Amends the State Employees Group Insurance Act of 1971 and the State Pension Funds Continuing Appropriation Act. Beginning July 1, 2010, requires the Department of Central Management Services to administer a program of health benefits coverage for retirees, and their dependents, of certain community college districts previously not participating in the Community College Health Insurance Security Fund. Beginning January 1, 2010, provides for the collection and use of contributions. Beginning July 1, 2009, establishes a committee to advise the State on the program and necessary adjustments in funding sources. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Open Meetings Act, the Freedom of Information Act, and the Attorney General Act. Requires each public body to have a freedom of information officer to process requests for inspection and copying of public records. Establishes within the Attorney General's Office an Office of the Public Access Counselor, and requires the Attorney General to appoint the Counselor. Authorizes the Counselor to issue binding opinions on a public body's compliance with the Open Meetings Act or on a public body's denial of access to public records, when requested by the denied party. Provides for administrative review of Public Access Counselor's opinions.
Amends the Rules of the House of Representatives of the 96th General Assembly to add a rule concerning amendments to the Taxpayer Accountability and Budget Stabilization Act and the State Pension Funds Continuing Appropriation Act.
Creates the Reproductive Health and Access Act. Provides that the State or any municipality, political subdivision, or other governmental unit or agency shall not: (1) deny or interfere with an individual's right to use or refuse contraception; (2) deny or interfere with a pregnant woman's right to bear a child; (3) deny or interfere with a pregnant woman's right to terminate a pregnancy: (i) prior to the viability of the fetus or (ii) when the termination of pregnancy is necessary to protect the life or health of the pregnant woman; or (4) require any woman to terminate pregnancy without her consent. Provides that party aggrieved by conduct that violates the Act may bring a civil lawsuit in a State circuit court or as a supplemental claim in a federal district court against the offending unit of government. Provides that the State shall ensure that individuals eligible for State medicaid assistance, or other State medical assistance, receive financial assistance for reproductive healthcare at least to the same extent as other comparable services. Provides that pregnancy terminations shall be performed in accordance with accepted standards of medical practice, by the method that, in the clinical judgment of the attending medical professional, will best serve the interests of the pregnant patient. Provides that all Illinois public schools shall offer medically accurate, age appropriate, comprehensive sexual health education as a part of the Comprehensive Health Education Program established in the Critical Health Problems and Comprehensive Health Education Act. Amends the Critical Health Problems and Comprehensive Health Education Act to provide that the Comprehensive Health Education Program shall comply with the Reproductive Health and Access Act. Provides that the provisions of the Act are severable. Contains other provisions. Effective immediately.
Amends the Property Tax Code. Makes a technical change in a Section concerning the adjournment of the boards of review.
Amends the State Officials and Employees Ethics Act. Expands the jurisdiction of the Legislative Ethics Commission to include matters arising under the Illinois Governmental Ethics Act and violations of other related laws and rules. Requires the Legislative Inspector General's summary investigation reports to be delivered to the Legislative Ethics Commission. With respect to the confidentiality of the Legislative Inspector General's reports, (i) removes the condition of necessity for the disclosure of reports to law enforcement authorities, ultimate jurisdictional authorities, and the Legislative Ethics Commission and (ii) authorizes the Legislative Ethics Commission to disclose or publish summary investigation reports, based on criteria established by the Commission by rule. Makes other changes. Effective immediately.
Amends the State Employees Group Insurance Act of 1971, Counties Code, Illinois Municipal Code, School Code, Illinois Insurance Code, Health Maintenance Organization Act, Limited Health Service Organization Act, and Voluntary Health Services Plans Act to provide that if an insured is owed any amount of money by an insurer, then the insurer shall provide the insured with the option of having the amount owed paid to the insured or applied to the insured's future premiums. Contains a nonacceleration clause.
Amends the Tobacco Products Tax Act of 1995. Increases the rate of the tax from 18% to 40% beginning on September 1, 2009. Provides that, beginning on October 15, 2009, 45% of the moneys received by the Department under the Act shall be paid into the Long-Term Care Provider Fund and 55% of the moneys received by the Department under the Act shall be paid into the Healthcare Provider Relief Fund (now, all of the moneys are paid into the Long-Term Care Provider Fund). Amends the State Finance Act to create the Healthcare Provider Relief Fund. Provides that moneys in the Fund may be used by the Department of Healthcare and Family Services only for the purpose of making reimbursements to providers of goods or services under certain medical assistance programs. Effective immediately.
Amends the Office of Banks and Real Estate Act. Changes the title of the Act (and makes conforming changes in other Acts). Changes the powers of the Secretary of Financial and Professional Regulation with respect to jurisdiction over entities subject to the Act. Amends the Illinois Banking Act. Provides that the Secretary may (1) waive specified reciprocity requirements with respect to the establishment of branches and (2) prescribe the definition of "liabilities outstanding". Changes provisions concerning the powers and duties of the Secretary with respect to deposits, penalties, and the borrowing of funds under specified situations. Adds provisions concerning audits of banks subject to the Act. Changes provisions concerning capital impairment. Amends the Illinois Bank Holding Company Act of 1957. Changes provisions concerning the powers of the Secretary. Amends the Illinois Savings and Loan Act of 1985 and Savings Bank Act. Changes provisions concerning (1) the bonds of officers and employees, (2) personnel, records, files, actions, and duties, (3) the examination of associations, (4) reimbursement and powers of members of the Board of Savings Institutions. Adds provisions concerning the appointment of a receiver following taking of custody. Amends the Pawnbroker Regulation Act to make changes concerning (1) administration of the Act, (2) licensure, and (3) insurance requirements. Amends the Banking Emergencies Act, Corporate Fiduciary Act, and Foreign Banking Office Act to make changes concerning the powers of the Secretary. Repeals provisions in the Illinois Savings and Loan Act of 1985 and the Savings Bank Act. Repeals the Financial Institution Activity Reporting Act. Makes other changes. Effective immediately.
