Amends the Developmental Disability Prevention Act. Provides that the standards for all levels of hospital perinatal care developed by the Department of Public Health shall conform to the most current edition of the American Academy of Pediatrics and the American College of Obstetricians and Gynecologists' Guidelines for Perinatal Care
Amends the Criminal Code of 1961. Provides that a person who has been convicted of a second or subsequent offense for criminal sexual assault in which the penalty is not natural life imprisonment shall be sentenced to a term of imprisonment of not less than 25 years (unless the minimum sentence is greater than 25 years) and not exceeding natural life imprisonment. Amends the Unified Code of Corrections. Provides that the minimum mandatory supervised release term for defendants who commit a second or subsequent offense of criminal sexual assault on or after the effective date of the amendatory Act shall be the natural life of the defendant (rather than from 3 years to natural life).
Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall undertake a pilot project to study patient outcomes, for patients with chronic diseases or patients at risk of low birth weight or premature birth, associated with the use of disease management programs and services for chronic condition management (rather than subject to appropriations, the Department of Healthcare and Family Services may undertake a pilot project to study patient outcomes, for patients with chronic diseases or patients at risk of low birth weight or premature birth, associated with the use of disease management programs and services for chronic condition management). Effective immediately.
Amends the Administration Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall contract (rather than is authorized to contract) with third-party entities to conduct Payment Recapture Audits to detect and recapture payments made in error or as a result of fraud or abuse. Effective immediately.
Amends the Developmental Disability Prevention Act. Provides that the standards related to staffing resources, including, but not limited to, medical and nursing resources, that are implemented through rulemaking after September 1, 2011 shall not exceed current, nationally-recognized, evidence-based practices. Provides that all rulemaking shall recognize and adequately address the needs and resources particular to the locality, institution, workforce availability, outcomes, and other variations impacting patient access to care, as reflected in the hospital's letter of agreement with its Administrative Perinatal Center.
Amends the Pawnbroker Regulation Act. Creates a provision that a pawnbroker shall not deface, scratch, obliterate, melt, separate, or break into parts, or otherwise in any manner do, cause, or suffer to be done by others, anything that shall destroy or tend to destroy the identity or value of any precious metal or precious gem during the holding period. Provides that a pawnbroker who acquires a precious metal object or precious gem shall keep it in the county where the pawnbroker holds a license from the time of the acquisition until at least 30 days after submitting a copy of a record of its acquisition. Extends the holding period for property containing precious metals or precious gems, or both, for 30 days. Creates a provision for definitions.
Amends the State Finance Act. Creates the Mobile Veteran's Unit Fund as a special fund in the State treasury. Provides that moneys in the Fund shall be used by the Department of Veterans' Affairs for the purpose of making grants provided under Section 36 of the Department of Veterans Affairs Act. Amends the Illinois Income Tax Act to create a tax checkoff for the Mobile Veteran's Unit Fund. Effective immediately.
Amends the Mental Health and Developmental Disabilities Code. Provides that if the respondent is unable to obtain an examination, in a proceeding to determine whether he or she is subject to involuntary admission, the respondent may request that the court order an examination to be made by a physician, qualified examiner, clinical psychologist, or other expert. Provides that if the respondent is unable to obtain an examination, in a proceeding for the administration of psychotropic medication or electroconvulsive therapy, the respondent may request that the court order an examination to be made by an impartial psychiatrist. Provides that if the respondent is receiving treatment from the Department of Human Services, the examiner shall not be in the employ of the Department of Human Services. Provides that if the respondent is receiving treatment from a hospital that is not affiliated with the Department of Human Services, the examiner shall not be in the employ of such hospital. Provides that if the respondent is in a hospital, the examiner shall be given direct access to the respondent in order to perform the examination. Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that the Department of Human Services may disclose records or communications of persons receiving care from the Department or under contract with the Department, without consent, to not-for-profit institutions of higher education engaged in research concerning the safety, effectiveness, or cost-effectiveness of mental health treatments. Effective immediately.
