SNOW REMOVAL LIABILITY LIMITS

Creates the Snow Removal Service Liability Limitation Act. Provides that any provision in a snow plow and de-icing services contract that purports to indemnify or hold harmless a promisee from or against liability for loss or damage resulting from the negligence or omissions of the promisee is against the public policy of this State and is void and unenforceable. Effective immediately.

ESTATE TAX-REPEAL

Amends the Illinois Estate and Generation-Skipping Transfer Tax Act. Provides that no tax shall be imposed under the Act for persons dying on or after the effective date of the amendatory Act or for transfers made on or after the effective date of the amendatory Act. Effective immediately.

LOTTERY-INTERNET PILOT PROGRAM

Amends the Illinois Lottery Law. Makes the Internet pilot program, which allows the sale of lottery tickets over the Internet, a permanent program. Effective immediately.

CHILD CARE-CRIMINAL CONVICTION

Amends the Child Care Act of 1969. Removes language concerning which specific offenses under the Criminal Code of 1961 or the Criminal Code of 2012 bars licensure or employment in facilities regulated under the Act and foster family homes. Removes language concerning granting exceptions for those offenses. Provides that no new applicant and, on the date of licensure renewal, no current licensee may operate or receive a license from the Department to operate and no person may be employed by and no adult person may reside in a child care facility licensed by the Department, including a foster family home, if that person: (1) has been convicted of any felony offense within 5 years of application or employment, (2) has been convicted of a Class X felony, (3) has been convicted of any felony in which the victim was a child under the age of 18, (4) is currently on the Illinois State Police Sex Offender Registry, (5) is currently on the Murderer and Violent Offender Against Youth Database, or (6) was adjudicated not guilty for an offense by reason of insanity. Provides for procedures for the Director of the Department of Children and Family Services to waive certain offenses and factors for the Director to consider. Provides that denials of waiver may be appealed pursuant to the Illinois Administrative Procedure Act. Amends the Children and Family Services Act to make a related change.

ANIMALS-POLICE AND SERVICE

Amends the Humane Care for Animals Act. Provides that a person who willfully or maliciously tortures, mutilates, injures, disables, poisons, or kills any animal used by a law enforcement department or agency in the performance of the functions or duties of the department or agency of when placed off duty, any service animal, any search and rescue dog, any law enforcement, service, or search and rescue animal in training, or any accelerant detection canine used by a fire officer for arson investigations in the performance of his or her functions or while off duty, if the animal is not killed or totally disabled, the person is guilty of a Class 3 felony, and if the animal is killed or totally disabled, the person is guilty of a Class 2 felony. Provides that a person who kills or severely injures any animal used by a law enforcement department or agency in the performance of the functions or duties of the department or agency of when placed off duty, any service animal, any search and rescue dog, any law enforcement, service, or search and rescue animal in training, or any accelerant detection canine used by a fire officer for arson investigations in the performance of his or her functions or while off duty, while he or she is in the commission of a felony, is guilty of a Class 2 felony. If the offender is found to be guilty under this Section, the offender shall be responsible for any veterinarian bills for an animal that was injured, and training costs for another animal, if the animal injured or killed is no longer able to be in service.

LOTTERY-AUDIT FINDINGS

Amends the Illinois Lottery Law. Requires the Department of the Lottery, on or before the last day of each fiscal year, to deposit any estimated remaining proceeds (rather than any remaining proceeds), after certain payments and transfers are made, into the Capital Projects Fund. Provides that the Department shall increase or decrease its deposit into the Capital Projects Fund each year by the amount that the actual expenditures either fell short of or exceeded the estimate used by the Department in making the deposit for the previous fiscal year. Effective immediately.

$IHDA-FEDERAL FUNDS

Appropriates and re-appropriates funds from the Federal HOME Investment Trust Fund to the Department of Revenue for the Illinois HOME Investment Partnerships Program administered by the Illinois Housing Development Authority for the fiscal year beginning July 1, 2015. Effective immediately.

LOCAL GOV-INTERNET POSTINGS

Amends the Local Records Act. Requires a unit of local government serving a population of 5,000 or more and a school district with an enrollment of 500 or more students to maintain an Internet website and post to that website, for the current calendar or fiscal year, as the case may be, specified information. Provides that a citizen who is a resident of the unit of local government or school district may bring a mandamus or injunction action to compel the unit of local government or school district to comply with the Internet posting requirements. Provides that records posted pursuant to the amendatory Act shall remain posted on the entity's website, or subsequent websites, in perpetuity. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Contains a severability clause. Amends the Freedom of Information Act. Provides that a public body is not required to copy and make available for public inspection a public record that is published on the public body's website if the public body's Freedom of Information officer certifies that the online record is a true and accurate copy of the original record maintained by the public body. Provides that the Freedom of Information officer shall notify the person requesting the public record that it is available online. Provides that if the person requesting the public record is unable to access the record online, the public body is then required to copy and make available the public record. Effective immediately.
