Amends the Illinois Power Agency Act. In provisions concerning the aggregation of retail electrical load of residential and small commercial retail customers by municipalities and counties, provides that any aggregation program that operates as an opt-out program shall apply solely to residential and small commercial retail customers that are taking service from the electric utility through fixed-price bundled service tariffs. Provides that the corporate authorities or the county board shall allow new residents outside of an opt-out period and non-applicable residential and small commercial retail customers who were not eligible to receive the opt-out notice to affirmatively commit to the terms and conditions of an opt-out program at any time during the length of the program under a process disclosed in the plan of operation and governance. Sets forth provisions concerning the plan of operation and governance for an opt-out program. Sets forth provisions concerning requests made by the corporate authorities or the county board in the aggregate area for certain information from the electric utility related to applicable residential and small commercial retail customers in the aggregate area. Provides that the Illinois Commerce Commission shall adopt rules to implement the provisions of the amendatory Act, including, but not limited to, protection of customers already under contract with an alternative retail electric supplier, utility processes for enrollment of opt-out customers, minimum disclosure requirements for opt-out aggregation programs and licensing of municipalities. Makes other changes. Effective immediately.

Amends the Clean Coal FutureGen for Illinois Act. Defines "operational phase". Provides that if the FutureGen Alliance selects as its location for CO2 storage a designated site or sites in the State of Illinois suitable for injection of captured CO2 into the Mount Simon Formation (rather than at the Tuscola or Mattoon site), then the Operator shall retain the rights, title, and interest in and to and any liabilities associated with the pre-injection CO2. Provides that the Operator shall retain all rights, title, and interest in the sequestered CO2 during the operational phase of the FutureGen Project. Provides that following the operational phase of the FutureGen Project, the Operator shall transfer and convey and the State of Illinois shall accept and receive, with no payment due from the State of Illinois, all rights, title and interest in and to and any liabilities associated with the sequestered CO2. Provides that the Operator (rather than the Department) shall procure a certain insurance policy that insures the Operator against any qualified loss stemming from a public liability action and with coverage limits of at least $15,000,000. Provides that the Operator shall establish and fund a newly-created CO2 Storage Trust Fund to complement commercially-available insurance products and to support the Operator's ability to satisfy financial assurance obligations that may be required by law or the terms of the Operator's permit issued by the Agency. Provides that the State shall indemnify and hold harmless the Operator against any qualified loss stemming from a public liability action to the extent that the qualified loss is not covered under the insurance policy required under the Act and to the extent that the CO2 Storage Trust Fund lacks adequate funds to cover the loss. Extends the repeal date from March 1, 2011 to March 1, 2015. Makes other changes. Effective immediately.
Amends the Illinois Pull Tabs and Jar Games Act. Removes language providing that production standards for pull tabs and jar games shall include the name of the supplier which shall appear in plain view to the casual observer on the face side of each pull tab ticket and on each jar game ticket. Amends the Charitable Games Act. Provides that a supplier shall permanently affix his or her name to all charitable games equipment and supplies, not including pull tabs. Makes other changes.
Creates the Efficient and Green Illinois Tax Credit Act. Authorizes the Department of Commerce and Economic Opportunity to award income tax credits based on 25% of the cost of qualifying expenditures for energy efficient projects, such as solar energy equipment, Energy Star certified heat pumps, lighting retrofit projects, and wind equipment. Authorizes the Department to adopt rules. Provides that the credit may be carried forward for up to 5 taxable years. Amends the Illinois Income Tax Act to make conforming changes. Provides that the credit is exempt from the Act's automatic sunset provisions. Effective immediately.
Amends the Illinois Power Agency Act. Provides that beginning April 1, 2012, and each year thereafter, the Illinois Power Agency shall prepare a report for the General Assembly and Illinois Commerce Commission that shall include, but not be limited to, renewable portfolio standards. Provides that a required annual report shall include the quantity, price, and rate impact of all renewable resources purchased pursuant to long-term contracts under the electricity procurement plans for electric utilities. Amends the Public Utilities Act. Provides that beginning April 1, 2012 and by April 1 of each year thereafter, the Illinois Power Agency shall submit an annual report to the General Assembly, the Commission, and alternative retail electric suppliers that shall include specified information. Effective immediately.
Amends the Mid-America Medical District Act. Expands the boundaries of the Mid-America Medical District to include the corporate boundaries of the City of Belleville. Provides for the appointment of 3 additional members to the Mid-America Medical District Commission. Provides that the new members shall be appointed by the Mayor of the City of Belleville with the advice and consent of the corporate authorities of the City of Belleville. Adds to the purposes of the Mid-America Medical District Commission convening dialogue among leaders in the public and the private sectors on topics and issues associated with training in the delivery of health care services within the District's program area. Authorizes the Mid-America Medical District Commission to issue revenue bonds. Sets forth the requirements for issuing revenue bonds. Effective immediately.
Amends the Public Utilities Act. In a provision concerning service obligations of electric utilities, provides that any residential or small commercial retail customer which elects delivery services is entitled to return to the electric utility's bundled utility tariffed service offering provided upon payment of a reasonable administrative fee which shall be set forth in the tariff, provided, however, that the electric utility shall be entitled to impose the condition that such customer may not elect delivery services for up to 12 months thereafter if the residential or small commercial customer has not elected delivery services within 2 billing cycles after returning to the electric utility's bundled utility tariffed service offering. Effective immediately.
Amends the Nursing Home Care Act. Makes a technical change in a Section concerning medical treatment.
Amends the Illinois Municipal Code. Provides that a municipality may impose a bail processing fee up to $20 against any person arrested for violating a bailable municipal ordinance or a State or federal law. Effective immediately.
Amends the Medical Assistance Article of the Illinois Public Aid Code. In regard to all changes in status of Medicaid recipients residing in Illinois nursing facilities, requires the Department of Healthcare and Family Services to report to the appropriation committees of both chambers hearing the agency's budget on the status of implementation, estimates of the cost of full implementation and recommendations for compliance no later than January 1, 2012. Effective immediately.
