REC TRAILS-FINES

Amends the Recreational Trails of Illinois Act. Provides that any person who does not comply with a Section of the Act pertaining to off-highway vehicle stickers may be fined not more than $250 for a first offense and not more than $500 for a subsequent offense. Provides that the moneys collected shall be deposited into the Off-Highway Vehicle Trails Fund.

CIGARETTES & TOBACCO-BAD DEBTS

Amends the Cigarette Tax Act, the Cigarette Use Tax Act, and the Tobacco Products Tax Act of 1995. Provides that, beginning on January 1, 2008, a distributor may deduct the amount of bad debts from the tax imposed under these Acts. Provides that "bad debt" means the taxes attributable to any portion of a debt owed to the distributor that is related to a sale of cigarettes or tobacco products subject to tax under these Acts, that is not otherwise deductible or excludable, that has become worthless or uncollectible, and that meets other criteria. Effective immediately.

USE/OCC TX-PROCEEDS-FUEL

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, beginning August 1, 2007 and continuing through July 31, 2009, each month the Department shall pay into the Road Fund 35% of the net revenue realized for the preceding month from the 6.25% rate under the Acts on the selling price of motor fuel and gasohol. Effective immediately.

ST PARKS-VERMILION COUNTY

Amends the State Parks Act, the State Finance Act, and the Illinois Pension Code. Requires the Department of Natural Resources to lease to the Vermilion county Conservation District, for one dollar, Kickapoo State Park, Harry "Babe" Woodyard State Natural Area, and Middlefork State Fish and Wildlife Area for their operation and management for 2 years. Requires a specified level of State appropriations for the District's use, and authorizes the District to retain revenues generated by the parks. Permits lease renewals. Creates a special fund in the State treasury for appropriations for the parks, and exempts the fund from fund sweeps. Provides that a Department employee assigned to Kickapoo State Park who then works for the Vermilion county Conservation District during the lease and subsequently returns to employment with the Department (i) retains his or her prior seniority within the Department and (ii) may apply for transfer of retirement fund creditable service accumulated during employment with the conservation district. Effective immediately.

ELECTIONS-NEW PARTY PETITIONS

Amends the Election Code. Makes the minimum petition signature requirement for a new State political party the same as that for a State office candidate of an established political party (now, the lesser of 25,000 or 1% of the number of voters voting in the most recent general election). Makes the minimum petition signature requirement for a new local political party the same as that for an established party candidate for the local office on the slate with the highest petition signature requirement (now, 5% of the number of voters in the relevant district or political subdivision who voted in the most recent election when district or subdivision officers were elected by the district or subdivision as a unit).

ELEC CD-OPEN PRIMARY

Amends the Election Code. Eliminates the requirement that a voter declare party affiliation when voting at a primary election. Provides that the voter shall receive the primary ballot of each of the established political parties nominating candidates for office at the primary election but may cast a ballot of only one political party, except in certain cases involving statewide political parties and political parties established only within a political subdivision.

$DHS-SENIOR CITIZEN SERVICES

Appropriates $2,000,000 from the General Revenue Fund to the Department of Human Services for a grant to Hope House in Rantoul, Illinois, for senior citizen services. Effective July 1, 2008.

SMKE FREE IL-PRIVATE CLUBS

If and only if Senate Bill 500 becomes law, then amends the Smoke Free Illinois Act to provide that smoking is allowed in a private club that has been in active and continuous existence prior to January 1, 2008, whether incorporated or not, and that can provide written documentation that three-fifths of its active members approve of smoking on the club's premises.

EXECUTIVE AIR FLEET-STUDY SALE

Encourages the Governor and the Governor's Office of Management and Budget to conduct a study to examine the possibility of selling or leasing the executive air fleet as a means to save money for the State of Illinois.

CRIM CD-NEG VEHICULAR HOMICIDE

Amends the Criminal Code of 1961. Creates the offense of negligent vehicular homicide, a Class A misdemeanor. Provides that a person commits the offense if the person's negligent operation of a motor vehicle is a proximate cause of the death of another person. Provides that a person acts negligently within the meaning of the provision if he or she fails to be aware of a substantial and unjustifiable risk of death or injury to others, and that failure constitutes a substantial deviation from the standard of care which a reasonable person would exercise under the circumstances then prevailing. Provides that the finder of fact may consider statutes and ordinances regulating the defendant's conduct in determining whether he or she was culpably negligent.
