Amends the Illinois Vehicle Code to provide that the provisions related to driving while under the influence (DUI) apply to driving any motor vehicle while under the influence. Provides that the suspension and revocation of a person's motor vehicle driving privileges and the person's opportunity for a hearing for a violation of the DUI provisions of the Illinois Vehicle Code also apply to operation of a snowmobile or watercraft while under the influence. Amends the Snowmobile Registration and Safety Act and the Boat Registration and Safety Act. Changes the penalties for operation of a snowmobile or watercraft while under the influence so they are similar to the penalties in the Illinois Vehicle Code for DUI. Provides for additional administrative sanctions for operation of a snowmobile or watercraft while under the influence that are similar to certain administrative sanctions for a DUI violation in the Illinois Vehicle Code. Amends implied consent provisions of the Snowmobile Registration and Safety Act and the Boat Registration and Safety Act to provide that a law enforcement officer must give notice to the Secretary of State when a person refuses to submit to a chemical test and must give additional warnings to the person regarding possible driver's license suspension, and requires the court clerk to send notice to the Secretary of State if the person fails to request a hearing or if the court finds against the person. Makes other changes. Effective immediately.
Amends the Illinois Pension Code. Provides that a retirement system or pension fund may not invest in any funds that trade derivatives in off markets or non-open markets, and if a retirement system or pension fund is investing in such a fund on the effective date, then the retirement system or pension fund must divest the retirement system's interest in the fund within one year after the effective date. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Creates the Calling Card Consumer Protection Act. Sets forth the findings of the General Assembly. Contains required disclosures for prepaid telephone calling cards and services. Specifies what qualifies as unlawful conduct related to prepaid telephone calling cards and that a violation of specified provisions is an unlawful practice within the meaning of the Consumer Fraud and Deceptive Business Practices Act. Effective immediately.
Appropriates $100,000, or so much of that amount as may be necessary, from the General Revenue Fund to the Department of Veterans' Affairs for grants to charitable and veterans' organizations for the purpose of providing honor guards and buglers at military funerals in Illinois. Effective July 1, 2010.
Amends the Senior Pharmaceutical Assistance Act. Makes a technical change in a Section concerning the short title.
Amends the Veterans' Health Insurance Program Act of 2008. Makes a technical change in a Section concerning the short title.
Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, the Savings Bank Act, and the Illinois Credit Union Act. Provides that a bank, savings and loan association, savings bank, or credit union organized under the laws of this State must not make commercial loans with an effective annual percentage rate of more than 9% available to a borrower. Effective immediately.
Amends the Liquor Control Act of 1934. Provides that the Illinois Liquor Control Commission shall have the duty and power of suspending or revoking all licenses of a licensee under the Act for the licensee's conviction for a gambling offense under the Criminal Code of 1961. Provides that the State Liquor Control Commission may not delegate this responsibility to any local liquor commission. Provides that the State Liquor Control Commission shall suspend for 30 days all liquor licenses of a licensee upon the licensee's first conviction for a gambling offense, shall revoke or suspend for at least 30 days those licenses upon a second conviction within a 12 month period, and shall revoke those licenses upon a third or subsequent conviction within a 5 year period. In a Section prohibiting the issuance of licenses to certain persons, provides that a corporation convicted of a gambling offense shall not be issued a license under the Act (now, a corporation is exempt from the prohibition if it meets certain conditions). Amends the Criminal Code of 1961. Provides that the State's Attorney must notify the State Liquor Control Commission of a liquor licensee's conviction for a gambling offense. In a Section concerning the separate criminal offense of keeping a gambling place, provides that all licenses issued under the Liquor Control Act of 1934 authorizing the serving of liquor on the premises that were used as the gambling place shall be suspended for a period of 60 days; and those licenses shall be revoked upon a second conviction of keeping a gambling place. Makes other changes. Effective immediately.
