ILLINOIS COOL CITIES ACT

Creates the Illinois Cool Cities Act. Provides that the Environmental Protection Agency shall provide technical assistance, if needed, to units of local government in the State that have endorsed the U.S. Conference of Mayors Climate Protection Agreement. Provides that any unit of local government may request designation as an Illinois Cool City if the unit of local government has (i) endorsed the U.S. Conference of Mayors Climate Protection Agreement and (ii) prepared and approved a plan to achieve a 7% reduction in greenhouse gas emissions from 1990 levels by the year 2012. Provides for designation of Illinois Cool Cities upon certain findings by the Director of the Environmental Protection Agency. Effective immediately.

EPA-FOSSIL FUEL EMISSIONS

Amends the Environmental Protection Act. In a Section regarding the control and reduction of emissions from fossil fuel-fired electric generating plants, provides that the Section is not intended to limit or restrict the authority of the Illinois Environmental Protection Agency to propose, or the Illinois Pollution Control Board to adopt, any regulations applicable or that may become applicable to these facilities that are required by federal law or that are otherwise part of the State's plan to attain the national ambient air quality standards or that are necessary to comply with the requirements of the federal Clean Air Act (now, just the applicable regulations required by federal law). Deletes a provision requiring the Board to adopt certain sulfur dioxide regulations and emission standards for existing fuel combustion stationary emission sources. Effective immediately.

DPT AGING-ELDER ABUSE FATALITY

Amends the Elder Abuse and Neglect Act. Authorizes the Department on Aging or any other State or county agency to establish regional interagency elder abuse fatality review teams composed of representatives of entities and individuals including, but not limited to, the Department on Aging, the Department of Public Health, coroners or medical examiners (or both), State's Attorneys, local police departments, forensic units, and providers of services for persons age 60 or older. Requires the teams to review cases of deaths (i) involving blunt force trauma or an undetermined or suspicious cause of death, (ii) if requested by the deceased's attending physician, (iii) upon referral by a health care provider, or (iv) constituting an open or closed case from a senior protective services agency, law enforcement agency, or State's Attorney's office that involves alleged or suspected abuse, neglect, or financial exploitation. Authorizes the teams to review other cases. Requires the Department on Aging, in consultation with coroners, medical examiners, and law enforcement agencies, to use data gathered by the teams and recommendations made by the teams to create an annual report, and provides that the Department, in consultation with those others, may use the data and recommendations to develop education, prevention, prosecution, or other strategies. Authorizes creation of a database of at-risk individuals.

MOBILE HOME LANDLORD TENANT

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that a park owner shall present a lease to a prospective tenant at least one day before signing the lease. Provides that when a mobile home park is owned by an entity that is publicly traded on any national stock or securities exchange, then the following conditions apply: 1) the park owner is to have a refund procedure for a lease or purchase agreement that a prospective tenant cancels within 3 days after signing the lease or purchase agreement; 2) if a tenant leaves the park because of a temporary illness or disability, the park owner shall allow qualified, including age in a park that has "housing for older persons", relatives designated by the tenant or the tenant's guardian to live in the home; 3) automatic lease renewal for 2 years unless certain requirements are met, such as a 30-day notice and a notice of reasons for the non-renewal of the lease; 4) the park owner is to give 12 months notice of a decision to close all or part of the park. Provides that a park owner may enter into a month-to-month rental agreement with a tenant if the agreement requires that there must be a rent increase notice given at least 90 days in advance of any increase and the tenant signs a statement that acknowledges that he or she wanted a shorter lease and was offered a longer lease. Provides a 90 day period following the effective date of the statutory changes to allow leases to be issued or modified in order to conform to the statutory changes. Provides for delivery of notices by first class mail. Provides that if the only change in a lease for a new term is the amount of the rent, the park owner may issue a rent increase notice, rather than issue a new lease.

DCFS-CHILD ABUSE-STATES ATTY

Amends the Abused and Neglected Child Reporting Act. Provides that whenever the Department of Children and Family Services receives, by means of its statewide toll-free telephone number established for the purpose of reporting suspected child abuse or neglect, a report of a newborn infant whose blood, urine, or meconium contains any amount of cocaine, the Department must immediately report that information to the State's Attorney of the county in which the infant was born. Effective immediately.

GREEN BLDG-ENTERPRISE ZONES

Amends the Illinois Enterprise Zone Act. Provides that a private development is qualified to become and is an enterprise zone and eligible for all the benefits of an enterprise zone if it (i) achieves certification using nationally recognized and accepted green building and sensible growth guidelines, standards, or systems, and (ii) is selected through a request for proposals by the Capital Development Board. Amends the Capital Development Board Act. Provides that the Capital Development Board shall issue a request for proposals by December 31, 2008 to select 3 model private developments that are designated by specified organizations as achieving certification using nationally recognized and accepted green building and sensible growth guidelines on a neighborhood scale. Provides that the model projects shall be designated as such to receive the benefits attained through Illinois Enterprise Zones for a period of 5 years.

MOTOR FUEL SALES-DISABILITIES

Amends the Motor Fuel Sales Act. Repeals language providing that the Act does not apply to gasoline or service stations offering motor fuel for sale only at self-service islands. Requires a station that offers motor fuel for sale only at self-service islands to provide at one or more islands a calling device that allows a person with a decal, a device, or registration plates issued to a person with disabilities to request assistance in dispensing motor fuel. Sets forth requirements for the calling device and signage. Provides that the station may not impose an additional charge for the assistance in dispensing motor fuel. Sets forth circumstances under which: (i) a station is not required to provide a calling device or (ii) a station is required to provide a calling device only during certain hours. Provides that the requirements of the Act do not apply if the driver or a passenger is reasonably capable of dispensing motor fuel. Provides that a gasoline station owner who violates either of these provisions is guilty of a petty offense and subject to a fine of not less than $300 and not more than $600.

SEX OFFENDER-INTERNET IDENTITY

Amends the Sex Offender Registration Act. Provides that when a sex offender registers with the appropriate law enforcement agency, he or she shall provide the law enforcement agency with all e-mail addresses, instant messaging identities, chat room identities, and other Internet communications identities that the sex offender uses or plans to use, all Uniform Resource Locators (URLs) registered or used by the sex offender, and all blogs and other Internet sites maintained by the sex offender or to which the sex offender has uploaded any content or posted any messages or information. Amends the Sex Offender Community Notification Law. Provides for disclosure of such information to the public. Effective immediately.

ED PARTNERSHIP ACT-PAY TUTORS

Amends the Educational Partnership Act. Provides that public and private institutions of higher education that have approved teacher education programs may engage pre-service teacher candidates in the tutorial services provided for in the Act. Allows these students to receive compensation for such tutorial services while also receiving academic or clinical experience credit or both.
