CRIM CD-DISMEMBER BODY

Amends the Criminal Code of 1961. Creates the offense of dismembering a human body. Establishes exceptions. Provides that the penalty is a Class X felony. Effective immediately.

TOBACCO-MINORS-LUNCH WAGON

Amends the Sale of Tobacco to Minors Act to provide that the sale or distribution at no charge of cigarettes from a lunch wagon engaging in any sales activity within 1,000 feet of any public or private elementary or secondary school grounds is prohibited.

CIVIL NO CONTACT ORDER ACT

Creates the Civil No Contact Order Act. Sets forth procedures under which a victim of non-consensual sexual conduct or non-consensual sexual penetration may petition a court for a civil no contact order requiring the person who committed the non-consensual sexual conduct or non-consensual sexual penetration to stay away from the victim. Provides that violation of a civil no contact order is a Class A misdemeanor for a first offense and a Class 4 felony for a second or subsequent offense. Provides that a law enforcement officer may make an arrest without a warrant if the officer has probable cause to believe that a person has committed or is committing a violation of a civil no contact order. Provides that sheriffs shall furnish to the Department of State Police copies of no contact orders issued by the court and that civil no contact orders shall be entered in the LEADS system. Provides that the Department of State Police shall maintain a record and index of civil no contact orders.

CREDIT-DEBIT CARD DISCLOSURE

Creates the Credit Card and Debit Card Account Disclosure Act. Provides that a person or entity that provides anything of value upon presentation of a credit card or debit card may not print or otherwise reproduce on the cardholder's receipt either of the following: any part of the credit card or debit card account number, other than the last 5 digits or characters, or the expiration date of the credit card or debit card. Provides that the prohibition does not apply where the person to whom the credit card or debit card is presented cannot record credit card or debit card numbers except in writing or by imprint. Provides that the prohibition does not apply to electronic benefits transfers under the federal Food Stamp Program. Provides that a person who violates the prohibition is liable to the issuer or the cardholder for any actual damages resulting from the use of the cardholder's credit card or debit card without his or her permission and for costs and attorney's fees. Provides that the Act becomes operative on January 1, 2005 with respect to any credit card or debit card transaction receipt device that is in use prior to January 1, 2004, and becomes operative on January 1, 2004 with respect to any such device first put to use on or after January 1, 2004.

PARENTAGE ACT-REMOVAL

Amends the Illinois Parentage Act of 1984. Provides that in any action brought under the Act for the initial determination of custody or visitation of a child or for modification of a prior custody or visitation order, the court may enjoin a party having physical possession or custody of a child from removing the child from Illinois pending the adjudication of the issues of custody and visitation. Provides that injunctive relief shall be governed by the relevant provisions of the Code of Civil Procedure. Provides that, in entering a judgment concerning custody, joint custody, removal, or visitation (now, custody, joint custody, or visitation) and in modifying a judgment concerning custody, visitation, or removal (now, custody or visitation), the court shall apply the relevant standard of the Illinois Marriage and Dissolution of Marriage Act. Effective immediately.

ATM POINT OF SALE SURCHARGE

Amends the Electronic Fund Transfer Act in relation to notices required with respect to the imposition of surcharges. Removes the exemption from the notice requirements applicable to point-of-sale terminals.

INCOME TAX-ALS CHECKOFF

Amends the Income Tax Act to create the Lou Gehrig's Disease (ALS) Research Fund checkoff. Provides that the Department of Revenue shall print on its standard individual income tax form a provision indicating that if the taxpayer wishes to contribute to the Lou Gehrig's Disease (ALS) Research Fund, he or she may do so by stating the amount of the contribution on the return and that the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return. Amends the Department of Public Aid Law of the Civil Administrative Code of Illinois. Provides that, subject to appropriation, the Department of Public Aid shall make grants from the Lou Gehrig's Disease (ALS) Research Fund to the Les Turner ALS Foundation for research on Amyotrophic Lateral Sclerosis (ALS). Amends the State Finance Act to create the Lou Gehrig's Disease (ALS) Research Fund. Effective immediately.

EQUAL PAY ACT

Creates the Equal Pay Act of 2003. Provides that no employer may discriminate between employees on the basis of sex by paying wages solely on the basis of the employee's gender. Prohibits retaliatory discharge or discrimination against an employee on the basis of the employee's use of the Act and provides for penalties for violations of the Act, including a Class B misdemeanor for retaliatory discharge or discrimination by the employer. Provides that the Director of Labor shall administer and enforce the Act. Provides that every employer subject to the Act shall preserve specified records for not less than 3 years. Provides that every employer covered by the Act shall post a notice summarizing the requirements of the Act. Provides that the Department of Labor shall conduct ongoing outreach and education efforts concerning the Act.
