Rep. Jay Hoffman

Amends the Prevailing Wage Act. Restores certain provisions of the Act to the form in which they existed before Public Act 104-17 took effect. Provides that nothing in the Act prohibits the payment of wages and fringe benefits for work performed under the Act that is based upon the craft and the skill level of the laborers, mechanics, or other employees who perform the work if the wages and fringe benefits are established and are paid in accordance with a collective bargaining agreement or understanding between an employer or an employer association and a bona fide labor organization for work performed of a similar character in the locality in which the work is performed. Effective July 1, 2026.

Provides that the Act may be referred to as the Road to Census 2030 Act of 2026. Appropriates from the General Revenue Fund $500,000 to the Department of Human Services, $500,000 to the Secretary of State, and $1,600,000 to the Department of Public Health. Effective July 1, 2026.

Congratulates the East St. Louis Senior High School boys basketball team, the Flyers, on winning the 2026 Illinois High School Association Class 3A State Championship.

Congratulates Cyndi Oberle-Dahm on her retirement from Belleville Township District 201. Thanks her for her commitment to the community and to the State of Illinois.

Amends the Nurse Practice Act. Ratifies and approves the Nurse Licensure Compact, which allows for the issuance of multistate licenses that allow nurses to practice in their home state and other compact states. In provisions concerning an application for a license, provides that the Department of Financial and Professional Regulation may establish, by rule, fees to be charged for the purpose of implementing and enforcing the provisions of the Act, including the fees necessary to implement the Nurse Licensure Compact. Provides that, on or after the effective date of the Nurse Licensure Compact, the Department may set the required fees to apply for a multistate license, upgrade from a single state license to a multistate license, and renew a multistate license. Provides that the initial application fee for a multistate license shall be no less than $150 and the biennial multistate license renewal fee shall be no less than $125. Provides that the Nurse Licensure Compact does not supersede existing State labor laws. Provides that the State may not share with or disclose to the Interstate Commission of Nurse Licensure Compact Administrators or any other state any of the contents of a nationwide criminal history records check conducted for the purpose of multistate licensure under the Nurse Licensure Compact. Provides that an employer who employs nurses, as defined in the Article, shall provide the nurses under its employment with the opportunity to obtain the required continuing education hours. Requires that nurses subject to the Nurse Licensure Compact complete 20 hours of approved continuing education per every 2-year license renewal cycle. Provides that the Nurse Licensure Compact does not apply to an advanced practice registered nurse. Adds provisions concerning employer attestations.

Amends the Counties Code. Provides that, beginning July 1, 2026, each State's Attorney whose term begins after July 1, 2026 shall be compensated at the rate of 100% of the mean of the amount paid to the resident circuit judges in the county courthouse for the State's Attorney.. Provides that the State shall furnish 66 2/3% of the total annual compensation to be paid to each State's Attorney in the State based on the salary in effect on December 31, 1988, and 100% of the increases in salary taking effect after December 31, 1988. Provides that the amount shall be paid from the Personal Property Tax Replacement Fund. Provides that the county shall be responsible for the State and federal income tax reporting and withholding and the employer contributions under the Illinois Pension Code.

Amends the Illinois Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Act. Provides that each self-insured commercial vehicle rental company may collect and shall pay into the Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Trust Fund an amount equal to $1.00, or a lesser amount determined by the Illinois Vehicle Hijacking and Motor Vehicle Theft Prevention and Insurance Verification Council, multiplied by each car rental contract providing physical damage insurance coverage written by it in the State during the preceding calendar year. Effective January 1, 2027.

Amends the Election Code. Provides that it is unlawful for any person to intimidate, threaten, coerce, use violence or force, or attempt to intimidate, threaten, coerce, or use violence or force against: (1) an election worker in the performance or discharge of his or her election-related duties; or (2) an individual who is lawfully present at a polling place or a location where a canvass of votes is conducted. Provides that any person who violates the provision is guilty of a Class A misdemeanor for a first offense and a Class 4 felony for a second or subsequent offense committed within 3 years of a previous conviction for the same offense.

Amends the Illinois Power Agency Act and the Broadband Infrastructure Advancement Act. Provides that the Illinois Power Agency and the Department of Commerce and Economic Opportunity, respectively, shall create a specific Database and may contract with a third-party database program administrator to do so. Provides that, if the Agency or Department decides to contract with a third-party database program administrator, the third-party database program administrator shall be exempt from certain requirements in the Illinois Procurement Code. Provides that the specific Database shall be a searchable database of awardees, contractors, developers, suppliers, vendors, and subcontractors for certain projects or providers that is: (i) publicly accessible; (ii) easy for people to find and use; (iii) organized by company specialty or field; (iv) region-specific; and (v) populated with information that includes, but is not limited to, project names, project size, contact information, including the addresses, phone numbers, and email addresses of suppliers, vendors, or subcontractors who participate or have participated in any of the programs described in the respective Act, and the current status of such projects. Provides that a posting on the specific Database shall be made by the applicable developer prior to the start of work on a project. Requires developers to provide regular updates on the status of such projects until a project's completion. Amends the Illinois Procurement Code. In provisions concerning competitive sealed bidding, provides that public notice of an invitation for bids shall be published in the Illinois Procurement Bulletin and in the BidBuy eProcurement System at least 14 calendar days before the date set in the invitation for the opening of bids. Provides that the Director of the Illinois Power Agency may create alternative bidding procedures to procure renewable energy resources smaller than 1,000 kilowatts (rather than to procure renewable energy resources) under certain provisions of the Illinois Power Agency Act. Makes other changes. Effective immediately.

Amends the Illinois Works Jobs Program Act. Provides that the provisions of the Act apply to projects financed or funded, in whole or in part, by a grant, loan, incentive, or tax subsidy, credit, or rebate provided through a program established by State law and administered by a State agency and that require the payment of prevailing wages to employees. Makes changes to the Illinois Works Apprenticeship Initiative. Provides that the Department of Labor may reduce or waive the apprenticeship requirements under certain conditions. Makes conforming changes. Effective immediately.
