Amends the Criminal Victims' Asset Discovery Act. Changes the short title of the Act to the Criminal Victims' Asset Discovery and Escrow Account Act. Provides that the Act applies to persons convicted of violent crimes (rather than first degree murder, a Class X felony, or aggravated kidnapping). Provides that a person contracting with any person or the representative or assignee of any person convicted of a violent crime in this State, with respect to the reenactment of the violent crime, by way of a movie, book, magazine article, tape recording, phonograph record, radio or television presentation, or live entertainment, or from the expression of the convicted person's thoughts, feelings, opinions, or emotions regarding the crime if the expression represents the primary contents of a movie, book, magazine article, tape recording, phonograph record, radio or television presentation, or live entertainment, shall submit a copy of the contract to the Attorney General and pay over to the Attorney General any moneys that would otherwise, by terms of the contract, be owing to the person convicted or the person's representatives. Provides that the Attorney General shall deposit the moneys in an escrow account for the benefit of and payable to any victim or the legal representative of any victim of violent crimes committed by the convicted person, if the victim, or the legal representative of the victim, within 5 years from the establishment of the escrow account, brings a civil action and recovers a money judgment for damages against the person or the person's representatives. Amends the Violent Crime Victims Assistance Act and the Code of Civil Procedure to make conforming changes.

Creates the Prescription Drug Repository Program Act. Requires the Department of Public Health to establish a prescription drug repository program, under which any person may donate a prescription drug or supplies needed to administer a prescription drug for use by an individual who meets eligibility criteria specified by the Department. Sets forth requirements that prescription drugs or supplies must meet in order to be accepted and dispensed under the program. Provides that no drugs or supplies donated under the prescription drug repository program may be resold. Provides that nothing in the Act requires that a pharmacy or pharmacist participate in the prescription drug repository program. Provides for civil and criminal immunity for drug and supply manufacturers and individuals in relation to the donation, acceptance, or dispensing of prescription drugs or supplies under the prescription drug repository program. Amends the Pharmacy Practice Act, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in donating or accepting, or packaging, repackaging, or labeling, prescription drugs to the extent permitted or required under the Prescription Drug Repository Program Act are exempt from provisions of those other Acts that might prohibit or otherwise regulate such activity.
Amends the Illinois Lake Management Program Act. Requires all oceangoing vessels engaging in port operations in this State to obtain a permit from the Environmental Protection Agency. Provides that the Agency may issue a permit for an oceangoing vessel only if: (1) the applicant can demonstrate that the oceangoing vessel will not discharge aquatic nuisance species; or (2) if the oceangoing vessel discharges ballast water or other waste or waste effluent, that the operator of the vessel will use environmentally sound technology and methods, as determined by the Agency, that can be used to prevent the discharge of aquatic nuisance species. Sets forth procedures for the permitting process and requires the Agency to establish reasonable permit fees. Effective immediately.
Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.
Amends the Community Mental Health Act. Provides that from funds appropriated to the Department of Human Services for that purpose, the Secretary of Human Services shall establish a 2-year pilot program in 3 locations across the State to provide mental health services to veterans who do not qualify for mental health services under a federally funded or State-funded program and who do not have insurance coverage for mental health services. Provides that the Department of Human Services shall implement the program in cooperation with the Department of Veterans' Affairs. Provides that in allocating funds to community providers for veterans' mental health services, the Department of Human Services shall give preference to programs that serve special population groups and targeted geographic areas. Effective immediately.
Creates the Use and Occupation Tax Task Force to gather information and make recommendations to the Governor and to the General Assembly regarding the reformation of the use and occupation tax procedures and policies in Illinois. Requires the task force to submit a report to the Governor and the General Assembly by January 1, 2009 concerning its findings and recommendations.
Amends the Illinois Income Tax Act. For taxable years ending on or after December 31, 2008, allows small businesses that provide health care insurance for their employees to claim a tax credit in an amount equal to $100 for each employee covered, $50 for each spouse covered, and $40 for each dependent (up to 2 dependents) covered. Provides that the taxpayer may not carry the credit forward or back and that the credit may not reduce a taxpayer's liability to less than zero. Exempts the credit from the Act's sunset provisions. Effective immediately.
Amends the Illinois Public Aid Code. Creates the Medicaid Reform Commission to study all aspects of the Illinois medical assistance program, the Children's Health Insurance Program, and the Covering ALL KIDS Health Insurance Program and to make recommendations for a restructuring of those programs to improve the delivery of health care services in a fiscally sustainable manner, addressing issues that include, but need not be limited to, provider reimbursements, payment cycles, case management, and access to care. Provides for 8 voting members appointed by the Speaker and the Minority Leader of the House of Representatives and by the President and the Minority Leader of the Senate. Provides for ex-officio, nonvoting members. Requires the Commission to report its recommendations by July 1, 2009. Effective immediately.
Amends the Charter Schools Law of the School Code. Under specified circumstances, allows for a maximum of 5 additional charter schools exclusively for truants or dropouts in Chicago if the limit on the number of charter schools that may operate at any one time in the rest of the State has not been reached. Provides that if any of the additional charter schools are not used exclusively for truants or dropouts, then the State Board of Education shall withhold and the charter school shall forfeit all State funding designated for that school.
Amends the Illinois Public Aid Code. Requires the Commission on Government Forecasting and Accountability to have an audit of the Medicaid program performed by an independent CPA.
