FIRE PROTECTION-TRUSTEE

Amends the Fire Protection District Act. Provides that trustees in a fire protection district with more than 30 full-time paid firefighters shall receive a salary not to exceed $4,000 per year (now, $2,000 per year). Effective immediately.

ELECTRONIC HARMFUL MATERIAL

Amends the Criminal Code of 1961. Provides that it is unlawful for a minor under 17 years of age to knowingly disseminate any material that depicts nudity or other sexual conduct by electronic transfer or capture of images of the person's self image or image of another minor under 17 years of age. Provides that it is unlawful for a minor under 17 years of age to knowingly request another minor under 17 years of age to violate this provision and distribute that image or images to another person or persons. Provides that it is unlawful for a minor under 17 years of age to knowingly obtain an image in violation of these provisions and distribute the image or images by means of uploading the nude image on an Internet website with the intent to injure the reputation of the other person or with the intent to cause emotional distress to the other person or with the intent to profit from the display of the image and to maintain an Internet website or webpage which is accessible to one or more third parties for a period of at least 24 hours. Establishes penalties.

ELECTIONS-NOMINATION VACANCY

Amends the Election Code. Beginning June 1, 2011, provides that when a vacancy in nomination occurs on or after the general primary but more than 90 days before certification of candidates for the general election ballot, other than because no candidate's name appeared on the general primary ballot and no write-in candidate was nominated, the vacancy may be filled only at a special primary election on a date set by the State Board of Elections but at least 30 days before the date of certification. Beginning June 1, 2011, permits a vacancy in nomination occurring less than 91 days before certification of candidates for the general election ballot but more than 15 days before the general election to be filled by the political party's nominating committee only if the vacancy is due to the candidate's death or incapacitating illness. Beginning June 1, 2011, adds inability to fulfill the duties of the office sought due to illness as an event creating a vacancy in nomination. (Now, a vacancy in nomination occurring on or after the general primary, other than due to the lack of candidates, and before the 15th day before the general election is filled by the party's nominating committee by certain deadlines based upon when the vacancy occurs).

COOK COUNTY REASSESSMENTS

Amends the Property Tax Code. Requires that, in counties with 3,000,000 or more inhabitants, on or before October 1, 2010, the county assessor shall reassess all property in the county for which 2010 is not the general assessment year. Provides that the reassessments may not be done through the application of one or more factors, mathematical or otherwise. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

PROP TX-HOMESTEAD EXEMPTIONS

Amends the Property Tax Code. Provides that the alternative general homestead exemption applies on a permanent basis and increases the amount of the exemption to $60,000 for taxable year 2010 and thereafter. Effective immediately.

LOCAL GOV-HOME RULE TAXES

Amends the Home Rule County Retailers' Occupation Tax Law of the Counties Code and the Home Rule County Service Occupation Tax Law of the Counties Code. Provides that the maximum tax rate that is permitted under those Laws is 0.75%, unless a higher rate is authorized by referendum. Amends the Home Rule Municipal Retailers' Occupation Tax Act of the Illinois Municipal Code and the Home Rule Municipal Service Occupation Tax Act of the Illinois Municipal Code. Provides that the maximum tax rate that is permitted in the City of Chicago under those Tax Acts is 1.25%, unless a higher rate is authorized by referendum. Preempts home rule powers. Effective immediately.

BRDS AND COMMS ADVISORY PANEL

Creates the Boards and Commissions Advisory Panel for the purpose of conducting an exhaustive analysis of all statutorily created advisory panels, authorities, boards, commissions, committees, councils, and task forces to determine where cost savings may be made.

CIRCUIT BREAKR-COVERED RX DRUG

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Provides that beginning January 1, 2010, "covered prescription drug" includes any prescription drug used in the treatment of multiple sclerosis that is covered by the Medicare Part D Prescription Drug Plan in which the beneficiary is enrolled. Effective immediately.

ST ETHICS-REVOLVING DOOR

Amends the State Officials and Employees Ethics Act. With respect to the procurement revolving door prohibition, removes the requirement that the procurement participation by the former State executive branch constitutional officer, legislator, or employee was personal and substantial. Requires that the appropriate ethics commission or Auditor General conduct a public hearing, at which public comment may be offered, before granting or denying a waiver of the prohibition against the procurement or regulatory revolving door. In determining whether to grant or deny a waiver, requires that the appropriate ethics commission or Auditor General assess relevant information, including the effect of the prospective employment or relationship upon the procurement or regulatory decisions based on the totality of the participation by the former officer, legislator, or employee in those decisions (now, a waiver shall be granted upon a showing that the prospective employment or relationship did not affect the procurement or regulatory decisions). Effective immediately.
