IL OPTOMETRIC PRACTICE ACT

Amends the Illinois Optometric Practice Act of 1987. Replaces the requirement for licensees to apply for additional licenses in order to practice optometry at more than one address with the new requirement that licensees report to the Department every additional location where the licensee engages in the practice of optometry. Provides that failure to report a practice location or registering a location where a licensee does not practice constitutes a violation of the Act. In a provision concerning license renewal, provides that all licensees on March 31, 2010 without a certification of completion of an oral pharmaceutical course as required by the Act shall be placed on non-renewed status and may only be renewed after the licensee meets those requirements established by the Department. Provides that licensees may apply for expungement from their disciplinary record any offense relating to the failure to complete continuing education requirements, the failure to have an ancillary license, or the failure to report a practice location if they meet certain conditions. Repeals a Section concerning limited optometry licenses. Makes other changes.

COLORECTAL CANCER PILOT PRGM

Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Requires the Department of Public Health to implement the Colorectal Cancer Screening and Treatment Pilot Program in areas of the State that have the highest incidences of mortality related to colon cancer. Provides that the Program sites must be located in and operated through Federally Qualified Health Centers. Provides that the Program shall provide funding for colorectal cancer examinations and laboratory tests and shall provide colorectal cancer screening and treatment services for specified groups. Provides that these provisions are repealed 3 years after the effective date of the amendatory Act.

ELEVATORS - SPECIAL PURPOSE

Amends the Elevator Safety and Regulation Act. Provides that special purpose personnel elevators within the scope of section 17.1 of the American Society of Mechanical Engineers Code (ASME A17.1) and used only by authorized personnel are exempt from regulation under the Act. Effective immediately.

RADON TESTING AND DISCLOSURE

Amends the Illinois Radon Awareness Act. Changes a provision on the Disclosure of Information on Radon Hazards form. Requires sellers of certain property to disclose, among other things, either (i) that they have no knowledge of elevated radon concentrations or (ii) that prior elevated radon concentrations have been mitigated or remediated (now, only (i) must be disclosed). Provides that the Act's provisions do not apply to the transfer of any residential dwelling unit located on the third story or higher above ground level of any structure or building. Effective immediately.

RADON--DEVICE APPROVAL

Amends the Radon Industry Licensing Act. Prohibits any person from selling a device in this State to detect the presence of radon or radon progeny in the indoor atmosphere without prior approval of the device from the Agency. Requires all electronic radon detection devices sold in this State to be calibrated to ensure the accuracy and precision of their measurements of radon and radon progeny. Effective immediately.

MEDICAID-APPLY-NURSING HOME

Amends the Illinois Public Aid Code. Provides that if an applicant for medical assistance is a resident in a nursing home, the Department of Healthcare and Family Services must notify the nursing home, in writing, of the Department's decision on the application. Effective immediately.

FINANCE-CONSERVATION TRANSFERS

Amends the State Finance Act. Provides that amounts that were transferred from certain special funds into the FY09 Budget Relief Fund prior to the effective date of the amendatory Act shall be re-transferred. Limits future transfers from those funds. Effective immediately.

ENTERPRISE ZONE ACT-WIND FARMS

Amends the Illinois Enterprise Zone Act. Provides that businesses that intend to establish a new wind power facility in Illinois may be considered "high impact businesses" and qualify for certain occupation tax exemptions. Exempts businesses that intend to establish new wind power facilities from provisions of the Act requiring applicants for designation as high impact businesses to provide the Department with (i) the prospective plan for which 1,500 full-time jobs would be eliminated if the business is not designated and (ii) proof of alternative non-Illinois sites which would receive the proposed investment and job creation if the business is not designated, and from provisions of the Act concerning revocation of high impact business status. Requires payment of prevailing hourly wages.

AFFORDABLE ALZHEIMERS HOUSING

Resolves that the State of Illinois establish an affordable Alzheimer's housing-with-services program that builds off of both the Supportive Living Facilities and the Comprehensive Community Residential Settings programs.
