Rep. Dan Brady

Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code to provide coverage for autism spectrum disorders to the extent that the diagnosis and treatment of autism spectrum disorders are not already covered by the policy or plan. Provides that this coverage shall be subject to a maximum benefit of $36,000 per year, but shall not be subject to any limits on the number of visits to an autism service provider. Makes other changes. Effective immediately.

Designates the date of March 10, 2008 as Internet Safety Awareness Day in the State of Illinois.

Amends the Election Code. Prohibits county clerks and members of boards of election commissioners from making public endorsements of candidates and public questions. Effective immediately.

Amends the Criminal Code of 1961. Provides that a person commits disorderly conduct when he or she knowingly possesses while on, brings onto, or causes to be brought onto school property, property in which a school sponsored activity or event is being conducted, or property in which any activity or event that bears a reasonable relationship to school is being conducted, any facsimile firearm. Defines "facsimile firearm" as any replica, toy, starter pistol, or other object that bears a reasonable resemblance or that reasonably can be perceived to be an actual firearm. Provides that a violation by a person under 13 years of age at the time of the commission of the offense is a petty offense. Provides that a second or subsequent violation by a person under 13 years of age at the time of the commission of the offense is a Class A misdemeanor.

Amends the Illinois Vehicle Code. Provides that any person who fails to comply with a request by a law enforcement officer for display of evidence of insurance, shall, at the discretion of the law enforcement officer, have his or her vehicle towed or have his or her vehicle held at the scene until a display of evidence of insurance can be produced. Provides that, if the vehicle is towed, the owner of the vehicle shall be responsible for all towing and storage costs. Provides that a vehicle that has been towed for failure to display evidence of insurance shall not be released until a display of evidence of insurance is produced.

Amends the Illinois Insurance Code. Makes a technical change in a Section concerning the short title.

Creates the Unauthorized Alien Employment Prohibition Act and amends the Illinois Income Tax Act, the Illinois Human Rights Act, and the Right to Privacy in the Workplace Act. Provides that an employer shall not intentionally or knowingly employ an unauthorized alien. Provides for investigation of complaints. Provides for actions against an employer by the State's Attorney. Provides that the court may, depending upon the circumstances and with specified exceptions: order an employer to terminate the employment of unauthorized aliens; impose probationary periods; require affidavits or reports; or order suspension or revocation of certain licenses held by the employer. Provides that an employer shall verify the employment eligibility of hired employees through the basic pilot program administered by the Department of Homeland Security and the Social Security Administration. Creates the Employer Sanctions Legislative Study Committee to examine and report on laws and rules regarding employer sanctions. Contains provisions regarding: false and frivolous complaints; notices to U.S. Immigration and Customs Enforcement and local law enforcement agencies; expediting of actions; defenses; presumptions; information on the Attorney General's website; construction; notices by the Department of Revenue to employers; discrimination; severability; and other matters. Makes a violation of the discrimination provisions of the Unauthorized Alien Employment Prohibition Act a civil rights violation under the Illinois Human Rights Act. Deletes provisions that restricted the use of any Employment Eligibility Verification System. Some provisions are effective immediately.

Amends the Election Code. Provides that the State Board of Elections shall not accept for filing any petition for nomination for State Senator or Representative if the petition contains less than 10% of the number of signatures required by the Code. Effective immediately.

Amends the School Code. Provides that if a school district, upon request, provides information to another school district concerning the job performance or qualifications of an applicant for employment who is a current or former employee of the school district providing the information and that school district suspects that the current or former employee has abused a minor, then that school district shall inform the school district requesting the information of this suspicion. Provides that any school district, school board, or person participating in good faith in providing information of suspected abuse of a minor under these provisions shall have immunity from any liability, civil, criminal, or otherwise, that might result by reason of such action. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Property Tax Code. Deletes the requirement that certain fraternal organizations that receive an assessment freeze must submit an annual application. Effective immediately.
