PEN CD-ALT FORMULA-DEPT OF JJ

Amends the State Employee Article of the Illinois Pension Code. Adds certain employees of the Department of Juvenile Justice whose position is equivalent to a parole officer to the alternative formula. Removes restrictions on the application of the alternative formula provisions to certain employees of the Department of Juvenile Justice. Effective immediately.

PEN CD-ART 17-BOARD MEMBERSHIP

Amends the Chicago Teacher Article of the Illinois Pension Code. Adds a pensioner member to the Board of Trustees and makes corresponding changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

VEH CD-RENTAL VEH-INSURANCE

Amends the Illinois Vehicle Code. Provides that beginning January 1, 2011, and annually each January 1 thereafter, the maximum amount that may be recovered by a person who rents a motor vehicle to another due to the theft of the rental motor vehicle shall be increased by $500 above the maximum recovery allowed immediately prior to January 1 of that year. Effective January 1, 2011.

SHORT TERM BORROWING

Amends the Short Term Borrowing Act. Authorizes the Governor, Comptroller, and Treasurer to borrow principal amounts not to exceed a total of $1,500,000,000, at any time and from time to time outstanding, to be applied to the purposes of paying hospital access improvement payments under the Public Aid Code and in order to obtain all funds available to the State under federal economic stimulus and recovery programs, together with paying debts and associated expenses incurred in connection with the borrowing. Provides that all moneys so borrowed shall be borrowed for a period not to exceed one year. Effective immediately.

CIV PRO-FORECLOSURE PREVENTION

Amends the Code of Civil Procedure by adding an Article that may be cited as the Mortgage Foreclosure Prevention Law of 2009. Provides that an eligible borrower has a right to defer a judicial sale for a specified period by providing an affidavit to the foreclosing lender. When the deferment period ends or the deferment is lost, a lender may schedule a sale by publishing a specified newspaper notice and serving a copy on those on the premises, 4 weeks before the sale. Provides a formula to set the borrower's monthly payment. Provides that a borrower loses the right to deferment if he or she ceases to reside on the premises. Provides for mortgage foreclosure counselors. Provides that a foreclosing lender and a borrower must negotiate in good faith. Provides that a borrower may dispute a deferment cancellation through arbitration. Provides that lenders shall send to borrowers a mandated notice about deferment. Provides that a lender who acts in bad faith or recklessly in violation of these provisions is liable to a person injured for actual damages, statutory damages up to $25,000, punitive damages, costs, and attorney's fees. Makes other changes. Effective 7 days after becoming law.
