Amends the Illinois Fairness in Lending Act. Provides that no financial institution or other entity whose business includes engaging in residential real estate-related transactions may discriminate against any person in making available such a transaction, or in the terms or conditions of such a transaction, on the basis that the person is pregnant.
Amends the Illinois Controlled Substances Act. Provides that a person who knows or should know that one or more specified controlled substance violations are being committed from, upon, or in residential property he or she owns, manages, or controls that has been physically altered to increase the number of living units therein in violation of any applicable building codes is guilty of a Class A misdemeanor and the residential property is subject to forfeiture. Effective immediately.
Amends the Assistive Technology Warranty Act. Makes a technical change in a Section concerning the short title.
Amends the Humane Care for Animals Act. Provides that a dog may be tethered outdoors only if certain requirements are met. Provides that, even if those requirements are met, "it is unlawful to tether a dog outdoors between the hours of 10 pm and 6 am; except that a dog of any age may be temporarily tethered, tied, or chained outdoors for a time period not exceeding 15 minutes or a dog may be tethered if it has access to adequate shelter and protection from the weather". Provides that this prohibition shall not apply to certain classes of activities. Provides that a person convicted of violating this prohibition is guilty of a Class B misdemeanor and that a second or subsequent violation is a Class 4 felony with every day that a violation continues constituting a separate offense. Requires the court to order the convicted person to undergo a psychological or psychiatric evaluation and to undergo treatment that the court determines to be appropriate after due consideration of the evaluation, if the convicted person is a juvenile or a companion animal hoarder. Provides that nothing in this prohibition shall be construed to supersede the duties of an owner as otherwise specified in the Act. Defines "tether".
Amends the Chicago Laborers Article of the Illinois Pension Code. Requires the Laborers' and Retirement Board Employees' Annuity and Benefit Fund to indemnify and protect the trustees, staff, and consultants of the Fund against all damage claims and suits when damages are sought for negligent or wrongful acts alleged to have been committed in the scope of employment or under the direction of the trustees. Provides that the trustees, staff, and consultants shall not be indemnified for wilful misconduct or gross negligence. Authorizes the board to insure against loss or liability of the trustees, staff, and consultants that may result from these damage claims. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Condominium Property Act. Provides that to the extent that the governing documents of a common interest community or a master association provide for lien rights and the applicability of forcible entry provisions of the Code of Civil Procedure, the purchaser of a unit in a common interest community or master association at a judicial foreclosure sale, other than a mortgagee, who takes possession of a unit pursuant to a court order or a purchaser who acquires title from a mortgagee has the duty to pay the proportionate share, if any, of the common expenses for the unit which would have become due in the absence of any assessment acceleration during the 6 months immediately preceding the commencement of an action to collect the unpaid assessments. Provides that if the outstanding assessments are paid at any time during a collection action, the purchaser shall have no obligation to pay any assessments which accrued before he or she acquired title. Provides that this does not create a statutory lien in favor of the common interest community or master association.
Amends the Chicago Teacher Article of the Illinois Pension Code. Eliminates the required contribution for converting past service to the augmented retirement formula, and provides for a refund of such contributions already paid. Also provides for recalculation of the pension and a lump sum payment of the difference between the augmented and unaugmented rates for certain pensioners. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Illinois Marriage and Dissolution of Marriage Act. Makes a technical change in a Section concerning the best interest of the child.
Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that no electronic check may be drawn on nor any electronic withdrawal made from commercial checking accounts maintained by the Director of Revenue by any secure online, Internet, or web-based banking methods or procedures except on the written approval of 2 or more persons designated and authorized by the Director to make such electronic checks or electronic withdrawals. Increases amounts that the Director may keep in such accounts. Amends the Illinois Income Tax Act. Creates an addition modification in an amount equal to certain unpaid withholdings. Makes other changes. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act to extend the statute of limitations on certain violations of the Acts from 3 years after the commission of the act to 6 years after the commission of the act. Provides that vendors who do not have a valid certificate of registration are not entitled to the vendor discount under the Acts. Amends the Coin-Operated Amusement Device and Redemption Machine Tax Act. Makes changes regarding the imposition of the privilege tax and in penalty provisions. Amends the Uniform Penalty and Interest Act. Imposes a penalty for failure to file a transaction reporting return required under specified provisions of the Retailers' Occupation Tax Act and the Use Tax Act. Amends the Criminal Code of 1961 to make changes in the definition of "redemption machine". Makes other changes. Effective immediately.
