MOSQUITO ABATEMNT DIST-TRNSFER

Amends the Mosquito Abatement District Act. Provides that, notwithstanding any other provision of law, (i) mosquito abatement districts in counties with a population of 3,000,000 or more are abolished on January 1, 2004, (ii) no new mosquito abatement districts may be organized on or after January 1, 2004 in those counties, and (iii) the assets, liabilities, rights, powers, duties, and functions of an abolished district are assumed by the county in which the district lies or the City of Chicago if the district lies in the City of Chicago. Provides that the duties and functions of the abolished districts, including the eradication of the West Nile Virus, shall be assumed by the State certified public health departments of the assuming county or the City of Chicago, as appropriate. Amends the Township Code to make similar provisions for mosquito abatement districts created under the Code in counties with a population of 3,000,000 or more. Effective immediately.

PROP TAX-RETIRED FIREFIGHTER

Amends the Property Tax Code. Creates the retired firefighters and police officers tax freeze homestead exemption. Provides that, beginning with taxable year 2004, a person receiving a retirement pension or retirement annuity under the Illinois Pension Code as a retired firefighter or police officer and who resides in the jurisdiction where he or she was a firefighter or police officer shall receive an exemption from property taxes in an amount equal to the difference between what the property tax bill for the residence would be in the taxable year minus the base amount. "Base amount" is defined as the property tax bill for the first year of eligibility for this exemption, plus any increase in the bill resulting from any added improvements thereafter. Amends the State Mandates Act to require implementation without reimbursement from the State.

PROF ENGINEERS-EXEMPTIONS

Amends the Professional Engineering Practice Act of 1989. Provides that nothing in the Act shall be construed to prohibit any individual from exercising their rights pursuant to the National Labor Relations Act and the Labor Management Relations Act. Provides that nothing in the Act shall be construed to prohibit any professional engineer or any professional engineering company from lawfully obtaining work, even if such work had previously been let to or performed by a competitor professional engineering company. Makes changes in provisions related to grounds for disciplinary action. Effective immediately.

VEH CD-TRUCKS USING CAR PLATES

Amends the Illinois Vehicle Code. In the Article on registration and license fees, provides that vehicles of the second division weighing 8,000 pounds or less and not used for commercial purposes may display registration plates issued to first division vehicles. Effective immediately.

POLICE TRAINING-LICENSING

Amends the Illinois Police Training Act. Requires full-time and part-time police officers to be licensed rather than certified. Makes related changes. Provides that the Board has the power to require local governmental units to furnish personnel rosters, employment status reports, and annual training plans to the Board. Effective immediately.

HUMANE CARE FOR ANIMALS-COURT

Amends the Humane Care for Animals Act. Provides that the State's Attorney shall, at anytime prior to trial, file a "petition for forfeiture prior to trial" asking for permanent forfeiture of a seized companion animal (now within 14 days after seizure). Eliminates a provision that states that a court may waive the posting of security in cases regarding companion animals and animals used for fighting purposes for good cause shown. Effective January 1, 2005.

SEX OFFENDER INFO

Amends the Sex Offender and Child Murderer Community Notification Law. Provides that a manager of a condominium or of an apartment building shall post in a conspicuous place in the common areas of the condominium or apartment building a notice as to how a unit owner or renter can obtain information about persons who are registered as sex offenders under the Sex Offender Registration Act, including how to access information maintained in the Statewide Sex Offender Database that is posted on the Department of State Police Web site. Effective immediately.

VEHICLE-REPEAT VIOLATION

Amends the Illinois Vehicle Code. Provides that applicants pay all application and fingerprinting fees. Provides that all fees paid for fingerprint processing services shall be deposited into the State Police Services Fund and all other fees deposited into the Road Fund. Provides that an applicant for a school bus driver permit must not have been convicted of reckless driving, DUI, or reckless homicide resulting from the operation of a motor vehicle rather than having been convicted of these offenses within 3 years of the date of application. Provides that a third or subsequent offense constitutes a Class 4 non-probationable felony. Provides that a person shall be guilty of aggravated driving under the influence of alcohol, other drug or drugs, or intoxicating compound or compounds, or any combination thereof if the person committed a violation of Section 11-501 of the Code for the second time within 5 years (rather than a third or subsequent time).
