INC TX-HEALTH SAVINGS ACCOUNTS

Amends the Illinois Income Tax Act. Provides income tax deductions for contributions to and interest on a health savings account, established under the Medicare Prescription Drug, Improvement and Modernization Act of 2003. Effective July 1, 2007.

LAKE MICHIGAN POLLUTION

Amends the Rivers, Lakes, and Streams Act. Requires the Director of the Environmental Protection Agency to seek negotiations with each state that borders Lake Michigan to establish a notification policy under which the states will notify one another when permitting new sources of water pollution or increased levels of pollution into Lake Michigan. Requires the Director to report to the General Assembly no later than January 1, 2009 on the status of these negotiations. Effective immediately.

PREMATURE AWARENESS MONTH

Recognizes the dedication and efforts of the March of Dimes Illinois Chapter and its volunteers and proclaims the month of November to be Premature Birth Awareness Month in the State of Illinois.

HEALTH SAVINGS ACCOUNTS

Creates the Health Savings Account Act and amends the Illinois Income Tax Act. Provides that, beginning in taxable year 2008, a resident of Illinois or an employer may deposit contributions, subject to certain limitations, into a health savings account. Provides that the principal contributed to and the interest earned on a health savings account and money reimbursed to an eligible individual or an employee for qualified medical expenses is exempt from the Illinois income tax. Sets forth restriction on the use of funds held in a health savings account. Provides that an eligible individual may withdraw money from his or her health savings account for any purpose, but provides that certain withdrawals are not tax exempt. Repeals the Health Savings Account Act on June 30, 2018. Effective July 1, 2007.

MENTAL HEALTH-REPORTING

Amends the Mental Health and Developmental Disabilities Code. Changes the content of the quarterly report that a mental hospital or facility administering electro-convulsive therapy must submit to include: (i) whether the patient gave informed consent or received therapy without informed consent, was confined as subject to involuntary admission, or received the therapy on an emergency basis; (ii) the type and charge dose of electro-convulsive treatments used; (iii) the identity of the treating hospital; (iv) if no patients have been treated using electro-convulsive therapy during that quarter, a written statement to that effect; and (v) for the first quarter report of each year, a copy of the informed consent used for electro-convulsive therapy, including any pamphlet or form information given to the patient on electro-convulsive therapy. Requires the Department of Human Services to include in its annual report the names of all facilities that have failed to comply with the listed reporting requirements during the calendar year covered by the annual report. Provide for the enforcement of the reporting requirements and civil penalties for failure to report. Effective immediately.

INS-ID THFT INS DISCLOSURES

Amends the Illinois Insurance Code. Requires the Department of Financial and Professional Regulation to develop appropriate disclosures to be provided to purchasers of identity theft insurance, including what the insured will receive if he or she is a victim of identity theft and how to protect himself or herself from identity theft.

KIDCARE-MEDICAID-MANAGED CARE

Amends the Children's Health Insurance Program Act and the Illinois Public Aid Code. Under the Children's Health Insurance Program Act, provides that the Department of Healthcare and Family Services shall implement the following: (1) on and after July 1, 2007, a capitated managed care system for selected populations of persons in certain counties surrounding Cook County and in certain counties in southern Illinois, under which the State pays a fixed amount per individual per month to a third-party entity to manage the program of health care benefits and assume the risk associated with the payment of medical bills without regard to the actual medical claims incurred; (2) on and after July 1, 2007, a primary care case management (PCCM) system for selected populations of persons in the remaining counties of the State other than Cook County, under which each participant has one health care provider who is responsible for managing all aspects of the participant's medical care; and (3) on and after July 1, 2007, a PCCM system for selected populations of persons in Cook County. Requires the Department to file a report describing a mechanism for achieving a transition to a capitated managed care system for persons in Cook County by July 1, 2008. Requires that the populations selected for participation in the various systems must include, at a minimum, all persons eligible for benefits under the Children's Health Insurance Program Act. Provides that the Department may implement similar capitated managed care systems and primary care case management systems for Medicaid recipients under the Illinois Public Aid Code. Effective immediately.
