Rep. Dan Brady

Amends the School Code with respect to MIA/POW scholarships. Provides that, for the purposes of the definition of "eligible veteran or serviceperson", a person shall be deemed to have entered service as an Illinois resident if he or she entered service while a resident of another state, left that service and became a resident of this State, and joined the Illinois National Guard or the reserves of the armed forces of the United States while a resident of this State. Effective immediately.

Amends the Illinois Vehicle Code. Requires the use of head lamps or daytime running lights at all times when a motor vehicle is operated upon any highway in this State, rather than just requiring the use of head lamps when certain atmospheric or daylight conditions are present. Provides that motor driven cycles and motorized pedalcycles are subject to the same lighted lamp requirements that currently only apply to motorcycles. Provides that law enforcement agencies acting in their official capacity are exempt from the provisions requiring the use of daytime running lamps or head lamps. Effective immediately.

Amends the Downstate Police, Downstate Firefighter, Chicago Police, Chicago Firefighter, Illinois Municipal Retirement Fund, and State Employee Articles of the Illinois Pension Fund. Allows an annuitant to re-enter service for a total of 2 years to fill positions vacated because persons are serving on active duty in the military, naval, or air forces of the State or federal government without impairing his or her pension benefits. In provisions amending the State Employee Article, exempts the changes from provisions concerning new benefit increases. Effective immediately.

Amends the Illinois Public Labor Relations Act. In the case of peace officers, expands the scope of arbitration to include residency requirements in municipalities of 1,000,000 or more population. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the State Employee Article of the Illinois Pension Code. Allows a State policeman who applies for retirement within 3 months after the effective date of the amendatory Act in order to take a judicial position to elect to establish eligible creditable service for periods employed by the Federal Bureau of Investigations for which credit is not held in any other public employee pension fund or retirement system. Requires payment of employee contributions, the employer's normal cost of the benefits accrued, and regular interest. Effective immediately.

Amends the Security Deposit Interest Act. Provides that the lessor shall, within 30 days after the end of each 12 month rental period, pay to the lessee any interest, by cash or credit to be applied to rent due, except when: (1) the lessee has signed an agreement with the lessor that the interest may be held in an account with the original security deposit, provided that interest shall accrue on the entire balance held for the lessee, including the original deposit and any interest previously accrued; or (2) the lessee is in default under the terms of the lease (instead of only when the lessee is in default under the terms of the lease).

Amends the Illinois Vehicle Code. Provides for the issuance of Emergency Medical Services license plates to licensed Emergency Medical Technicians. Provides that in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and at renewal. Provides that $15 of the additional original issuance fee and $23 the renewal fee shall be deposited into the EMS Assistance Fund. Provides that $10 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Effective immediately.

Amends the Election Code. Authorizes county clerks to use an electronic system for reporting deaths, when established as provided in the Vital Records Act, to purge voter registration records of the names of deceased voters (now, requires county clerks to purge voter registration records by using death-related records). Requires that persons in charge of vital records provide municipal boards of election commissioners with the names and previous addresses of persons over the age of 18 (now, 21) years who died in the past month.

Congratulates Kim M. Brunner, Executive Vice President, Chief Legal Officer and Secretary for State Farm Mutual Automobile Insurance Company, on his retirement.
