Amends the Environmental Protection Act. Defines "Tier 1 construction or demolition debris soil". Provides that a "pollution control facility" includes any site or facility at which Tier 1 construction or demolition debris soil is accepted or deposited as fill material. Provides that the Illinois Environmental Protection Agency may, by intergovernmental agreement, develop a special authorization for the removal and reuse of soil from and to sites within the corporate boundaries of a municipality with a population in excess of one million. Specifies the terms and requirements of the intergovernmental agreement. Specifies certification requirements for the use of contaminated soil as fill material in a quarry, mine, or other excavation. Provides that owners and operators of Tier 1 construction or demolition debris soil fill operations must develop and implement a receipt control plan and engineered control plan for construction or demolition debris soil used as fill material. Specifies the requirements of the receipt control plan and engineered control plan. Specifies the notice requirements for an intergovernmental agreement. Effective immediately.

Amends the Illinois Enterprise Zone Act. Provides that businesses that intend to establish a new wind power facility in Illinois may be considered "high impact businesses" and qualify for certain occupation tax exemptions. Exempts businesses that intend to establish new wind power facilities from provisions of the Act requiring applicants for designation as high impact businesses to provide the Department with (i) the prospective plan for which 1,500 full-time jobs would be eliminated if the business is not designated and (ii) proof of alternative non-Illinois sites which would receive the proposed investment and job creation if the business is not designated, and from provisions of the Act concerning revocation of high impact business status. Requires payment of prevailing hourly wages.
Congratulates the members of the "Be a Santa to a Senior" program and designates the month of December 2010 as Be a Santa to a Senior Month.
Amends the Environmental Protection Act. Makes a technical change in a Section concerning the short title.
Amends the Aircraft Use Tax Law. Provides that the tax does not apply to an aircraft that is not eligible to receive a certificate of airworthiness from the Federal Aviation Administration because the aircraft is not in a condition for safe operation.
Amends the Electric Service Customer Choice and Rate Relief Law of 1997 in the Public Utilities Act. Provides that an alternative retail electric supplier shall be responsible for procuring cost-effective renewable energy resources as required under specified provisions of the Act in a specified manner. Provides that an alternative retail electric supplier shall comply with the renewable energy portfolio standards by any one or a combination of specified means. Contains provisions concerning the use of renewable energy certificates. Contains provisions concerning alternative compliance payments for alternative retail electric suppliers. Provides that each alternative retail electric supplier shall, by September 1, 2011 and by September 1 of each year thereafter, prepare, and submit to the Illinois Commerce Commission a report that provides information certifying compliance by the alternative retail electric supplier with specified provisions. Provides that upon complaint or the Commission's own motion, the Commission may conduct a contested case to review allegations that the alternative retail electric supplier has violated specified provisions. Contains an exemption from specified requirements for electric utilities that meet certain criteria. Provides that biennially, the Commission shall submit to the General Assembly a report that discusses the status of renewable energy in the State and the effect of certain provisions on electricity prices and retail and wholesale electric markets.
Amends the Environmental Protection Act. Provides that certain limitations on liability and cost recovery for site remediation do not apply to sites that (i) are subject to any remediation or remedial activity regulated under a State program authorized, approved, or delegated pursuant to any federal environmental statute or (ii) do not qualify to participate in the Site Remediation Program. Provides that sites that are subject to post-closure corrective action or remediation requirements under the federal or State solid hazardous waste laws do not qualify to participate in the Site Remediation Program. Specifies that the definition of "remedial action" applies only to the provisions concerning the Site Remediation Program. Provides that the Pollution Control Board may (now, "shall") adopt rules concerning the proportionate share of liability. Provides that the Environmental Protection Agency's issuance of a No Further Remediation Letter signifies a release from further responsibilities for those sites that are eligible for the Site Remediation Program. Makes other changes. Effective immediately.
Amends the Environmental Protection Act. Requires the Illinois Pollution Control Board to adopt Non-attainment New Source Review and Prevention of Significant Deterioration programs, and requires those programs to be no more stringent than the federal program requirements under 40 C.F.R. 51.165 and 51.166. Effective immediately.
Creates the Efficient and Green Illinois Tax Credit Act. Authorizes the Department of Commerce and Economic Opportunity to award income tax credits based on 25% of the cost of qualifying expenditures for energy efficient projects, such as solar energy equipment, Energy Star certified heat pumps, lighting retrofit projects, and wind equipment. Authorizes the Department to adopt rules. Provides that the credit may be carried forward for up to 5 taxable years. Amends the Illinois Income Tax Act to make conforming changes. Provides that the credit is exempt from the Act's automatic sunset provisions. Effective immediately.
Amends the Environmental Protection Act. Provides that urban soil and urban clean construction or demolition debris taken to a clean construction or demolition debris fill operation is not waste. Defines "urban soil" as soil that is excavated and removed from sites within the boundaries of a municipality with a population in excess of 1 million and that has not been the subject of a release of contaminants but may nonetheless contain contaminants due to certain causes. Defines "urban clean construction or demolition debris" as specified paving materials that are excavated from a construction or demolition site within the corporate boundaries of a municipality having a population in excess of 1,000,000. Requires the owner of a site from which urban soil only is removed, prior to authorizing the transfer of that soil, to perform or cause to be performed (i) a Phase I Environmental Audit or an historical or regulatory database search, such as that set forth in the Standard Practice for Limited Environmental Due Diligence: Transaction Screen Process (ASTM E 1528-06), (ii) a Phase II Environmental Audit (under some circumstances), and (iii) testing of representative samples of the soil using specific methods. Requires the owner to certify certain information to the clean construction or demolition debris fill operator. Requires fill operations that accept urban soil to develop and implement a Receipt Control and Screening Plan that ensures the receipt of certification documents. Authorizes the Agency to propose to the Board, and the Board to adopt certain rules. Effective immediately.
