ST ETHICS-PUBLIC SERVICE ADS

Amends the State Officials and Employees Ethics Act. Prohibits a public service announcement on behalf of a State administered program that contains the proper name, image, or voice of a State executive branch constitutional officer or legislator from being displayed on a billboard or electronic message board. Effective immediately.

CORRUPTION INFLUENCED&CRIM ORG

Amends the Criminal Code of 1961. Adds the Corruption Influenced and Criminal Organizations Law to the Code. Provides that it is unlawful for any person: (1) who is employed by or associated with any enterprise, knowingly to conduct or participate, directly or indirectly, in such enterprise's affairs through either a pattern of predicate activity or the collection of unlawful debt; or (2) knowingly to acquire or maintain, directly or indirectly, through either a pattern of predicate activity or the collection of unlawful debt, any interest in, or control of, to any degree, any enterprise, real property, or personal property of any character, including money. Defines "pattern of predicate activity". Provides criminal penalties and for seizure and forfeiture of property derived from the pattern of predicate activity. Amends the Code of Criminal Procedure of 1963. Authorizes the court to issue an order authorizing the interception of a private communication when no party has consented to the interception and the interception may provide evidence of, or may assist in the apprehension of a person who has committed, is committing or is about to commit predicate activity. Amends the Statewide Grand Jury Act. Permits the convening of a Statewide Grand Jury to investigate and return indictments for violations of the Corruption Influenced and Criminal Organizations Law.

PROMPT PAYMENT-CARE PROVIDERS

Amends the State Prompt Payment Act. Defines "qualified provider" as (i) an organization that provides non-residential services for the elderly or for the prevention, intervention, or treatment of mental illness, developmental disabilities, or alcoholism or substance abuse or (ii) an entity licensed under the Community-Integrated Living Arrangements Licensure and Certification Act; but does not include a licensed hospital. Provides that a properly prepared voucher request to the Office of the Comptroller for payment to a qualified provider shall be given priority by the Comptroller for processing and warrant issuance after debt service obligations and payroll obligations of the State have been met unless the Comptroller deems that other obligations of the State must be satisfied prior to these categories of payment. Provides that, if at any time the Comptroller determines that there are insufficient funds available to process priority payments, then vouchers shall be processed and paid out in a first-in, first-out manner as corresponding funds become available. Effective immediately.

STATEWIDE GRAND JURY-POWERS

Amends the Statewide Grand Jury Act. Provides that a Statewide Grand Jury may be convened to investigate violations of offenses involving the corruption of a public official, including theft, fraud, extortion or the Official Misconduct Article and the Public Contracts Article of the Criminal Code of 1961.

SCH CD-SPEC ED REIMBURS-TEACHR

Amends the Children with Disabilities Article of the School Code. With respect to the special education reimbursement to school districts for teachers, provides that the reimbursement is for staff working on behalf of certain children (instead of for those children), and provides for a specified increase in the reimbursement from the 2008-2009 school year through the 2012-2013 school year. For each school year thereafter, provides that the reimbursement amount shall equal the amount from the previous school year increased by a percentage increase equal to the percentage increase, if any, in the Consumer Price Index for All Urban Consumers for all items. Increases the reimbursement to school districts for certificated employees who work with or on behalf of students with disabilities full time (instead of teachers, professional workers, directors, and school psychologists) and non-certified employees (instead of necessary non-certified employees) by a specified amount from the 2008-2009 school year through the 2012-2013 school year. For each school year thereafter, provides that the reimbursement amount shall equal the amount from the previous school year increased by a percentage increase equal to the percentage increase, if any, in the Consumer Price Index for All Urban Consumers for all items. Increases the reimbursement amount for readers. Effective immediately.

SCH CD-SPECIAL ED-IEP MEETING

Amends the Children with Disabilities Article of the School Code. Provides that the determination of eligibility for special education must be made and the individualized education program must be completed within 60 calendar days for children ages 3 and 4 and within 60 school days for children ages 5 through 21 (now, 60 school days regardless of age) from the date of written parental consent.

VEH CD-SEAT BELTS-SCHOOL BUS

Amends the Illinois Vehicle Code. Provides that, beginning July 1, 2010, each school bus that is purchased new shall be equipped with seat safety belts for each passenger. Provides that the State Board of Education shall adopt rules to ensure that school districts require all passengers on those buses to wear seat safety belts. Provides that except for willful and wanton conduct, a school bus driver may not be held personally liable for the failure of passengers to wear seat safety belts. Denies home rule powers. Makes a corresponding change in the Illinois Municipal Code. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.
