Amends the Cemetery Oversight Act. Makes a technical change in a Section concerning the short title.
Amends the Criminal Code of 1961 relating to unlawful use of weapons. Increases the penalties by one class if a semi-automatic assault weapon or high capacity ammunition was possessed in the commission of the offense. Defines "semi-automatic assault weapon" and "high capacity ammunition". Effective immediately.
Amends the Unified Code of Corrections. Provides that the Prisoner Review Board shall not release any material to the inmate, the inmate's attorney, any third party, or any other person containing any information from the victim or from a person related to the victim by blood, adoption, or marriage who has written objections, testified at any hearing, or submitted audio or visual objections to the inmate's parole, unless provided with a waiver from that objecting party.
Amends the Fire Investigation Act. Authorizes the Attorney General, or the State's Attorney in a county in which a violation occurs, to bring an action against violations of rules adopted under the Act. Authorizes (rather than requires) the Office of the State Fire Marshal or local officers charged with the duty of investigating fire to enter (rather than inspect and examine) all buildings, premises, occupancies, structures, or portions thereof in their respective jurisdictions. Provides that if a dangerous condition, code violation, or fire hazard is found to exist, then the Office of the State Fire Marshal or the local officers shall order the dangerous condition removed or remedied. Provides that if, in the determination of the Office, the condition of a building, structure, occupancy, premise, or portion thereof poses an immediate threat or hazard to safety or health, the Office must require the building, structure, occupancy, premise, or portion thereof to be vacated immediately and not reoccupied until the necessary repairs and improvements are completed and the Office or the local officers have inspected and approved them. Requires the Office to cause a notice to be posted at each entrance to each such structure. Prohibits entry in such a structure, except for the purpose of making the required repairs. Requires that notice to remain posted until the required repairs are made.
Amends the Unified Code of Corrections. Provides that every person who has been twice convicted in any state or federal court of a felony offense that contains the same element of the intentional or knowing infliction of great bodily harm, permanent disability or permanent disfigurement as the felony offense for which the person is now to be sentenced and the current offense was committed after the 2 prior convictions, shall be adjudged an habitual violent offender. Provides that, except when the death penalty is imposed, anyone adjudged a habitual violent offender shall be sentenced to a term of natural life imprisonment.
Amends the Medicaid Revenue Act. Requires the Department of Healthcare and Family Services, in accordance with the federal Patient Protection and Affordable Care Act, to establish a Basic Health Program within its existing Medicaid managed care and care coordination programs in order to help serve the health care needs of individuals earning between 133% and 200% of the federal poverty level. Provides that the Department shall ensure full implementation of the Basic Health Program by January 1, 2014 and shall take all necessary steps to ensure that the State of Illinois is eligible for, and receives, the enhanced federal matching funds available to serve this currently underserved population.
Amends the Bingo License and Tax Act. Provides that no person or organization shall conduct a remote caller bingo game without a remote caller bingo license issued from the Department of Revenue. Sets forth certain restrictions on the conducting of a remote caller bingo game. Sets forth provisions concerning costs, fees, prizes, and proceeds. Defines "remote caller bingo game".
Amends the Public Utilities Act. Provides an alternative procedure that a large public utility may choose in establishing the ratemaking rate base of a water or sewer utility that the large public utility is acquiring. Defines "large public utility" and "water or sewer utility". Provides that the Commission's order that approves the large public utility's acquisition of the water or sewer utility shall include the Commission's decision establishing (1) the ratemaking rate base of the water or sewer utility and (2) the district or tariff group with which the water or sewer utility will be combined for ratemaking purposes. Sets forth provisions concerning definitions, appraisers and their duties, ratemaking rate base, and rate cases. Makes other changes. Effective immediately.
Amends the Illinois Income Tax Act. Provides that any fund that received less than $100,000 but more than $90,000 by October 1, 2011 shall also be included on the individual income tax form for the taxable year beginning on January 1, 2012. Provides that, if a fund that received less than $100,000 but more than $90,000 by October 1, 2011 does not receive at least $100,000 in contributions by October 1, 2013, or by October 1 of any subsequent year, then the fund shall be removed from the individual income tax return forms for each year following the year in which the fund did not receive at least $100,000, and all subsequent contributions to the fund shall be refunded to the taxpayer. Effective immediately.
