EDUC LABOR-FAIR SHARE PAYMENTS

Amends the Illinois Educational Labor Relations Act with regard to non-member fair share payments. Provides that only the exclusive representative may negotiate provisions in a collective bargaining agreement providing for the payroll deduction of labor organization dues, fair share fee payments, initiation fees, or assessments. Provides that if a collective bargaining agreement is terminated or continues in effect beyond its scheduled expiration date pending the negotiation of a successor agreement or the resolution of an impasse under the Act, then the employer shall continue to honor and abide by any dues deduction or fair share clause contained in the agreement until a new agreement is reached. Sets forth applicability requirements for successor exclusive representatives. Amends the State Mandates Act to require implementation without reimbursement.

LABOR POLICE FIRE DISCIPLINE

Amends the Illinois Public Labor Relations Act. Provides that discipline and disciplinary due process procedures shall be mandatory subjects of bargaining for firefighters and peace officers. Provides that a home rule unit may not regulate these mandatory subjects of discipline and disciplinary due process procedures in an inconsistent manner. Amends the Illinois Municipal Code. Deletes provisions that stated, as to firefighters and peace officers, that in non-home rule units of government that due process was a permissive subject and not a mandatory subject, except where a collective bargaining agreement included due process provisions and was in effect on the effective date of the prior amendatory Act. Effective immediately.

POLICE-FIRE-REMOVAL-DISCHARGE

Amends the Counties Code and the Illinois Municipal Code. Provides that the Merit Commission (now, the plaintiff) shall pay the cost (now, the reasonable cost) of preparing and certifying for judicial review the record of a hearing by the Commission on the removal, demotion, or suspension of certain employees of the sheriff, police department, or fire department. Removes provisions requiring the court to award to a plaintiff who prevails in the judicial review proceeding a sum equal to the costs paid by the plaintiff to have the record prepared and certified for judicial review. Removes a provision allowing an alternative or supplemental form of due process based on impartial arbitration that is negotiated by an employer and a labor organization. Removes a provision making bargaining for alternative or supplemental forms of due process permissive for non-home rule units of local government unless the contract term was negotiated prior to a certain time. Provides that certain employers are not prohibited from agreeing, through the collective bargaining process, to submit disciplinary matters to the grievance and arbitration procedures in a collective bargaining agreement with the certified collective bargaining representative.

PROP TX-ALT HOMESTEAD EXEMPT

Amends the Property Tax Code. In a Section concerning the Senior Citizens Homestead Exemption, provides that in all counties (now, in counties with less than 3,000,000 inhabitants), the county board may by resolution provide that if a person has been granted the homestead exemption, the person qualifying need not reapply for the exemption. In a Section concerning the alternative general homestead exemption, deletes provisions ending the alternative exemption after certain tax years. Provides that the $20,000 limit on the alternative exemption applies only for certain tax years. Sets forth requirements for ordinances by counties concerning the homestead exemption. Effective immediately.

MEDICAL CANNABIS ACT

Creates the Medical Cannabis Act. Provides that a person who has been diagnosed by a physician as having a debilitating medical condition and the person's primary caregiver may be issued a registry identification card by the Department of Human Services that permits the person or the person's primary caregiver to legally possess no more than 12 cannabis plants and two and one-half ounces of usable cannabis. Provides that a person who possesses a registry identification card is not subject to arrest, prosecution, or penalty in any manner, or denial of any right or privilege, including civil penalty or disciplinary action by a professional licensing board, for the medical use of cannabis; provided that the qualifying patient or primary caregiver possesses an amount of cannabis that does not exceed 12 cannabis plants and two and one-half ounces of usable cannabis. Amends the Cannabis Control Act to make conforming changes consistent with the Medical Cannabis Act. Effective immediately.

EMPLOYEE CLASSIFICATION ACT

Creates the Employee Classification Act. States that the Act is intended to address the practice of misclassifying employees as independent contractors. Provides that an individual performing any service is deemed to be an employee unless specified conditions are met. Requires summaries of the requirements of the Act to be posted by specified methods. Provides that it is a violation of the Act to misclassify persons performing services as employees. Contains provisions regarding: enforcement; investigations; hearings; remedies; review; contempt as a remedy; civil penalties for violations; creation of an Employee Classification Fund and the uses of moneys in the Fund; retaliation; creation of a private right of action; adoption of rules; criminal penalties; and other matters. Amends the State Finance Act to include the Fund as a special fund. Amends the Department of Employment Security Law, the Department of Revenue Law, and the Workers' Compensation Act to require cooperation with the Department of Labor. Amends the Illinois Procurement Act to conform to the new Act. Contains a severability clause. Effective July 1, 2006.

PEACE OFFCR-DISCIPLINE

Amends the Uniform Peace Officers' Disciplinary Act. Changes the definition of "interrogation" to include the questioning of an officer during an informal inquiry. Amends the Board of Fire and Police Commissioners Act and the Sheriff's Merit Commission Act. Provides that certain Sections of those Acts shall not be construed to limit or prohibit any municipality, subject to the Illinois Public Labor Relations Act, from bargaining collectively over discipline and discharge procedures that are not consistent with other provisions of those Act, including arbitration procedures for the appeal of decisions of the Board of Fire and Police Commissioners and the Sheriff's Merit Commission. Effective immediately.

WORKERS COMP-FUNDING

Amends the State Finance Act. Sets forth that notwithstanding any other provision of State law to the contrary and in addition to any other transfers that may be provided for by law, on July 1, 2005 (now, on the first day of each calendar quarter of the fiscal year beginning on July 1, 2005), or as soon as may be practical thereafter, the State Comptroller shall direct and the State Treasurer shall transfer from each designated fund into the Workers' Compensation Revolving Fund amounts equal to each of the following totals (now, one-fourth of each total): General Revenue Fund $44,000,000 (instead of $34,000,000), and Road Fund $36,000,000 (instead of $25,987,000). Effective immediately.

MEDICAL MARIJUANA USE COMM

Finds that State law should make a distinction between the medical and non-medical use of marijuana and establishes a committee to investigate and assess options for legal protection for seriously ill patients to use medical marijuana without facing criminal prosecution under State law.
