Amends the Counties Code. Provides that a board of health of a county or a multiple-county health department may (currently, shall) establish and carry out programs and services in mental health, including intellectual disabilities and alcoholism and substance abuse, not inconsistent with the regulations of the Department of Human Services.
Amends the Illinois Funeral or Burial Funds Act. Provides that, at the time of payment, a provider shall inform the purchaser of all the possible funding arrangements for a pre-need contract, including the distinctions between the financial results of funding the contract through a trust fund, Totten trust, annuity, or life insurance policy. Further provides that, at the time of payment, a provider shall make the purchaser aware of who the pre-need contract designates as the beneficiary.
Amends the Election Code. Provides that each election precinct shall contain 1,200 voters (now, 500 voters in counties, 600 voters in a municipality with a board of election commissioners and fewer than 500,000 inhabitants, or 400 voters in a municipality with a board of election commissioners and more than 500,000 inhabitants). Provides that, in a city with fewer than 500,000 inhabitants, if any election precinct casts more than 1,500 votes (now, 800 votes) at 2 consecutive general elections, the state's attorney shall apply to the Circuit Court to compel the board to divide the precinct. Provides that, in a city with more than 500,000 inhabitants, if any election precinct casts more than 1,200 votes (now, 600 votes) at 2 consecutive general elections, the state's attorney shall apply to the Circuit Court to compel the board to divide the precinct. Effective immediately.
Amends the Clerks of Courts Act. Provides that with regard to any notification required by law to be made by the circuit clerk to a party, the circuit clerk may reasonably rely upon any notice of the party's change of address received from the United States Postal Service as a true and correct statement of the party's current residential address.
Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that upon a motion by the parent who received orders for deployment, the court may delegate his or her visitation rights, or a portion of those rights, to a family member of that parent who has a substantial relationship with the child if the court determines that delegated visitation is in the best interests of the child. Provides that visitation rights delegated to a family member under the new provisions terminate upon: (1) the completion of the parent's deployment, in which case the previous custody or visitation order is reinstated; or (2) a showing that the delegated visitation is no longer in the best interests of the child. Provides that nothing in the new provisions increases the authority of a family member who is delegated visitation rights to seek separate visitation rights of the child. Effective immediately.
Amends the Election Code. Provides that when a county board of election commissioners is established in certain counties where any portion of a municipality with a municipal board of election commissioners is located, the application of certain provisions of the Code to the territory of that municipality located within that county is rejected. Authorizes the establishment of a county board of election commissioners by vote of the electors of any county with a population of less than 200,000, but more than 175,000 persons as of the 2010 federal census in which a city, village, or incorporated town or a part thereof with a board of election commissioners is located. Provides for the transfer of records from municipal board of election commissioners that has been abolished. Authorizes a county board to certify and submit a proposition to establish a county board of election commissioners. Provides that no appointed commissioner shall hold or be a candidate for any elective public or political office during his or her term. Provides that certain county boards of election commissioners shall be funded by an annual election fund tax not to exceed .040% of the value, as equalized or assessed, of all the taxable property within its jurisdiction. Effective immediately.
Amends the Illinois Funeral or Burial Funds Act and the Illinois Pre-Need Cemetery Sales Act. Provides that, before a seller and purchaser enter into a pre-need contract or pre-need sales contract, the seller must disclose and fully explain that the purchaser may fund the contract by choosing one of the following options: depositing the funds into a local banking institution; depositing the funds into a trust program; or other means offered by the seller. Provides that the purchaser shall then choose one of those options. Provides that sellers of pre-need sales contracts must be licensed by the Department of Financial and Professional Regulation. Makes other changes. Effective immediately.
Amends the Illinois Police Training Act. Increases the size of the Illinois Law Enforcement Training Standards Board from 20 members to 26 members by adding the Cook County Medical Examiner, 2 Illinois county board chairs, 2 Illinois county coroners from counties other than Cook County, and one active member of a statewide association representing coroners.
Amends the Juvenile Court Act of 1987. Provides that the Department of Children and Family Services shall develop and distribute to all guardians ad litem a bibliography containing information on parental alienation behaviors. Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that the training for guardians ad litem shall include a component on the dynamics of parental alienation behaviors and its effect on parents and children.
Creates the Education Streamlining Initiative Act. Contains only a short title provision. Amends the School Code to repeal the State Board of Education Article.
