INC TAX-HIGHER EDUCATION

Amends the Illinois Income Tax Act. Authorizes a credit to individual taxpayers who are residents of Illinois for expenditures made by the taxpayer during the taxable year for qualified college tuition expenses paid for the taxpayer or a dependent of the taxpayer, as determined under the Act, for up to 4 years of college education for each eligible student attending an institution of higher education. The amount of the credit is equal to 25% of the qualified college tuition expenses, but not to exceed $2,500 per student per taxable year. If a taxpayer claims a credit for a dependent, then that dependent may not claim a credit on the dependent's return for that taxable year. Defines "qualified college tuition expenses" as the tuition required for the enrollment or attendance of an eligible student at an institution of higher education who is eligible to receive grants from the Monetary Award Program, except that tuition payments made through scholarships or other financial aid are excluded and tuition payments for post-baccalaureate or other graduate degrees are excluded. Provides that the credit may not reduce the taxpayer's liability to less than zero and may not be carried back or carried forward. Exempt from the Act's sunset provisions. Effective immediately.

$DCEO-FERMI LAB-ACCELERATOR

Appropriates $35,000,000 from the Build Illinois Bond Fund to the Department of Commerce and Economic Opportunity for a grant to Fermi National Accelerator Laboratory for the Illinois Accelerator Research Center. Appropriates $15,000,000 from the General Revenue Fund to DCEO for a grant to the Fermi National Accelerator Laboratory for implementation of the Illinois Accelerator Research Center. Effective July 1, 2009.

HEALTH-HONEY-RAW AG COMMODITY

Amends the Illinois Food, Drug and Cosmetic Act. In the definition of "raw agricultural commodity", includes honey, whether on the comb, extracted, churned, or in crystallized form. Effective immediately.

FORECLSE-TENANT NOTICE-COUNTY

Amends the Code of Civil Procedure. Provides that no mortgagee-in-possession, receiver or holder of a certificate of sale or deed, or purchaser who fails to file a supplemental petition for possession during the pendency of a mortgage foreclosure shall file a forcible entry and detainer action against a tenant or subtenant (instead of tenant) of the mortgaged real estate until 90 days after a notice of intent to file such action that identifies the tenant or subtenant and the premises (instead of notice of intent to file such action) has been properly served upon the tenant or subtenant and the county housing authority, but if the county has not formed a county housing authority, then upon the county clerk (instead of has been properly served upon the tenant).

DCEO-GRANTS-EFFICIENT BOILERS

Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Requires the Department to establish a grant program to encourage the purchase and installation of high energy efficiency boilers. Provides that the grants are only available for the purchase and installation of these boilers in commercial buildings and multi-family residential buildings.

ADMIN PRO-SMALL BUSINESS

Amends the Illinois Administrative Procedure Act. Requires that the economic impact analysis for a proposed rule affecting small businesses be prepared by the agency promulgating the rule (now, the Business Assistance Office of the Department of Commerce and Economic Opportunity). Requires each agency to perform periodic reviews of its rules in order to evaluate their affect upon small businesses.

Amends the Illinois Underground Utility Facilities Damage Prevention Act. Provides that after the effective date all new or replaced underground utility lines must be marked with detectable underground warning tape, which is able to be traced by inductive locating. Requires that the marking shall be a minimum of 6 inches and be buried as close to the ground surface as possible, or between 4 and 6 inches deep. Provides that the warning tape shall be American Public Works Association color-coded to match the type of utility line it is protecting.

UTILITIES-FIBER OPTIC CONDUIT

Amends the Illinois Highway Code and the Illinois Underground Utility Facilities Damage Prevention Act.
