MOBILE HOME LEASE-REQ

Amends the Mobile Home Landlord and Tenant Rights Act. Provides a refund procedure for a lease or purchase agreement that a prospective tenant cancels within 5 days after signing the lease or purchase agreement. Provides that a landlord is limited to 2 months rent for a tenant's early termination of the lease. Provides that if a tenant leaves the park because of temporary illness or disability, the park owner shall allow relatives designated by the tenant or the tenant's guardian to live in the home. Provides for automatic lease renewal for 2 years unless certain requirements are met, such as a 30-day notice and a notice of reasons for the non-renewal of the lease. Provides that the park owner is to give 12 months notice of closing all or part of the park. Provides for the park owner and tenant or tenant association to use a State certified general real estate appraiser, selected by the parties or the court, to prepare an appraisal to determine the appropriate amount for rent and fees. Provides that the appraisal is subject to court review. Makes other changes.

MOBILE HOME-LEASE-RENT

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that, if a mobile home park has an occupancy rate of less than 85%, (i) the purchaser of an existing mobile home that is located on a lot in that park may not be charged a rental amount for that lot for the first year of the lease that exceeds the rental amount charged to the prior lessee by more than 6% and (ii) rental amounts for the lease of any mobile home or mobile home lot may not be increased by more than 5% annually. Provides that in any mobile home park, increases in rent must be clearly explained in writing; the explanation must indicate (i) how much the rent has increased as a percentage of the base rent, (ii) the increase or decrease in the Consumer Price Index during the previous 12-month period, and (iii) the dollar amount of the increase per month and annually. Exempts mobile home parks in operation for 5 years or less, regardless of ownership, from these rent limitations.

IDENTITY PROTECTION ACT

Creates the Identity Protection Act. Prohibits a State or local government agency from using an individual's social security number in certain ways, subject to various exceptions. Requires each State or local government agency to develop and implement an identity protection policy. Provides that any employee of a State or local government agency who intentionally violates the provisions of the Act is guilty of a Class A misdemeanor. Preempts the concurrent exercise of home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

MOBILE HOME LEASE-REQ

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that, if the park owner enters into an agreement to sell a mobile home to a prospective tenant or lease it to a prospective tenant with an option to purchase, the prospective tenant may cancel the sale or lease-purchase agreement along with the lease by notifying the park owner in writing within 3 business days after the prospective tenant's execution of the lease. Provides that the park owner shall, within 10 days after receiving the written cancellation, refund all consideration paid by the prospective tenant and cancel any debt relating to the purchase or lease of the mobile home. Provides for automatic lease renewal for 2 years unless certain requirements are met, such as a 30-day notice and a notice of reasons for the non-renewal of the lease. Provides that if the tenant does not accept the landlord's new lease terms that the park owner and tenant or tenant association shall use a State-certified general real estate appraiser, selected by the parties or the court, to prepare an appraisal to determine the appropriate amount for rent and fees. Provides that the appraisal is subject to court review. Makes other changes.

INC TAX-CREDITS

Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.

SCH CD-CHARTER SCH LIMIT-CHI

Amends the Charter Schools Law of the School Code. Under specified circumstances, allows for a maximum of 5 additional charter schools exclusively for truants or dropouts in Chicago if the limit on the number of charter schools that may operate at any one time in the rest of the State has not been reached. Provides that if any of the additional charter schools are not used exclusively for truants or dropouts, then the State Board of Education shall withhold and the charter school shall forfeit all State funding designated for that school.

HABILITATIVE SERVICES

Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act to provide coverage for habilitative services, including, but not limited to occupational therapy, physical therapy, and speech therapy for children under the age of 19 with congenital or genetic defects existing at or from birth or with a defect acquired at a young age. Amends the State Mandates Act to require implementation without reimbursement.

ELEC CD-SPENDING LIMITS

Amends the Election Code. With respect to holders of and candidates for State executive branch constitutional offices and General Assembly seats, limits campaign expenditures to an amount equal to the annual compensation of the office sought multiplied by the number of years in the term sought. Provides that the limit applies separately during a primary campaign and an election campaign.
