ILLINOIS ETHANOL BOARD ACT

Creates the Illinois Ethanol Board Act. Establishes the Board. Sets out the Board's duties including promoting the development and use of ethanol and implementing air quality improvement programs. Provides for the appointment of the Board by the Governor, with the advice and consent of the Senate. Provides for ex officio non-voting members from the Department of Commerce and Economic Opportunity, the Department of Agriculture, the Illinois Environmental Protection Agency, and a State university designated by the Governor. Specifies other powers and duties of the Board. Effective immediately.

EMERG TEL SYSTEMS-WARNING

Amends the Emergency Telephone System Act. Provides that moneys in an Emergency Telephone System Fund account established by a municipality or county may be used to pay for costs associated with emergency warning systems. Effective immediately.

$SUPP-EDUC ASSIST FUND

For Fiscal Year 2008, appropriates $23,472,892 (instead of $20,700,000) from the Education Assistance Fund to the State Board of Education for General State Aid - Hold Harmless. For Fiscal Year 2008, appropriates $3,618,167,108 (instead of $3,620,940,000) from the Common School Fund to the State Board of Education for General State Aid. Effective immediately.

ALTERNATE FUELS-NOTICE

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Requires the Department of Revenue to assist the Department of Transportation and any other applicable State agency in developing and maintaining a list and map of all refueling stations that provide E85 blended fuel or biodiesel fuel. Amends the Illinois Highway Code. Provides that, beginning July 1, 2008 and through June 30, 2013, the Department of Transportation must include the locations of all refueling stations that provide E85 blended fuel or biodiesel fuel on maps published by the Department. Effective immediately.

E85 INSTALLATION

Amends the Motor Fuel Sales Act. Requires that, no later than December 31, 2012, there must be installed, at each gasoline station or service station, one or more new E85 ethanol fuel dispensing pumps. Amends the Illinois Income Tax Act. Creates a tax credit, for taxable years ending on or after December 31, 2007 and on or before December 30, 2017, for taxpayers who install a new E85 ethanol fuel dispensing pump at a gasoline station or service station in Illinois during the taxable year in the amount equal to the cost of that installation. Provides that the credit: (i) may not exceed $80,000 per pump: (ii) may not be claimed in any one taxable year in an amount exceeding $20,000 per pump, but any excess amount may be carried forward; and (iii) may not be claimed with respect to the installation of more than one E85 ethanol fuel dispensing pump at any one station. Provides that the credit may be carried forward for 4 years. Effective immediately.

RENEWABLE MOTOR FUELS ACT

Creates the Renewable Motor Fuels Retail Infrastructure Development and Maintenance Act. Makes it a violation to sell motor fuel below cost. Provides that it is a violation of the Act to engage in motor fuel price gouging in response to the occurrence of a national disaster or State emergency, except where the sale is both an isolated and inadvertent incident. Provides that in certain instances it is not a violation of the Act to sell or advertise for sale motor fuel at a retail price that would constitute a below-cost sale. Allows concessions of up to 5% of the motor fuel sale, provided that the concessions are not given by the motor fuel retailer or an affiliate and that the cost of the concessions do not reduce the pump price and net amount paid for the motor fuel at the time of the sale. Establishes a Motor Fuel Cost and Bio-Fuels Blend Ratio Review Board. Removes, after the listed time period, the protection against predatory pricing for any retail motor fuel facility that fails to either offer motor fuels at retail with the required blend ratios or to have upgraded or installed an infrastructure at the retail motor fuel station that can safely store and dispense motor fuel containing ethanol alcohol or biodiesel in the required blend ratios. Sets out the duties and powers of the Department of Revenue, the Department of Agriculture, the Office of the State Fire Marshal, and the Attorney General. Effective 90 days after becoming law.

SCH CD-REIMBURSE TRANSPORTION

Amends the School Code. Provides that when calculating the State reimbursement for transportation costs, the State Board of Education may not deduct the number of pupils enrolled in early education programs from the number of pupils eligible for reimbursement if the pupils enrolled in the early education programs are transported at the same time as other eligible pupils.
