CONSERVATION-OPEN SPACE FUND

Amends the Open Space Lands Acquisition and Development Act. Provides that, notwithstanding any other provision of law, moneys in the Open Space Lands Acquisition and Development Fund may not be appropriated, assigned, or transferred to another State fund. Effective immediately.

ZERO EMISSION VEHICLE ACT

Amends the Procurement Code. Requires bidders that respond to solicitations issued on or after January 1, 2027 for master contracts for the purchase of vehicles to submit an Illinois Jobs Plan that meets certain requirements. Amends the Electric Vehicle Rebate Act. Provides that, beginning July 1, 2027, changes electric vehicle rebates and requires Illinois residency and changes the luxury and low efficiency vehicle fee. Amends the Toll Highway Act. Requires the Toll Highway Authority to build at least 4 150 kW fast charging ports by 2027, expand to 8 ports by 2029 and 16 ports by 2031. Amends the Vehicle Code. Requires the Illinois Commerce Commission to establish biennial reporting for large fleets beginning in 2027. Amends the Electric Vehicle Charging Act. Provides that units of local government may grant exceptions if utility upgrades would materially increase construction costs, but EV capable spaces cannot fall below certain levels. Provides that Tenants and condominium owners may install Level 1, Low Power Level 2, or Level 2 charging systems at their own expense, subject to reasonable restrictions. Amends the State Mandates Act. Provides that State mandates created by the amendatory Act requires no reimbursement to units of local governments. Amends the Retailer Occupation Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act to make other changes. Effective immediately.

SCH CD-SPEC ED-NOTICES-FORMS

Amends the Children with Disabilities Article of the School Code. With respect to the identification, evaluation, and placement of children, requires the State Superintendent of Education to send a copy of certain revised uniform notices by July 1 of every even-numbered year to each school district and statewide organization representing those school professions involved with individualized education programs. Requires the copy of the revised uniform notices to include an updated instruction guide and access to remote training materials. Provides that a third-party software provider that creates a platform for an individualized educational assessment form shall include a footnote that includes a reference to how to contact the State Board of Education, instructions on completing an individualized educational assessment form, an instructional video on how to fill out an individualized educational assessment form, and contact information for a person at the State Board of Education who can answer questions about completing an individualized educational assessment form. Prohibits a school district from modifying or customizing its individualized educational assessment form. Provides that the State Board of Education, in its adoption of rules regarding an individualized education program, may not include in an individualized educational assessment form a separate section regarding autism consideration.

OPERATING ROOM SAFETY ACT

Creates the Operating Room Patient Safety Act. Provides that each surgical technologist hired or contracted by a health care facility on or after January 1, 2028 shall meet specified educational, certification, or experiential requirements. Provides that health care facilities located in a Health Professional Shortage Area or Medically Underserved Area, as determined by the federal government, shall be exempt as provided but shall have a hiring preference for surgical technologists who graduated from nationally accredited surgical technology programs and are certified through the National Board of Surgical Technology and Surgical Assisting or the National Center for Competency Testing. Provides that nothing in the Act prohibits a person licensed in the State under any other Act from engaging in the practice for which the person is licensed, including, but not limited to, a physician licensed to practice medicine in all its branches, a physician assistant, an advanced practice registered nurse, or a nurse performing surgery-related tasks within the scope of the nurse's license or registration; or a student or intern from performing surgical technology services under direct supervision, as defined in the Registered Surgical Assistant and Registered Surgical Technologist Title Protection Act.

SCH CD-SEXUAL MISCONDUCT

Amends the School Code. In provisions concerning sexual misconduct in schools, provides that guidelines established for certain situations and all available methods for how to report staff-student boundary violations within a school and to external agencies must be posted on the website, if any, of each school district, charter school, or nonpublic school and must be included in any staff, student, and (instead of or) parent handbook provided by the school district, charter school, or nonpublic school (instead of nonpublic, nonsectarian elementary or secondary school). In provisions concerning an employment history review, requires a job applicant to provide the name, address, telephone number, and other relevant contact information of the applicant's current employer only if the applicant has direct contact with children or students at the applicant's current employer. Provides that for a licensed substitute teacher who is seeking employment in more than one school district, a school district's regional office of education or intermediate service center may collect and share specified information and records. Provides that a regional office of education's or intermediate service center's participation in the employment history review shall be limited to collecting such information and records and sharing the information and records with the school district or school districts. Sets forth other provisions concerning a regional office of education's or intermediate service center's participation in the employment history review and how long the review remains valid. Makes corresponding changes.

PFAS-CONTAINING PESTICIDES

Amends the Illinois Pesticide Act. Provides that the statements that are to be provided by pesticide registrants under the Act must include either a specific statement that the pesticide to be registered contains no PFAS or, if the pesticide (including its active and inert ingredients) contains any PFAS, certain information regarding the PFAS, including the name of the specific chemical and the quantity of the chemical in the product. Provides that the Director of Agriculture shall not register any pesticide product that contains a chemical that is an intentionally added PFAS and that the use of any pesticide that contains any chemical that is an intentionally added PFAS is prohibited. Further provides, beginning January 1, 2030, that the use of any spray adjuvant that contains intentionally added PFAS is prohibited. Requires the Department of Agriculture to adopt rules to implement these provisions. Defines "PFAS" and "intentionally added PFAS".

SWITCH NETWORK SALVAGE

Amends the Public Utilities Act. In provisions concerning a Large Electing Provider's transition to IP-based networks and service, provides that a Large Electing Provider shall provide telecommunications service, including telecommunications service over traditional circuit switched networks, to existing business and residential end-use customers until at least December 31, 2031. Provides that, beginning January 1, 2032, a Large Electing Provider shall start the process of returning the salvage value of traditional circuit switched networks to the people of the State. Requires a Large Electing Provider to complete the salvage of the Large Electing Provider's traditional circuit switched networks by January 1, 2038. Provides that the Large Electing Provider shall document and report to the Department of Public Health and the Illinois Commerce Commission, on a quarterly basis, all activities related to the salvage of the Large Electing Provider's traditional circuit switch networks, including, but not limited to, the total realized salvage value, a per-mile salvage value, the geographic location of all salvages, and the value of such salvages. Provides that, if a Large Electing Provider retires a traditional circuit switch network, the Large Electing Provider shall, beginning on December 1, 2032 and annually thereafter, transfer the salvage value of the retired networks to the Lead Service Line Replacement Fund for the sole purpose of providing grants to municipal and private water utilities to replace lead service lines. Effective immediately.

ENDANGERING CHILD & EVIDENCE

Amends the Criminal Code of 2012. Provides that a second or subsequent violation of endangering the life or health of a child or a similar statute of this State or any other state of an offense that is substantially equivalent to the offense of endangering the life or health of a child is a Class 3 felony. Provides that in addition to any other penalty provided by law, upon conviction for endangering the life or health of a child, the court may order the convicted person to undergo a psychological or psychiatric evaluation and to undergo any treatment at the convicted person's expense that the court determines to be appropriate after due consideration of the evaluation. Provides that the special probation provisions are not applicable to a person convicted of a second or subsequent violation of endangering the life or health of a child or child abandonment or similar statutes of other states. Amends the Code of Criminal Procedure of 1963. Provides that in a prosecution for a physical or sexual act perpetrated upon or against a youth who is a victim of trafficking in persons, involuntary servitude, and related offenses, provides for the admission of certain evidence as an exception to the hearsay rule. Amends the Bill of Rights for Children. Provides that a child reported to the Department of Children and Family Services or law enforcement to be a victim of a physical act or a youth who is a victim of trafficking in persons, involuntary servitude, and related offenses, whose case is accepted by either agency for investigation has the right to have that child's forensic interview conducted by a forensic interviewer from a children's advocacy center accredited according to the Children's Advocacy Center Act and serving the child's area or jurisdiction where the incident occurred, when such service is accessible based on the children's advocacy center's available resources. Amends the Privacy of Child Victims of Criminal Sexual Offenses Act. In a prosecution or investigation of sexual abuse against children under 18 years of age, permits disclosure to a multidisciplinary team member, as defined in the Children's Advocacy Center Act, and to a nonoffending parent or guardian of the identity of any child who is a victim of such criminal sexual offense or alleged criminal sexual offense. Defines "child" and "youth".

SCH CD-BD MEMBER TRAINING/TOUR

Amends the School Code. Requires every voting member of a school board of a school district (other than the Chicago school district) to complete a minimum of 4 hours of professional development and leadership training within the first year of every elected term (rather than within the first year of his or her first term). Provides that in addition to training, every voting member of a school board shall, within the first year of every elected term, tour any affiliated education buildings that a student may attend while under the direction of the school district. Effective July 1, 2027.

ELECTRONIC DEVICE STEWARDSHIP

Creates the Electronic Device Stewardship Act. Requires a producer that sells an electronic smoking device to implement and finance an electronic smoking device stewardship program, no later than 2 years after the effective date of the Act, through a producer responsibility organization that is approved by the Environmental Protection Agency. Requires a producer responsibility organization to submit an electronic smoking device stewardship plan to the Agency for approval no later than 2 years after the effective date of the Act. Establishes requirements regarding fees collected from participating producers. Sets forth procedures regarding approval of stewardship plans. Prohibits, beginning 2 years after the effective date of the Act, a producer from selling, offering for sale, distributing, or importing for sale an electronic smoking device unless the producer is in an approved producer responsibility organization in compliance with the Act, with a civil penalty of up to $10,000 for a violation. Provides an affirmative defense for a distributor or retailer for reliance on the representation of a producer or producer responsibility organization. Allows the Attorney General to recover civil penalties and any other damages and to seek injunctive relief. Provides an antitrust exemption. Requires a producer responsibility organization to submit an annual report to the Environmental Protection Agency. Requires the Agency to adopt rules and conduct an evaluation. Makes findings and states the purpose of the Act. Defines terms. Effective immediately.
