Amends the Cannabis Control Act and the Illinois Controlled Substances Act. Provides that whenever a peace officer has probable cause to arrest a person for a suspected misdemeanor violation of either of these Acts, the peace officer in lieu of making an arrest may issue a citation to the person. Provides that the person shall post bail or other security, as determined by the Illinois Supreme Court, which shall include the posting of bail by either cash payment, a bond card, or a charge to the defendant's debit or credit card. Provides that if a citation is issued, a court appearance is not required if the person intends to plead guilty to the charge. Provides that if the defendant does not appear on the date set for appearance, or any date to which the case may be continued, the court may enter an ex parte judgment against the defendant assessing fines, penalties, and costs in an amount equal to the cash bail required by the Illinois Supreme Court and the clerk of the circuit court shall apply the cash bail or security in payment of the fines, penalties, and costs.

Amends the School Code. Provides that a transition specialist certificate shall be issued to persons who, through their education and training, have a comprehensive understanding of the requirements for transition planning and of transition services for students with all types of disabilities and are aware of the array of options available to students with disabilities after they exit high school. Provides that before the 2008-2009 academic year, the Board of Higher Education shall, in collaboration with the Interagency Coordinating Council and the Advisory Council on the Education of Children with Disabilities, develop coursework for students who want to qualify for a transition specialist certificate. Provides that those public universities that are teacher training institutions shall implement the coursework developed by the Board beginning with the 2008-2009 academic year. Effective immediately.
Appropriates $10,000,000 to the Illinois Department of Human Services, Division of Alcoholism and Substance Abuse, to fund services for 2260 substance abusing offenders. Effective July 1, 2007.
Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code to provide coverage for autism spectrum disorders to the extent that the diagnosis and treatment of autism spectrum disorders are not already covered by the policy or plan. Provides that this coverage shall be subject to a maximum benefit of $36,000 per year, but shall not be subject to any limits on the number of visits to an autism service provider. Makes other changes. Effective immediately.
Creates the HIV Testing and Expansion Act. Contains only the short title provision.
Amends the Public Health Program Beneficiary Employer Disclosure Law. Makes a technical change in a Section concerning the short title.
Amends the State Budget Law and the State Finance Act. Provides that, beginning with fiscal year 2009, the General Assembly must make appropriations in each fiscal year sufficient to fund legislative member initiatives. Each member is entitled to designate initiatives totaling up to 1/177th of 1% of the total appropriations for the fiscal year. Designations must be made in writing and filed on or before May 1 immediately before the beginning of the fiscal year with the Speaker by Representatives and with the President by Senators. Requires the Governor to include an amount sufficient for these purposes in the budget submitted by the Governor. Makes a continuing appropriation if the General Assembly fails to make sufficient appropriations. Defines a "legislative member initiative". Effective immediately.
Amends the State Commemorative Dates Act, the School Code, and the Promissory Note and Bank Holiday Act. Makes the date of the general election a legal and school holiday known as General Election Day. Rephrases the current authorization for banks to close on the date of the general election. Prohibits requiring officers and employees of the State, units of local government, and school districts to work on General Election Day except as necessary for the conduct of the election, for law enforcement, for fire protection, and for public health and safety. Requires courts to designate General Election Day as a court holiday. Preempts home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Amends the Election Code, the Civil Administrative Code of Illinois, the Office of Banks and Real Estate Act, the Counties Code, and the Universities Civil Service Act to make conforming changes.
Amends the Criminal Identification Act. Permits the court to order the sealing of the criminal records of adults and of minors prosecuted as adults which cannot be sealed pursuant to other provisions of law when the offender has obtained a certificate of good conduct from the Prisoner Review Board and has demonstrated rehabilitation. Permits the sealing of the records of persons who have been convicted of Class 2, 3, or 4 felony violations relating to the manufacture or delivery of cannabis, a controlled substance, or a look-alike substance, or the delivery of methamphetamine. Amends the Unified Code of Corrections. Provides that in determining whether an applicant for a certificate of good conduct has been rehabilitated, the Board shall apply the same criteria used to determine whether a recommendation for executive clemency should be issued, and shall grant the certificate only if the applicant meets those standards. Effective June 1, 2007.
Amends the Juvenile Court Act of 1987. Provides that the court, on its own motion or upon the petition of a law enforcement official, shall immediately and automatically enter an order expunging any and all law enforcement records relating to an incident occurring before an individual's 17th birthday, and all of the individual's juvenile court records, or both, pertaining to the incident, including immediate notification to any and all contracted private electronic database corporations, but only in the following circumstances: (1) the minor was arrested and no petition for delinquency was filed with the clerk of the circuit court; or (2) the minor was charged with an offense and was found not delinquent of that offense. Provides that if a minor is charged with an offense and is found not delinquent of that offense the judge shall include an order of expungement in the final dismissal order, including immediate notification to applicable law enforcement or arresting agencies, and any and all contracted private electronic database corporations. Provides that an expungement order form shall be provided to the minor, in open court, for immediate completion and entry of order by the court.
