IDOT-DISADVANTAGED COMPANY AID

Amends the Department of Transportation Law of the Civil Administrative Code of Illinois and the State Finance Act. Grants the Illinois Department of Transportation the power to enter into agreements to make direct grants and low-interest loans to minority-owned businesses, female-owned businesses, and disadvantaged business enterprises certified by the Department for participation on Department-procured construction and construction-related contracts. Provides that grant and loan funds shall be expended, subject to appropriation, from the Working Capital Loan Repayment Fund. Specifies permissible uses of funds and provides that funds may be loaned with or without interest. Provides that the Department shall establish the requirements for eligibility and criteria for grant and loan applications, approved use of funds, amount of loans or grants, interest rates, collateral, and terms. Creates the Working Capital Loan Repayment Fund and provides that the State Comptroller shall order and the State Treasurer shall transfer $10,000,000 from the Road Fund to the Working Capital Loan Repayment Fund.

ECON DEVELOPMENT COMPACT

Creates the Tri-State Metro Area Economic Development Interstate Compact Act. Provides that member states agree not to offer tax breaks to a company located in another member state as an inducement to change the company's location to the offering member state.

HOME LOAN PREPAYMENT PENALTIES

Amends the Residential Mortgage License Act of 1987, the High Risk Home Loan Act, and the Interest Act. Limits the imposition of prepayment penalties in connection with high risk home loans. Limits the size of balloon payments in connection with high risk home loans. Limits the imposition of late fees. Effective January 1, 2013.

AGG INTIMIDATION-REPORT FELONY

Amends the Criminal Code of 1961. Provides that in addition to other elements of the offense a person commits aggravated intimidation when he or she commits the offense of intimidation and the person knew that the victim was a civilian reporting information regarding a forcible felony to a law enforcement agency and the offense was committed because the person reported information regarding a forcible felony to a law enforcement agency.

CRIM CD-FIRST DEGREE MURDER

Amends the Criminal Code of 1961. Provides that no later than 90 days prior to trial of a defendant charged with first degree murder, the court shall hold a hearing to determine whether there is probable cause to believe that one or more aggravating factors relevant to the imposition of the death penalty exist. Provides that if the court does not find that there is probable cause to believe that one or more aggravating factors exist, the court shall decertify the case as a death penalty case and shall prohibit the State from proceeding to an eligibility hearing in the sentencing phase. Provides that if the court decertifies the case as a death penalty case, the court shall issue a written finding. Provides that the State may pursue its right to appeal decertification pursuant to Supreme Court Rule. Provides that if the court does not decertify the case as a death penalty case, the matter may proceed to the eligibility phase of the sentencing hearing after the defendant has been found guilty. Effective immediately.

DHFS-ICF/DD-RATE DETERMINATION

Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to make a new rate determination for all facilities licensed by the Department of Public Health under the ID/DD Community Care Act as Intermediate Care for the Developmentally Disabled facilities or Long Term Care for Under Age 22 facilities. Provides that the amount of the payment rate shall be prospectively established annually on the basis of historical, financial, and statistical data reflecting actual costs from prior years beginning with the most recent cost reports on file with the Department of Healthcare and Family Services for fiscal year 2011, which shall be applied to the current rate year and updated for inflation, except that the capital cost element for newly constructed facilities shall be based upon projected budgets. The annually established payment rate shall take effect on July 1 in 2012 and subsequent years. Effective immediately.

CRIM CD&CORR-ATM TRANSFER

Amends the Criminal Code of 1961. Provides that it is unlawful to use force or to threaten the use of force against another person to effect or to attempt to effect a transaction at an electronic fund transfer terminal located in this State. Provides that a violation is a Class X felony. Amends the Unified Code of Corrections. Provides that a violation committed during the course of the commission of first degree murder is an aggravating factor in sentencing.

CIV PRO-FORECLOSE-FRAUD-FELONY

Amends the Code of Civil Procedure. Provides that a person commits false representation concerning title to real estate, a Class 4 felony, when he or she knowingly, as part of any transaction or legal proceeding under the Mortgage Foreclosure Article of the Code, claims an interest in real estate or executes, notarizes, or records a fraudulent real estate document and that a person commits a pattern of making false representations concerning title to real estate, a Class 3 felony, by committing false representation concerning title to real estate in 2 or more instances with a similar pattern or purpose which are not isolated incidents within the preceding 4 years and in which the aggregate loss or intended loss is more than $250. Provides that the Attorney General has a private right of action for civil penalties arising from such conduct. Provides that a private cause of action for the owner or holder of the beneficial interest in real estate which is the subject of a false representation concerning title may bring a civil action in the circuit court in the county in which the real estate is located to recover damages suffered by the owner or holder of the beneficial interest plus reasonable attorney's fees.

SCH CD-BULLYING PREVENTION

Amends the School Code. In a Section concerning the School Bullying Prevention Task Force, requires the State Board of Education to convene the Task Force to continue to monitor bullying in schools and to consider any additional recommendations subsequent to the submission of its report to the Governor and the General Assembly, which recommendations must be submitted in a report to the Governor and the General Assembly on or before December 30, 2013. Repeals the Section on December 31, 2013 (instead of March 2, 2011). Effective immediately.
