Amends the Criminal Code of 1961. Makes a technical change in a Section concerning non-defenses to charges of identity theft and aggravated identity theft.
Amends the Unified Code of Corrections. Makes a technical change in a Section concerning rules and regulations for early release on account of good conduct of persons committed to the Department of Corrections.
Amends the Administration Article of the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services' Inspector General shall oversee the Department's integrity functions, which include, but are not limited to, the monitoring of quality assurance programs administered by the Department (rather than monitoring of quality assurance programs generally related to the medical assistance program and specifically related to any managed care program). Adds the offices of the Centers for Medicare and Medicaid Services that administer the Medicare and Medicaid integrity programs to the list of agencies the Inspector General shall liaison with on behalf of the Department. Makes other changes.
Amends the Illinois Water Well Construction Code. Requires the Illinois Department of Public Health, by January 1, 2012, to (i) establish standards for the certification and licensing of individuals and contractors constructing and modifying closed loop wells and (ii) issue permits for the construction and modification of closed loop wells. Effective immediately.
Amends the Condominium Property Act. In provisions concerning liens for amounts due, for unpaid common expenses, provides, with respect to a condominium unit in foreclosure, that a mortgagee who receives title to a unit by purchase at a judicial foreclosure sale, by a deed in lieu of foreclosure, or by a court order pursuant to a foreclosure shall pay the unpaid proportionate share of the common expenses for the unit, related late charges, and attorney's fees that accrued before the mortgagee acquired title and those that later become due, up to the date of the conveyance of the unit pursuant to a sale by the mortgagee. Provides that a purchaser at a judicial foreclosure sale or a person who purchases a foreclosed unit from the mortgagee has no obligation to pay for the unpaid proportionate share of the common expenses for the unit, related late charges, or attorney's fees which accrued before the purchaser acquired title. Deletes language providing that: (i) the purchaser at a judicial foreclosure sale or a mortgagee who receives title by deed in lieu of foreclosure or by a court order shall pay the unit's common expenses from and after the first day of the month after the delivery of the deed in lieu of foreclosure, the sale, or the court order; and (ii) a person who buys a unit, other than a mortgagee, at a judicial foreclosure sale or from a mortgagee shall have the duty to pay the proportionate share of unpaid unit common expenses which would have become due (without any assessment acceleration) during the 6 months before the filing of an action to collect assessments. Makes other changes.
Amends the Environmental Protection Act. Beginning January 1, 2030, prohibits the installation or operation of drycleaning machines that use perchloroethylene. Until that date, authorizes the use of (i) perchloroethylene drycleaning machines that have only a primary control system, but only for the remainder of each machine's useful life and at the facility at which it is located on the effective date of the amendatory Act and (ii) perchloroethylene drycleaning machines that have primary and secondary control systems. Beginning January 1, 2013, prohibits a person from operating a drycleaning machine unless (i) a person with specified training is present at the facility during the machine's operation and (ii) certain secondary containment measures are in place. Authorizes the Environmental Protection Agency, by rules adopted before July 1, 2013, to require manufacturers of alternatives to perchloroethylene to provide information about those products to the Agency. Requires the Agency to review the safety and legality of the perchloroethylene alternatives. Defines "drycleaning", "drycleaning machine", "drycleaning solvents", "perchloroethylene drycleaning machine", "primary control system", "refrigerated condenser", and "secondary control system". Effective immediately.
Amends the Illinois Oil and Gas Act. Provides that the Director of Natural Resources shall adopt rules that require, prior to such hydraulic fracturing, the owner or operator to perform a suitable mechanical integrity test of the casing or of the casing-tubing annulus or other mechanical integrity test methods using procedures that are established by administrative rule. Provides that each owner or operator that begins extracting natural gas from shale shall report to the Department specified information within 30 days after the completion of all stages of the hydraulic fracturing stimulation. Requires that the owner or operator shall post the chemical disclosure information on certain specified websites. Provides that the owner or operator shall provide information to the Director as to the amounts, handling, and, if necessary, disposal at an identified appropriate disposal facility, or reuse of the well stimulation fluid load recovered during flow back, swabbing, or recovery from production facility vessels. Provides that the storage of the well stimulation fluid load shall be protective of an underground source of drinking water by the use of either tanks or lined pits. Provides that nothing in the provision shall be construed to require or allow disclosure of trade secrets or commercial information that is exempt from inspection or copying when provided to the Department together with a claim made pursuant to the Freedom of Information Act that such information is proprietary, privileged, or confidential and that disclosure may cause competitive harm to the person or business. Provides that the provision only applies to the extraction of natural gas from shale.
Amends the Employee Washroom Act. Makes a technical change in a Section concerning the short title.
Amends the Firearm Owners Identification Card Act. Provides that a person who is not a federally licensed importer, manufacturer, or dealer and who desires to sell or transfer a firearm of a size that may be concealed upon the person to another person, who is not a federally licensed importer, manufacturer, or dealer, shall do so only at the place of business of a federally licensed firearm dealer. Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he or she were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus other authorized fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or other family members, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show.
Amends the Property Tax Code. Removes a requirement that taxpayers in a county with 3,000,000 inhabitants must reapply for the Senior Citizens Homestead Exemption on an annual basis.
