Amends the Public Health Program Beneficiary Employer Disclosure Law. Makes a technical change in a Section concerning the short title.

Amends the Election Code. Requires that the proposition of retention of commissioners of the Illinois Commerce Commission be included on general election ballots. Requires abstracts to be made of votes and a canvassing of votes in an election for retention as commissioner of the Illinois Commerce Commission. Requires the State Board of Elections to transmit to the Illinois Commerce Commission and the Governor the names of commissioners of the Illinois Commerce Commission who fail to win retention in office. Sets forth the form that the proposition relating to the retention of a commissioner for the Illinois Commerce Commission must take on the ballot. Amends the Public Utilities Act. Requires the Secretary of State, prior to the next general election after a commissioner of the Illinois Commerce Commission is appointed, to certify the name of that commissioner to proper election officials to be submitted to the electors on the sole question of whether the commissioner should be retained as a member of the Illinois Commerce Commission for the remainder of his or her current term. Effective immediately.
Amends the Illinois Insurance Code. Exempts any action against an insurance company where the company has committed fraud from certain limitations concerning damages that may be awarded.
Creates the Certified Professional Midwife Licensure Act. Provides for the regulation of persons providing midwifery services through licensure by the Department of Financial and Professional Regulation. Amends the Regulatory Sunset Act to repeal the new Act on January 1, 2019. Amends the Medical Practice Act of 1987 and the Nurse Practice Act to provide that those Acts do not prohibit the practice of midwifery by persons licensed under the Certified Professional Midwife Licensure Act. Effective immediately.
Amends the School Code. Provides that a school board shall require students who participate in an interscholastic athletic program to undergo an electrocardiogram (EKG) test. Provides that the State Board of Education shall determine how often a student must undergo EKG testing.
Amends the Illinois Income Tax Act. Increases the amount of the earned income tax credit from 5% of the federal credit to: (i) 7.5% of the federal tax credit for taxable years ending in calendar year 2007; and (ii) 10% of the federal tax credit for taxable years ending in calendar year 2008 or thereafter. Effective immediately.
Amends the School Code. Allows the Chicago Board of Education to develop a plan for implementing a program that seeks to establish common bonds between youth of various backgrounds and ethnicities, which may be similar to that of the Challenge Day organization.
Amends the Medical Practice Act of 1987. Provides for the public release of individual profiles on persons licensed under the Act, including information relating to criminal charges, administrative disciplinary actions, and hospital privilege revocations. Provides that a physician may elect to include certain information in his or her profile. Provides that certain information collected for physician profiles is not confidential. Provides that, when collecting information or compiling reports intended to compare physicians, the Disciplinary Board shall require that only the most basic identifying information from mandatory reports may be used, and details about a patient or personal details about a physician that are not already a matter of public record through another source must not be released. Effective immediately.
Creates the Safe Cosmetics Act. Provides that beginning January 1, 2008, the manufacturer of any cosmetic product subject to regulation by the federal Food and Drug Administration that is sold in this State shall provide the Department of Public Health with a complete and accurate list of its cosmetic products that, as of the date of submission, are sold in the State and that contain any ingredient that is a chemical identified as causing cancer or reproductive toxicity. Provides that the Department may conduct investigations of cosmetic products that contain chemicals identified as causing cancer or reproductive toxicity or other ingredients of concern in order to determine potential health effects of exposure to such ingredients and may refer its findings to the Attorney General and the federal Food and Drug Administration for possible enforcement action pursuant to the Act and the federal Food, Drug, and Cosmetic Act. Amends the Freedom of Information Act to exempt certain information submitted to the Department pursuant to the Safe Cosmetics Act concerning cosmetic ingredients considered to be a trade secret. Effective immediately.
Amends the Chicago School District Article of the School Code. Requires the Chicago Board of Education, in each school building in the school district, to post the date of the last fire alarm inspection at the building and the capacity of the building. Amends the State Mandates Act to require implementation without reimbursement.
