Rep. Michael J. Zalewski

Amends the Counties Code and the Illinois Municipal Code. Provides that the county board of any county may license and regulate landlords, as defined by the county board, within the unincorporated areas of that county. Provides that the corporate authorities of any municipality may license and regulate landlords, as defined by the corporate authorities of the municipality, within that municipality. Effective July 1, 2009

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois, the Foreign Banking Office Act, and the Illinois Insurance Code. Allows the Department of Revenue to require financial institutions doing business with the State to provide data concerning those holding accounts with the institution for use in collecting debts owed to the State. Provides for data matches, accommodation of the institutions and charges, confidentiality, and liability.

Amends the Business Brokers Act of 1995. Exempts any franchise seller as defined in the Federal Trade Commission rule entitled Disclosure Requirements and Prohibitions Concerning Franchising, as it may be amended, from the registration requirements and other duties imposed under the Act (rather than exempting persons registered under the Illinois Franchise Disclosure Act of 1987 from the Act's requirements as to (1) offers and sales in connection with franchising activities or (2) assisting their franchisees in the offer or sale of a franchise). Amends the Business Opportunity Sales Law of 1995. Provides that a seller of a business opportunity that is defined as a franchise under the Franchise Disclosure Act of 1987 is exempt from registering certain disclosure documents if the seller delivers either (1) The Franchise Offering Circular or (2) a disclosure document as required by the Illinois Franchise Disclosure Act of 1987, as it may be amended, to each purchaser 14 days prior to (rather than delivery by the earlier of the first personal meeting, or 10 business days) the purchaser's execution of specified documents. Makes other changes. Amends the Franchise Disclosure Act of 1987. In the definition of the term "franchise", provides that a person granted the right to operate a franchise business is required to pay the franchisor or the franchisor's affiliate a fee of $500 or more at any time prior to or within the first 6 months of the commencement of operations of the franchise business. Also enumerates specific franchise agreements and relationships not governed by the Act. Makes changes to provisions concerning the sale and extension or renewal of an existing franchise; exemptions from the Act's registration requirements; registration and annual reports; amendments to disclosure statements; the deferral of payment of the initial franchise fee; and other matters. Repeals the provision prohibiting a franchise broker from selling a franchise that requires registration under the Act unless the franchise broker submitted an application for registration and a consent to service of process. Repeals the provision creating a franchise advisory board.

Amends the Code of Civil Procedure. Provides that no judgment for possession obtained in a forcible entry action may be enforced more than 120 (instead of 90) days after judgment is entered, unless upon plaintiff's motion the court grants an enforcement period extension. Provides that the plaintiff's notice of motion shall contain a notice to the defendant that states that the landlord obtained an eviction judgment against the defendant, but the sheriff did not evict the defendant within the 120 (instead of 90) days that the landlord has to evict after a judgment. Makes corresponding change to 120 days (instead of 90 days) in a provision addressing an order of possession following a hearing and supplemental petition. Effective immediately.

Amends the Mercury-Free Vaccine Act. Provides that the Department of Public Health shall prepare and distribute to all health care providers in the State, a pamphlet that contains information about vaccines that contain mercury and the possible adverse effects associated with such vaccinations and an explanation of the provisions of the Mercury-Free Vaccine Act. Provides that the Department shall provide the pamphlet to hospitals, medical clinics, public health services, and physicians who are likely to provide prenatal or perinatal care for distribution free of charge to pregnant women receiving prenatal or perinatal care. Provides that the Department shall also distribute the pamphlets to any person, organization, or other interested parties upon request. Provides that the Department outreach efforts shall include referral components intended to link immunizing children with available public or private primary care providers. Provides that, in addition to the English language version, the pamphlets shall be translated into a Spanish language version. Makes other changes.

Amends the Chicago Laborers Article of the Illinois Pension Code. Provides that the city shall levy a tax annually at a rate on the dollar of the value, as equalized or assessed by the Department of Revenue of all taxable property within the city for the year 2010 and each year thereafter, that will produce, when extended, an amount equal to or greater than the total amount of contributions made by or on behalf of employees to the Fund for annuity purposes in the calendar year 2 years prior to the year for which the annual applicable tax is levied, multiplied by 1.00. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the General Assembly Compensation Act. Provides that, if the General Assembly, by law, requires any State employees to take one or more unpaid days off as furlough days, then each and every member of the General Assembly is mandatorily required to take at least an equivalent number of unpaid days off as furlough days in the same period during which the employees must take the furlough days. Effective immediately.

Amends the Illinois Insurance Code. Makes technical changes in a Section concerning the short title.

Amends the Rights of Crime Victims and Witnesses Act. Provides that if the office of the municipal attorney is prosecuting the case of the death of a person resulting from reckless homicide or a violation of the Illinois Vehicle Code in which the defendant intends to plead guilty to the violation, the office of the municipal attorney prosecuting the case shall notify the spouse, parent, child, or sibling of the decedent of the date of that plea and of the right of such persons to attend such court appearance and of a representative of such family members to present a victim impact statement at sentencing.

Creates the Rental Housing Nuisance Act. Defines certain real property leased for residential purposes as potential nuisance property if certain criminal activity was conducted on the property on 3 or more instances during any 120 day period as a result of any 3 separate factual events that have been independently investigated by any law enforcement agency that have resulted in an arrest, issuance of a warrant for an arrest, issuance of a ticket or citation or the filing of a police report. Provides that after independent review of any police reports and determination by the chief law enforcement officer that the activity described in the police reports as occurring upon the property meets the definition of nuisance activity and that the owner permitted the property to become a potential nuisance property, the chief law enforcement officer may require that the owner of the property or his or her or its property manager or other designee meet with the chief law enforcement officer to discuss the nuisance activity and steps the owner can take to mitigate or abate the activity. Provides that the chief law enforcement officer in the name of the municipality or county, in a civil action in a court of proper jurisdiction, may seek a declaration that the property is a nuisance property under the Act if mitigation efforts fail. Establishes civil penalties if the court determines the property to be nuisance property. Effective immediately.
