lb. and less flat weight plate category to be deposited into the Homeland Security Preparedness Fund for the Illinois Emergency Management Agency to use as directed under the Illinois Emergency Management Agency Act. Provides that this surcharge shall not apply to registration of vehicles by units of local, State, or federal government and other specified organizations.

EPA-USED OIL FILTER PROGRAM

Amends the Environmental Protection Act. Provides that, beginning on the effective date of this amendatory Act of the 99th General Assembly, no person may knowingly dispose of a used oil filter in a manner that is intended for collection and disposal at a landfill. Effective immediately.

ELEC CD-BD OF EDU ELECTIONS

Amends the Election Code and School Code. Authorizes nominations of candidates for schools district offices to be filed with the county clerk or county board of election commissioners of the county (instead of the election authority) in which the principal office of the school district is located. Makes changes concerning what the county clerk or county board of election commissioners may receive and file. Provides that if a board of education vacancy occurs within 90 days before the first date for filing petitions for the next regularly scheduled consolidated election (rather than with less than 868 days remaining in the term or less than 88 days before the next regularly scheduled election), then the person so appointed shall serve the remainder of the unexpired term, and no election to fill the vacancy shall be held. Requires the regional superintendent of schools to fill the vacancy within 60 (rather than 45) days if the remaining members have failed to fill the vacancy. Effective immediately.

CD CORR-EARLY RELEASE-50&15 YR

Amends the Unified Code of Corrections. Provides that upon a petition by a committed person who is at least 50 years of age and who has served at least 15 consecutive years of imprisonment in a Department of Corrections institution or facility, the Prisoner Review Board shall hear by at least 3 members and, with the approval of a majority of the Board voting on the petition, decide a committed person's eligibility for participation in the Elderly Rehabilitated Prisoner Supervised Release Program. Provides that the Board shall make use of a tool which assesses the petitioner's risks, assets, and needs to determine whether he or she may be released and if so, under what conditions. In assessing the petition, the Board shall consider information in the petition and information from the Department of Corrections and on its own resources. Provides that the Board shall consider the petition in its entirety and shall not order the release of the petitioner if it finds that the petitioner's release would pose an unacceptable risk of danger to public safety. Provides that the end date of the period of mandatory supervised release shall remain the same as it would have been had the petitioner not been given early supervised release, and the petitioner shall remain under the control of the Department until that date, except that the Board may enter an order releasing and discharging the petitioner from mandatory supervised release if it determines that he or she is likely to remain at liberty without committing another offense.

PEN CD-CHI FIRE-DIGITAL RECORD

Amends the Chicago Firefighter Article of the Illinois Pension Code. Authorizes the board of trustees of the Fund to have any records kept by the board photographed, microfilmed, or digitally or electronically reproduced in accordance with the Local Records Act. Provides that the photographs, microfilm, and digital and electronic reproductions shall be deemed original records and documents for all purposes, including introduction in evidence before all courts and administrative agencies. Effective immediately.
