Rep. Fred Crespo

Amends the Illinois State Auditing Act. Provides that if, in conducting a performance audit, which includes a program audit and a management or economy and efficiency audit, the Auditor General determines that an assessment of specified performance factors indicates a significant deficiency in program performance, the Auditor General, with the concurrence of the Joint Committee on Administrative Rules, may impose and collect an administrative fine upon each officer and employee responsible for that deficiency. Further provides that a fine may not exceed $50,000 per individual per program found to be deficient; that the Auditor General shall follow the provisions of Article 10 (Administrative Hearings) of the Illinois Administrative Procedure Act to the extent applicable; and that any fine so imposed is a personal liability of the officer or employee and shall not be reimbursed by the State or any other governmental entity.

Amends the Juvenile Court Act of 1987. Provides that if a minor is found to be a delinquent minor by reason of the commission of a gang-related offense, and the court finds that the minor is a first-time offender and orders that a parent, guardian, or legal custodian retain custody of that minor, the court may order the parent, guardian, or legal custodian to attend antigang violence parenting classes. Provides that the Department of Children and Family Services shall establish curriculum for the antigang violence parenting classes. Provides that the father, mother, spouse, or other person liable for the support of the minor, the estate of that person, and the estate of the minor shall be liable for the cost of classes, unless the court finds that the person or estate does not have the financial ability to pay. Amends the Code of Civil Procedure. Provides that if any lessee or occupant, on one or more occasions, uses or permits the use of leased premises for the commission of any act that would constitute a violation of the Firearm Owners Identification Card Act or the Deadly Weapons Article of the Criminal Code of 1961 or of any municipal or county ordinance relating to the registration, acquisition, carrying, possession, or use of firearms, firearm attachments, or firearm ammunition, and the owner or lessor does not bring or assign the State's Attorney to bring an action for forcible entry and detainer to recover possession of the leased premises, the State's Attorney shall bring such action on behalf of the owner or lessor without the consent of the owner or lessor.

Amends the Railroad Police Act. Provides that whenever a shipment of firearms, explosives, or other weapons is reported as stolen or missing to the railroad police force, the railroad police force shall report all information regarding the incident to local law enforcement, including the municipal police, the County Sheriff, and the Department of State Police.

Provides that Board of Higher Education, the Illinois Community College Board, and the Illinois Student Assistance Commission shall prepare a report by June 1, 2010 with findings on performance-based funding for higher education and submit that report to the General Assembly.

Amends the Public Utilities Act. Provides that notwithstanding the definition of "eligible customer" in a specified provision, each electricity provider shall allow meter aggregation for the purposes of net metering eligible renewable electrical generating facilities owned or operated by school districts, community college districts, or units of local government pursuant to an intergovernmental agreement. Provides that electricity providers shall provide net metering to all parties to the intergovernmental agreement so that all energy produced by the eligible renewable electrical generating facilities is applied as a 1:1 kilowatt hour credit for each party to the intergovernmental agreement. Provides that electricity providers shall carry over any excess kilowatt-hour credits earned and apply those credits to subsequent billing periods to offset any customer-generated consumption until all credits are used or until the end of the annualized period. Provides that the electricity provider shall not discontinue meter aggregation as long as the intergovernmental agreement described in specified provisions is in effect. Effective immediately.

Amends "An Act concerning appropriations", Public Act 95-731. Restores an appropriation to the Department of Labor in connection with Displaced Homemaker Grants that was vetoed by the Governor. Effective immediately.

Mourns the death of David M. Coffee of Streamwood.

Congratulates State Representative Paul Froehlich on his retirement from the Illinois House of Representatives.

Amends several Acts that regulate the medical and healthcare professions. In a provision in those Acts concerning fee-splitting or directly or indirectly giving to or receiving from certain persons or entities any fee, commission, rebate, or other form of compensation for any professional services not actually or personally rendered, provides that the provision does not prohibit contractual or employment arrangements with health care professionals or providers, such as physicians, physician practices, hospitals, long-term care facilities, clinics, or other entities, except as otherwise prohibited by law. Provides that contractual and employment arrangements with health care professionals or providers may include arrangements for compensation, use of space, staff, equipment, health insurance, pension, or other benefits for the provision of services within the scope of the licensee's practice under that specific Act. Amends the Medical Practice Act. Provides that nothing in the Act prohibits physicians, physician practices, or entities authorized by law to employ physicians from also employing other licensed health care workers and other persons. Effective immediately.

Congratulates the Streamwood Historical Society on the occasion of the addition of the Hoosier Grove Schoolhouse Museum to the Country School Association of America's national historic register.
