Amends the State Finance Act. Provides that, beginning with fiscal year 2010 and thereafter, Road Fund moneys may not be appropriated to certain executive agencies. Prohibits certain transfers from the Road Fund or the State Construction Account Fund. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, beginning on July 1, 2009, motor fuel and gasohol must be taxed under the Acts at the rate of 1.25% (now, 6.25%). Amends the Motor Fuel Tax Law. Imposes an additional tax of $0.150 per gallon on motor fuel sold in the State. Provides that this additional tax must be adjusted each fiscal year to account for inflation. Provides that the proceeds of this additional tax must be deposited into the Metropolitan Transit and Road Improvement Fund and sets forth certain requirements regarding distributions from that Fund. Effective July 1, 2009.

Amends the Transitional Bilingual Education Article of the School Code. Adds as a purpose of the Article the establishment of approved alternative programs in public schools. Provides that an approved alternative program means a full-time program of instruction (1) in all of those courses or subjects that a child is required by law to receive and that are required by the child's school district, given in either the native language of those children of limited English-speaking ability who are enrolled in the program or in English; and (2) that consists of both a structured English immersion program and a program of 2-way bilingual education, or a part-time program of instruction based on the educational needs of those children of limited English-speaking ability who do not need a full-time program of instruction.
Amends the Election Code. Establishes the Office of Campaign Finance Disclosure Auditor within the State Board of Elections, under the direction and supervision of an Auditor appointed by the State Board. Requires the Auditor to audit campaign finance disclosure reports and authorizes the Auditor to conduct audits and investigations with respect to campaign finance statements and forms filed with the State Board.
Amends the Illinois Vehicle Code by providing that a county may adopt all or any portion of the Illinois Vehicle Code by reference. Provides that a county or municipality may set minimum and maximum penalties that are at least as stringent as the penalties for violations provided by the Illinois Vehicle Code.
Amends the State Employee Article of the Illinois Pension Code. Provides the alternative (State police) retirement formula for certain tollway employees, automotive mechanics, mechanic/autobody technicians, automotive attendants, sign hangers, and sign hanger foremen. In provisions concerning the alternative retirement formula, makes changes to reflect obsolete job designations of the Illinois State Toll Highway Authority. Requires the Illinois State Toll Highway Authority to make contributions to the System of amounts that will be sufficient to meet the cost of any additional liability created by the amendatory Act for its employees. Includes language in compliance with the new benefit increase provisions. Effective immediately.
Amends the Criminal Code of 1961. Provides that recording or listening with the aid of any device to incoming telephone calls of phone lines publicly listed or advertised as telephone answering services and utilized by business or professional organizations for such purposes is exempt from an eavesdropping violation. Provides that if such recordings contain information relevant to a criminal investigation, they must be turned over to local law enforcement authorities within 24 hours from the time of such recording or as soon as practicable and shall not be otherwise disseminated. Provides that failure on the part of the individual or business operating any such recording or listening device to comply with these requirements shall eliminate any civil or criminal immunity conferred upon that individual or business by the operation of the eavesdropping exemption provisions. Effective immediately.
Amends the Illinois Food, Drug and Cosmetic Act and the Criminal Code of 1961 to include in the definition of "raw agricultural commodity", honey that is in the comb or that is removed from the comb and in an unadulterated condition. Further amends the Illinois Food, Drug and Cosmetic Act to provide that notwithstanding any other provision of the Act, the Department of Public Health may not regulate honey that is in the comb or that is removed from the comb and in an unadulterated condition. Provides that both forms of honey are exempt from the provisions of the Act. Amends the Sanitary Food Preparation Act. Sets forth a definition of "honey house". Provides that notwithstanding any other provision of the Act, the Department of Public Health may not regulate honey that is in the comb or that is removed from the comb and in an unadulterated condition. Provides that both forms of honey are exempt from the provisions of the Act. Provides that if a producer is engaged in the sale of honey at a local market and packs or sells less than 500 gallons of honey produced in this State per year, then the Department may not regulate or inspect the producer's honey house.
Amends the Counties Code. Provides that the county boards of Cook, DuPage, Kane, Lake, McHenry, and Will Counties may impose a tax upon all rail line owners (calculated per rail car per mile) for the privilege of operating a rail line within the county and that the rate must be sufficient to complete necessary grade crossing separation work and related infrastructure improvements to improve safety for first responders and the general public. Contains other provisions. Effective immediately.
Amends the Election Code. Provides that a person who (i) filed a statement of candidacy as an established political party's candidate at a general primary or (ii) voted at an established political party's general primary may not file a statement of candidacy as an independent candidate or as a different party's candidate at the immediately following general election. A person may file a statement of candidacy for a partisan office as a qualified primary voter of an established political party regardless of any prior filing of candidacy for a partisan office or voting the ballot of an established political party at any prior election. Effective immediately.
Amends the Compensation Review Act. With respect to Compensation Review Board recommendations beginning in 2010 for cost of living adjustments to General Assembly member compensation, prohibits the recommendation from including adjustments for periods of time other than the period since the Board's most recent previous report. Invalidates any violating portions of future reports, and prohibits the payment of funds appropriated for compensation in violation of the prohibition.
