EMS-ACUTE STROKE PATIENTS

Amends the Emergency Medical Services (EMS) Systems Act. Provides that the Director of the Illinois Department of Public Health shall develop a working group to advise the Department on Primary Stroke Center Systems; that this work group shall have representation from the following groups: EMS Medical Directors; hospital administrators; neurologists from accredited Primary Stroke Centers; EMS Coordinators; stroke advocates; fire chiefs in Illinois; private ambulance providers; and a representative from the State Emergency Medical Services Advisory Council; and that this group shall also develop and submit a statewide stroke assessment tool to the Department for final approval, a copy of which shall be disseminated to all EMS Systems for adoption no later than January 15, 2011. Effective immediately.

CIRCUIT BREAKER-REVENUE-AGING

Amends the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. In connection with the pharmaceutical assistance program under the Act, provides that to become a beneficiary under the program, a person must have a maximum household income equal to or less than 239% of the Federal Poverty Level (instead of less than specified amounts or equal to or less than 200% of the Federal Poverty Level. Provides for 4 (instead of 5) Eligibility Groups (eliminates current Eligibility Group 3). For persons in the Eligibility Group consisting of persons who have a diagnosis of HIV or AIDS, provides for an alternative co-payment according to whether or not a drug is covered by the Medicare Part D Prescription Drug Plan in which the beneficiary is enrolled (in addition to whether or not the drug is included in the formulary of the Illinois AIDS Drug Assistance Program operated by the Illinois Department of Public Health). Makes changes in the definitions of "covered prescription drug" for each Eligibility Group. Makes other changes. Effective immediately.

REQUESTS-YOUTH CONNECT SCHOOLS

Requests that the Chicago Public Schools allocate 2,100 seats to Youth Connection Charter School over a seven-year period to address the immediate and urgent need to help as many young adults as possible achieve an education.

UTIL-ASSISTANCE-PAYMENT PLANS

Amends the Public Utilities Act. Contains provisions concerning financial assistance and payment plans that are approved by the Commission for low-income customers. Specifies the requirements for the financial assistance and payment plans. Provides that an electric utility shall be permitted to recover all of its uncollectibles through an automatic adjustment clause tariff. Effective immediately.

HFS-MEDICAID-NURSING HOMES

Amends the Illinois Public Aid Code. Provides that under the medical assistance program, beginning January 1, 2009, the Department of Healthcare and Family Services may reimburse a skilled nursing facility, intermediate care facility, or institution for mental diseases providing long-term care services, based upon patient days reported in the facility's most recent cost report, for spending incurred to provide health care benefits to its employees serving the vulnerable populations residing in the facility, in order to attract and retain a qualified and healthy workforce. Provides that subject to available appropriations, the reimbursement shall be made according to certain criteria. Provides that the reimbursement is subject to audit by the Department and shall be reduced or eliminated in the case of any facility that does not honor its commitment to increase spending to improve the health of its employees or that decreases such spending. Effective July 1, 2009.

CIV PRO-FORECLOSURE ASSIGNMNT

Amends the Code of Civil Procedure. Provides that "mortgagee" means (i) the holder of an indebtedness or obligee of a non-monetary obligation secured by a mortgage (instead of holder of an indebtedness or obligee of a non-monetary obligation secured by a mortgage or any person designated or authorized to act on behalf of such holder) and (ii) any person claiming through a mortgagee as successor. Provides that a foreclosure complaint shall include a statement of the capacity in which the plaintiff brings the foreclosure such as legal holder of the indebtedness or the trustee under a trust deed (instead of as legal holder of the indebtedness, pledgee, agent, trustee under a trust deed or otherwise), along with copies of documents upon which the plaintiff relies and which show the plaintiff to be the mortgagee, as defined in the Act. Provides that a foreclosure judgment shall include: allegations of fact in the complaint that are not denied by the verified answer or counterclaim (instead of not denied by the verified answer or counterclaim or where the defendant states in an affidavit that he or she has no knowledge sufficient to form a belief) are sufficient evidence thereof; the last date for redemption; court rulings as to each request for relief; tangible evidence of who holds the indebtedness, the indebtedness, and the mortgage foreclosed (instead of the indebtedness and the mortgage foreclosed) shall be exhibited to and filed with the court; and if the plaintiff is not the original mortgagee, specific findings of fact concerning the plaintiff's capacity to bring the foreclosure action as legal holder of the indebtedness or the trustee of a trust deed and a determination of whether this capacity legally entitles the plaintiff to bring the action (instead of a foreclosure judgment shall include the last date for redemption and court rulings as to each request for relief). Effective immediately.

CIV PRO-FORECLOSE-FORCBLE ENTR

Amends the Code of Civil Procedure. Provides that no mortgagee, assignee of a mortgagee, mortgagee-in-possession, (instead of mortgagee-in-possession) receiver or holder of a certificate of sale or deed, or purchaser who fails to file a supplemental petition under provisions of the Illinois Mortgage Foreclosure Law concerning possession during the pendency of a mortgage foreclosure shall file a forcible entry and detainer action against an occupant of the mortgaged real estate until 90 days after a notice of intent to file such action has been properly served upon the occupant.

$DHS-JACKSN PRK HOSP-CAP NEEDS

Appropriates $7,400,000 from the General Revenue Fund to the Department of Human Services for capital needs at Jackson Park Hospital. Effective July 1, 2009.

TOBACCO-NO SALES AT HEALTH

Creates the Tobacco Sales At Health Care Institutions Prohibition Act. Provides that a health care institution shall not sell or cause to be sold tobacco products. Provides that a retail establishment that operates or has a health care institution within it, such as a pharmacy or drug store, shall not sell or cause to be sold tobacco products. Provides that a person who violates the Act is guilty of a petty offense and shall be fined $200 for a first offense, $700 for a second offense occurring within 24 months of the first offense, and $1,000 for 3 or more violations occurring within 24 months of the second or subsequent violation. Provides that each calendar day an entity operates in violation of any provision of the Act shall be deemed a separate violation. Provides that nothing in the Act shall be interpreted as prohibiting the Illinois Department of Public Health or other agency from suspending or revoking any license or permit issued by and within the jurisdiction of such department or agency for repeated violations of the Act. Provides that any fines or fees collected under the Act shall be used for the enforcement of the Act and for educational programs on the harmful effects of tobacco. Amends the State Finance Act. Creates the Tobacco Products Education Fund in the State treasury. Amends the Clerks of Courts Act to make conforming changes. Effective January 1, 2011.
